PURSUANT to section 3 ·of the Motor-spirits (Regulation of Prices) Act, 1933, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and on the recom­ mendation of the Minister of Industries and Commerce, and for the purpose of consolidating and amending certain enactments heretofore in force, doth hereby make the following regulations. REGill,ATIONS. 1. These regulations may be cited as the Motor-spirits Price:;; Regulations 194-2. 2. These regulations shall come into force on the day following notification in the Gazette of the making thereof.* 3. (a) In these regulations, unless inconsistent with the context,­ " The said Act" mea.Qs the Motor-spirits (Regulation of Prices) Act, 1933: "Accredited agent" in relation to any sales area means an accredited agent of a wholesale vendor of motor-spirits acting as such under an agreement between the agent and his principal in force on the date of the coming into force in that sales area of district regulations as herein defined: ti34 Motor-spirits Prices Regulations 1942 [1942/228 "Appropriate differential" in respect of a price fixed in con­ nection with any sales area means the amount shown in the Second Schedule hereto which is found (a) in the column headed with the name of the scale referred to in the regulation fixing the price, and (b) in the line opposite the number of the set of differentiab made applicable to that sales area: " Bulk consumer" in relation to any sales area means a person who during anyone year commencing on the 1st day of January and ending on the 31st day of December buys for delivery in that sales area not less than 3,500 imperial gallons of motor-spirits for use in his own business or businesses and not for resale: "B depot agent" in relation to any sales area means a duly appointed agent of a wholesale vendor of motor-spirits acting under an agreement to distribute the products of such wholesale vendor of motor-spirits made between the B depot agent and his principal and in force on the date of the coming into force in that sales area of district regulations as herein defined : "District regulations" Bleans an Order in Council heretofore made under the Motor-spirits (Regulation of Prices) Act, 1933, fixing the price at which motor-spirits may be sold in any particular place or locality, and where more than one such Order in Council has heretofore been made referring to any particular place or locality means the first thereof in order of time : " Local authority" means the Council, Board, or other statutory governing authority of a borough, county, road district, town district, drainage district, water-supply district, river district, or electric-power district, and includes Domain Boards, Fire Boards, Harbour Boards, Hospital Boardf!, and Railway Boards: "' Main-port prices" means the amounts set out under the names "Scale A", "Scale B", "Scale C", "Scale D", and " Scale E" in the First Schedule hereto (being the prices at which motor-spirits may be sold in the Sales Areas 9, 70, 85, and 97 as designated in the Third Schedule hereto) : " Price" means a price per imperial gallon: " Sales area" means a sales area described in the Third Schedule hereto: " Premium grade motor-spirits" means any motor-spirits which may by any regulations hereafter enacted be declared to be premium grade motor-spirits for the purposes of these regulations: "Standard grade motor-spirits" includes all kinds of motor­ spirits other than motor-spirits which for the time being are declared to be premium grade motor-spirits. (b) For the purposes of Regulations 6, 7, 8, lO, and 11 hereof there shall be applicable to any sales area the set of differentials bearing the number appearing in the description of that sales area in the. Third Schedule hereto. 1942/228] Motor-spirits -Prices Regulations 1942 535 (c) The amounts set out in the First Schedule hereto are sums of money set out in shillings, pence, and fractions of a penny; the amounts set out in the Second Schedule hereto are sums of money set out in pence and fractionB of a penny. (d) The description of saleR set out in the hea,dings to the First and Second Schedules hereto respectively and the names of localities appended to descriptions of Rales areas in the Third Schedule hereto, being intended for conveniencc of reference only, shall not control or in any way affect the interpretation of th"se regulations. 5. These regulations shall a}>ply to contracts whether entered into in any particular sales area specified in the Third Schedule hereto or elsewhere, but only to cont.racts for delivery within that sales area, and every price mentioned to be charged by whole;;alers of motor­ spirits meam1 the price to be charged for delivery withiu that sales area to a purchaser either in containers holding not less than 44 imperial gallons or in bulk into tanks. 6. The minimum price and maximum price at which a wholesaler may sell by wholetiale standard grade motor-spirits for delivery in any particular sales area shall be the amount set out in the column headed "Scale A " in the First Schedule hereto plus the appropriate differential : Provided that the said maximum price shall not apply- (a) To any sale made during the first fifteen days of any month in respect of which payment of the purchase-price has not been made before t.he end of that month; (b) To any sale made during any part of a month after the first fifteen days thereof in respect of which payment of the purchase-pricn has not been made prior tb the sixteenth day of the next following month. 7. The minimum price and maximum price at which a wholesaler may sell standard grade motor-spirits to his accredited agent for delivery in any particular sales area-- (a) When sold in receptacles containing not less than 44 imperial gallons and for 1"(>8ale in recept.acles containing not less than 44 imperial gallons, shall be t.he amount set out in the column headed "Scale C" in the First Schedule hereto plus the appropriate differential; (b) 'Vhen otherwise sold, shall be the amount set out in the column headed "Scale A" in the First Schedule hereto plus the appropriate differential: Provided that the said maximum price shall not apply to any sale in respect of which payment of the purchase-price has not been made prior to the twenty-first day of the month next following the month in which such sale was made. 8.
