Senator Jon Tester and Representative Cynthia Lummis Introduce Bills to Protect the Importation of Historically Significant U.S.-Made Rifles In February 2011, Sen. Jon Tester (D-Mont.) and Rep. Cynthia Lummis (R-Wyo.) introduced the Collectible Firearms Protection Act, S. 381 and H.R. 615, respectively. The bills propose to amend the Arms Export Control Act to guarantee that U.S.-made military firearms that were previously exported to a foreign government, and which under that law are eligible for re-importation into the U.S. as "curios and relics,"1 will not be blocked from importation. Sen. Tester’s and Rep. Lummis’ bills are a result of a decision of the Obama Administration to reverse its approval of a permit to import historic M1 Garand rifles and M1 carbines that the U.S. provided many years ago to South Korea. Because the rifles had been exported under the authority of the Department of State, the department claimed authority over their importation back into the United States. The department claimed that the rifles might be used "for illicit purposes," but the rifles are among the types of firearms least often misused. In fact, they are two of the four rifles most commonly used for marksmanship competitions in this country. As examples, the M1 is the only rifle used in the Civilian Marksmanship Program’s (CMP) John C. Garand Matches at the national, state and local levels, and the carbine is the only rifle used in CMP’s M1 Carbine Match series. M1 rifles and carbines have always been legal to manufacture in the United States and have been manufactured in large numbers. The federal government also authorizes original M1 rifles and carbines in government inventory to be sold to collectors and marksmanship competitors through the CMP. All told, M1 rifles and carbines are owned by hundreds of thousands of Americans, and have been for many years. Few firearms are so highly regarded for their historical significance. The Tester-Lummis bills will ensure that Americans will be able to acquire these useful, high-quality and interesting rifles for themselves and their sons and daughters for many years to come. M1 "Garand" Rifle (introduced in 1936) M1 Carbine (introduced in 1942) Notes: 1. "Curios and relics" are firearms "of special interest to collectors" that were "manufactured at least 50 years prior to the current date" and similar categories of firearms. The M1 rifles and carbines in question were manufactured in the 1940s and 1950s. The Arms Export and Control Act [22 U.S.C. 2778 (b)(1)(B)] provides that military firearms of U.S. manufacture, which have been exported to a foreign government, are eligible for importation back into the United States if they have at any time been eligible for importation as "curios and relics" and are owned by the foreign government. Under the Firearms Owners Protection Act (1986) the Attorney General is required to approve the importation of "curio and relic" firearms and firearms that are "particularly suitable for or readily adaptable to sporting purposes" [18 U.S.C. 925(d)], a standard that M1 rifles and carbines easily meet.
