Certified copy of an order of the Commissioners of Sewers for Caldicot Hundred, Monmouthshire, quashing thejpresentment of the jury made before the Court on 10 March 174-5 /Vfkjy/Sj, whereby 6 perches on broadstreet common were to be done by Eton College at 5s. a perch, and a gout was to be made by the College; and ordering that the cost of maintaining the hollow tree in the same stank was to be paid by the Provost and Fellows as brinkers on one side, and a moiety of the expense to be borne by the other brinker, Charles Griffiths, jun. 728. Copy of presentments of the jury to the Commissioners of Sewers, 11 March 1744- /T744/57 and 11 March 1745 /J745/67; questions on the presentments which the jury should be called upon to explain; statement of the case to be submitted to the Court of Sewers on behalf of Eton College concerning their liability to repair a certain stretch of sea wall. The College questions the identification of the wall and claims that neither in the Old Book nor in the New Book was it shown that Eton was chargeable for its upkeep beyond a small share. Certified copy of order by the Commissioners of Sewers for Caldicot Hundred, Monmouthshire, at the Court held at Newport, 14 October 28 George II, 1754: that the order made by the Court on 8 April 1754 appointing William Phillips and Samuel Evans, gent., expenditors on the two gouts on the end of Monkditch pill next to the sea which are defective and worth the doing £20, and which ought to be done by the Provost and Fellows of Eton College, be renewed. The expenditors are to employ workmen to do the repairs as soon as possible and upon production of their accounts shall have reimbursement. Subscribed: Examined by W. Williams, Clerk to the Commissioners. Payment due to the Clerk for this and the former order 5s. 144 730. ?1755. Goldcliff parish: an account of damages alleged to have been done to the Provost and Fellows of Eton College by Samuel Evans to the detriment of the sea walls etc. since the death of Westcot Littleton, vicar of Goldcliff, 12 December 1754. Subscribed: The several articles above exhibited against Mr Samuel Evans have been examined by me and I do certify that the same appear to be il l grounded frivolous and very much to the detriment of Mr Evans his Character given under my hand the 23d of July 1755* Charles Van. Francis (the second of the names who made the presentment against Evans, but the hand is difficult to read) 145 ECCLESIASTICAL 731' Mandate of Thomas /Cranmer/, Archbishop of Canterbury, to all rectors, vicars etc. in the Province of Canterbury, Manor of Lambeth, 11 February 1534 in the 2nd year of his episcopacy. Recites that a writ gravi cum querela was shown to him on the part of the Provost and Fellows of Eton College, rectors or proprietors of the parish church of Nash in the diocese of Llandaff, that when master Griffin Leyson, doctor of laws, commissary appointed to visit the city and diocese of Llandaff, visited the parish church of Chepstow in the deanery of Netherwent in the diocese of Llandaff on 15 September last past, he sequestered the ecclesiastical fruits, issues and emoluments of the parish church of Nash because the chancel was in disrepair, and for other reasons sufficiently proved before him on the part of the parishioners, and granted custody of the things sequestered to Robert Smyth and William Sampson, parishioners of the said parish. But because the Provost and Fellows, rectors and proprietors of the said church, offered a sufficient and fi t pledge for repairing the chancel before a day to be fixed by the commissary, and to do other things which the Provost and Fellows, by reason of the appropriation of the said church, and by right and custom, were bound to do, he reversed the sequestration. The Archbishop ordered that the keepers of the things sequestered should no longer detain the fruits and emoluments of the said church after intimation of the reversal of the sequestration, but should permit the Provost and Fellows or their deputies to enjoy their ecclesiastical rights there. But Robert Smyth and William Sampson notwithstanding retained to themselves the levying, collection and receipt of the fruits and emoluments of the church, in contempt of the order. The Archbishop therefore orders the recipients to inhibit Robert Smyth and William Sampson, or anyone else, from detaining the fruits and emoluments of the church, and to permit the Provost and Fellows to enjoy their ecclesiastical rights freely and peaceably themselves or through ministers, upon pain of excommunication. Petition of the Provost and Fellows of Eton College to the Lords Commissioners of the Great Seal: The Provost and Fellows ask that their error in presenting the Revd. Thomas Skinner in August 1756 to the discharged vicarage of Christchurch, Monmouthshire, be overlooked, and that his presentation be confirmed. The vicarage was void, as it was thought, by the cession of the Revd. Mr John Pettingall, who had held it for 4 years with another small living by acquiescence of the College at the request of the Bishop of Lincoln. It has since been discovered that, though discharged, Christchurch is rated at over £10 in the King's books, and therefore the right of presentation belongs to the Lords Commissioners of the Great Seal. 146 MISCELLANEOUS 733. 12 October 17^7- Petition of the free and customary tenants of the manor of Goldcliff to the Provost and Fellows of Eton College, in favour of taking down Goldcliff mill. Two copies of a printed notice about the woods which Thomas Bold issued on behalf of the College, threatening legal action against anyone who cuts down or enters the woods on the College estate.
