Confirmation of minutes of the 192nd meeting of Executive Committee held on 25.04.2014 at New Delhi. It was noted that 192nd meeting of Executive Committee & its adjourned meeting was held on 25.04.2014 & 16.05.2014 respectively at New Delhi. The minutes of the same were circulated to all the members of the Executive Committee on 20.05.2014 by email and by speed post vide letter No. 5-1/2014 (192nd EC) dated 21.05.2014 to suggest addition/deletion in respect of correctness of the minutes. However, the minutes, were also placed before the EC at the time of consideration of the same. Executive Committee confirmed the same. Agenda Item No. 2. Letter of GOI in respect of Legal Opinion from the Ministry of Law & Justice regarding representation of Deemed Universities in the Statutory Bodies and further notification by GOI in view of Legal Opinion- regarding. It was noted that a legal opinion has been received from the GOI, Ministry of Health & Family Welfare, Deptt. of AYUSH regarding representation of Deemed Universities in the Statutory Bodies vide their letter No. A.11019/7/14-EC/CCIM (University Election) dated 01.05.2014. Contents of the letter are as under:- 193ec minutes 1 (a) “ The referring Department seeks to be advised on the issue as to whether all „Deemed Universities‟ are entitled to elect a member from their faculty to represent in CCIM under Section 3(1)(b) of IMCC Act. (b) Similarly, Section 2(f) of UGC Act,1956 defines „University‟ as under: “ University means a University established or incorporated by or under a Central Act, a Provincial Act or a State Act, and includes any such institution as may, in consultation with the University concerned, be recognized by the Commission in accordance with the regulations made in this behalf under this Act.” (c) As regards to „Deemed University‟, Section 3 of the UGC Act, 1956 read as under: “The Central Government may, on the advice of the Commission, declare by notification in the official Gazette, that any institution for higher education, other than a University, shall be deemed to be a university for the purposes of this Act, and on such a declaration being made, all the provision of this Act, and on such a declaration being made, all the provisions of this Act, shall apply to such institution as if it were a University within the meaning of clause(f) of section 2.” (d) According to Section 2(k) of the IMCC Act, „University‟ for the purpose of IMCC Act is a University, which has been established by a law made by the competent legislature. Whereas Deemed Universities are the institutions which have been notified under Section 3 of the UGC Act as Deemed University, and there is no condition that those institutions should have been established by law. Since Deemed Universities are not the Universities established by any law, they cannot be recognized as University for the purpose of “University” under Section 2(k) of IMCC Act. Hence, no further election shall be conducted from any Deemed University for Central Councils (Statutory Bodies) in the light of opinion rendered by Legal Affairs Department of Ministry of Law & Justice.” Further, Govt. of India vide Notification No. S.O. 1087(E) dated 15.04.2014 has rescinded the following three Notifications by which Vd. Deodatta S.Bhadlikar (University representative of Padamshree Dr. D.Y. Patil Deemed University, Navi Mumbai), Dr. C. Nagarajan (University representative of Amrita Vishwa Vidyapeetham University, T.N.) and Dr. B. Sreenivasa Prasad (University representative of KLE University, Belgaum, Karnataka) had become the members of CCIM:- 1. S.O. 1757 (E), dated the 13th July, 2009 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 16th July, 2009. 2. S.O. 2816 (E), dated the 29th November, 2012 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 4th December, 2012; and 3. S.O. 188 (E), dated the 16th January, 2013 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 17th January, 2013. 193ec minutes 2 Since the rescinding of all the three Notifications have come into force at once i.e. with immediate effect from Notification No. 1087 published on 15.04.2014, therefore, all the above three members representing Deemed Universities, may no longer be treated as the members of CCIM. Executive Committee noted and decided that a letter be written to all the concerned. Agenda Item No. 3. Visitation of Rama Krishna Ayurvedic Medical College and Research Centre, Bangalore, Karnataka under Section 13C for the session 2014-2015 – regarding. It was noted that Rama Krishna Ayurvedic Medical College and Research Centre, Bangalore, Karnataka was visited on 27-28.01.2014 by Dr. Jageshwar Prasad Chaurasia and Dr. Basavaraj S. Hiremath. After going through the report it has been observed that part I has not been submitted along with the visitation report. Executive Committee noted that Part- I has already been received and assessed accordingly with approval of President I/c, CCIM as informed by the office. Agenda Item No. 4. Regarding visitation to Dharma Ayurveda Medical College, Sriperumbudur (T.N.). It was noted that an email letter was received dated 21.01.2014 by Dr. Goudar Amaregouda Mahantagouda, Dr. Rajashekhar Ganiger and Dr. Amit Kumar Sharma regarding Visitation of Dharma Ayurveda College, Sriperumbudur, Tamil Nadu for session 2014-15 under Section 13C in respect of denial of college authorities to get the visitation done. The matter alongwith letter of visitors was reported in 187th EC held on 17.02.2014 under Agenda Item No. 8. The decision of EC was as under: “Executive Committee agreed to consider the letter of visitors as report of the College” Accordingly, the matter of Dharma Ayuvedic College was placed before Screening Committee held on 08.05.2014 and Screening Committee decided not to recommend to GOI for granting permission for the session 2014-15 as college has denied visitation. Executive Committee agreed to the recommendation of Screening Committee and decided to send the recommendation to Govt. of India. 193ec minutes 3 Agenda Item No. 5. Regarding recommendation of Govt. Ayurved College Dhanwantri Nagar, Taluk Kanayannur, Tripunithura, Kerala under Section 13C. It was noted that the Screening Committee had given the following recommendation in respect of Govt. Ayurvedic College, Tripunithura, Kerala for academic session 2014-15 :- Recommended for UG 50 seats & PG in 06 subjects namely:- 1. Shalakya tantra (Shiro Nasa) -04 seats 2. Dravyaguna -04 seats 3. Swasthavritta -04 seats 4. Panchkarma -04 seats 5. Shalya tantra (Samanya) -05 seats 6. Rasashastra & Bhaisajyakalpna-04 seats However, due to typographical error the seats in respect of Rasahastra & Bhaisajyakalpna has been wrongly informed to the 192nd Executive Committee as 06 (instead of 04) seats. Hence, number of seats in the said subject be read as 04 seats. Executive Committee noted the same. Agenda Item No. 6. Regarding recommendation of S.R.M Govt. Ayurvedic College, Bansmandi, Bareilly, Uttar Pardesh and Govt. Ayurvedic College, Jalukbari, Gawahi under Section 13C. It was noted that due to typographical error in the minutes of Screening Committee, visitation reports of S.R.M. Govt. Ayurvedic College, Bansmandi, Bareilly, U.P. and Government Ayurvedic College, Jalukbari, Guwahati under Section 13C, the number of seats recommended for UG was mentioned as 50 and 60 respectively instead of 40 and 50 seats as sanctioned by GOI. Therefore, the seats as reported to 189th EC in respect of these two colleges be read as 40 seats (in case of S.R.M. Govt. Ayurvedic College, Bansmandi, Bareilly, U.P.) and 50 seats (in case of Government Ayurvedic College, Jalukbari, Guwahati) respectively. Further, it was informed that the recommendations of these two colleges as per actual sanctioned seats by GOI have been sent with the approval of President I/c, CCIM. Executive Committee noted the same. 193ec minutes 4 Agenda Item No. 7. Regarding recommendation received from Director, AYUSH, Bangalore to carry over system to BAMS Students. It was noted that a letter No. AYUSH/61/DEV (2)/2013-14 dated 22.02.2014 from the Director of AYUSH, Bangalore, Karnataka regarding recommendation to carry over system to BAMS students and forwarding therewith a letter of Registrar, Rajiv Gandhi University Health Sciences, Karnataka, Bangalore dated 17.02.2014. As per the letter, the above said University conducted the Ist BAMS professional examination as per the new guidelines. As the percentage was very less, the students submitted a requisition to the Hon’ble vice-chancellor requesting for carryover to second BAMS. As per the new guidelines, it was not possible but keeping in view the above request of the students a joint meeting of CCIM members of Karnataka & Chairman, Board of Studies & members (UG-Ayu) was held on 27.12.2013. In the meeting the matter was discussed in detail and it was resolved unanimously to recommend to CCIM to revise the 2012 Regulation as follows: 1.
