Based on the feedback that Bane NOR had received from the Authority via the preceding consultation process, Bane NOR postponed its determination of surcharges in accordance with section 6-3 of the Railway Regulations. Bane NOR was to compile more detailed documentation for potential proposals for surcharges. In this report, Bane NOR will explain the data for proposed surcharges in the infrastructure charge for three (3) market segments. These will come into force on 1 January 2019 in accordance with section 6-3 (6). The surcharges were announced in Bane NOR’s draft consultation, so the obligation to provide notification is hereby observed. The report also includes how current market segmentation will be continued on the Gardermoen Line in 2018. The audit of the market segmentation and the new surcharges is to be approved by the Ministry of Transport and Communications. In connection with the consultation on the plan, the Norwegian Railway Authority (SJT) recommended that Bane NOR should document better terms in order to specify a surcharge to the infrastructure prices based on section 6-3 of the regulations. Surcharges – in accordance with corresponding rules previously – were implemented for use of the Gardermoen Line as of 2000 [3]. When Bane NOR proposed a different approach to market segmentation in line with the new Railway Regulations, there would have to have been notification at least “three months before the deadline for publication of the network guide” before the change can be implemented. Price surcharge for individual market areas Page 5 Infrastrukturavgifter 3 Summary and summing up 3.1 Proposal for infrastructure charges, including surcharges Given the documentation of relevant market areas’ ability to pay, plus the fact that the surcharges in question in the infrastructure prices are in accordance with section 6-3 of the Railway Regulations [2], Bane NOR establishes the following prices for use of the infrastructure (minimum package); see Table 3-1. The changes have been announced in connection with the consultation on the draft implementation plan that took place in April and May 2017. 3.2 Continuation of surcharges in 2018 In 2000, the Gardermoen Line (Oslo – Gardermoen) was defined as a separate market area and a special surcharge was applied to the line; see [3]. Bane NOR has assumed that this surcharge now falls under section 6-3 of the Railway Regulations. The amendments to Bane NOR’s market division and surcharges will come into force in 2019; but the current surcharges will be continued in 2018, but adapted to a new basic price for the line. The basic price up to and including 2017 has been zero (0) Norwegian kroner (NOK), but will be 0.97 øre per gross tonne-kilometre in 2018. Surcharges in the infrastructure charge restricted to the Gardermoen Line (Oslo – Gardermoen) are established at 7.5 øre per gross tonne-kilometre. This will be applicable in 2018, while the new market division and surcharges will take effect from 2019. Price surcharge for individual market areas Page 6 Infrastrukturavgifter 4 Market division Bane NOR’s new market segmentation in accordance with section 6-3 of the Railway Regulations is reproduced below; see also [1]. As can be seen from section 6.1, market segmentation linked with the Gardermoen Line has existed since 2000. Bane NOR’s segmentation now includes the entire railway market in Norway. Up to and including 2017, there has been a separate infrastructure price for freight trains with an axle load in excess of 25 tonnes. This was justified by the axle load and applied to all market areas in respect of freight services. This special charge will cease as of 2018. The proposed surcharges in respect of freight services are linked to specific market areas. 4.1 Proposal for market segmentation Bane NOR has also assessed other market areas of relevance in a Norwegian context. These areas are based on separation between freight services and passenger services. Figure 4-1 shows Bane NOR’s division of the
