Regulatory Update - Indonesia Changes to Accredited Laboratory Lists for HKT and non-HKT Devices Further to PCS’s Regulatory Update dated 29th April 2020, the Indonesian Regulator - Direktorat Jenderal Sumber Daya dan Perangkat Pos dan Informatika (SDPPI) – has updated the accredited laboratories list whereby a paperwork Type Approval application process can be followed. This updated list is effective immediately, from 23rd July 2020. As a reminder, a paperwork-only approach for applications to SDPPI is currently permitted for all devices if all test reports are from an SDPPI-accredited laboratory. In any other case, local testing is required. This requirement is split into HKT devices (Cellular Phones, Handheld Computers, Computer Tablets) and non-HKT devices (all other categories). Both lists of accredited labs for HKT and non-HKT are now consolidated into one regulation -124 Tahun 2020. This is included as an attachment to this Regulatory Update, as well as a PCS English translation. There are now 16 labs on the HKT list, down from 33. There are now 72 labs on the non-HKT list, down from 150. Both HKT and non-HKT lab lists are valid until 23rd January 2021. Law Number 36 of 1999 concerning Telecommunications (State Gazette of the Republic of Indonesia of 1999 Number 154, Supplement to the State Gazette of the Republic of Indonesia Number 3881); 2. Government Regulation Number 52 of 2000 concerning Telecommunications Operation (State Gazette of the Republic of Indonesia of 2000 Number 107, Supplement to the State Gazette of the Republic of Indonesia Number 3980); 3. Presidential Regulation Number 54 Year 2015 concerning the Ministry of Communication and Information (State Gazette of the Republic of Indonesia Year 2015 Number 96); 4. Regulation of the Minister of Communication and Information Technology Number 16 of 2012 concerning Guidelines for Implementing the Recognition of Foreign State Test Offices (State Gazette of the Republic of Indonesia Year 2012 Number 578); 5. Regulation of the Minister of Communication and Information Technology Number 6 Year 2018 concerning Organization and Work Procedure of the Ministry of Communication and Information Technology (State Gazette of the Republic of Indonesia Year 2018 Number 1019); 6. Regulation of the Minister of Communication and Information Technology Number 7 of 2018 concerning Electronic Business Licensing Licensing Services in the Field of Communication and Information Technology (State Gazette of the Republic of Indonesia of 2018 Number 1041), as amended by Regulation of the Minister of Communication and Information Technology Number 7 of 2019 concerning Changes to Ministerial Regulation Communication and Information Number 7 of 2018 concerning Electronic Business Licensing Services for Communication and Information Technology (State Gazette of the Republic of Indonesia of 2019 Number 841); 7. Regulation of the Minister of Communication and Information Technology Number 16 of 2018 concerning Operational Provisions for the Certification of Equipment and / or Telecommunications Equipment (State Gazette of the Republic of Indonesia of 2018 Number 1801); DECIDED : To stipulate : DECREE OF THE DIRECTOR GENERAL OF RESOURCES AND POS AND INFORMATION DEVICES CONCERNING RECOGNITION OF OVERSEAS LABS IN THE FRAMEWORK FOR CERTIFICATION OF EQUIPMENT AND / OR TELECOMMUNICATION DEVICES. FIRST : Establish laboratory testing tools and / or telecommunications equipment: a. cellular telephone, handheld computer, and tablet computer as listed in Attachment I which is an integral part of this Decision of the Director General; and b. other than cellular telephones, handheld computers, and tablet computers as listed in Attachment II which is an integral part of this Decree of the Director General, as Overseas Labs which is recognized in the process of certifying telecommunications tools and / or equipment in accordance with statutory provisions. SECOND : Recognition of testing laboratory for telecommunication tools and / or equipment as the Overseas Labs as referred to in the FIRST Dictum shall be valid for 6 (six) months after this Decree of the Director General comes into force. THIRD : For the purposes of certifying telecommunications tools and / or equipment, the Overseas Labs as referred to in the FIRST Dictum, must: a. conduct tests in accordance with the technical requirements of telecommunications tools and / or equipment applicable in the territory of the Unitary Republic of Indonesia; and b. attach a summary of the Test Result Report page reference related to the Indonesian technical requirements that become the reference of testing. FOURTH : The Overseas Labs as referred to in the FIRST Dictum shall report to the Director General of Resources and Equipment of Post and Information Technology in the event of changes: a. name of the Labs; b. place of domicile; c. legal, business, organization, or accreditation status; and / or d. other matters that may affect the testing of telecommunication tools and / or equipment in accordance with the technical requirements and provisions in force in the territory of the Unitary Republic of Indonesia. FIFTH : The report on the change of name and domicile of the Overseas Labs as referred to in the FOURTH Dictum letter a and letter b will be recorded in the database of the Overseas Labs of the Directorate General of Resources and Equipment of Post and Information Technology, and will continue to be recognized as an Overseas Labs in the certification process telecommunication tools and / or equipment. SIXTH : Report on changes as referred to in the FOURTH Dictation letter c and letter d are evaluated by the Directorate General of Resources and Equipment of Post and Information Technology. SEVENTH : The recognition of the Overseas Labs can be revoked before the expiry of the period as referred to in the SECOND Dictum in terms of: a. Accreditation status as a test center is determined by: 1. The Accreditation Institution signing the Asia Pacific Accreditation Cooperation Mutual Recognition Agreement (APAC-MRA) and / or International Laboratory Accreditation Cooperation-Mutual Recognition Arrangement (ILAC-MRA); and / or 2. international institutions or telecommunications regulators in other countries, revoked or no longer valid; and b. based on the evaluation results, the Test Report (LHU) or test report issued by the Foreign Test Center is not in accordance with the technical requirements applicable in the territory of the Unitary State of the Republic of Indonesia. EIGHTH : This Decree of the Director General shall come into force on July 22, 2020.
