Compulsory regulations at seaport Kavkaz (hereinafter referred to as Compulsory Regulations) have been developed in accordance with Federal Law No. 261-FZ of November 8th, 2007, "About Seaports in the Russian Federation and introduction of amendments to Certain Legislative Acts of the Russian Federation", Federal Law of April 30, 1999 No. 81-FZ "Merchant Shipping Code of the Russian Federation 1" (hereinafter referred to as MSC of the Russian Federation), General Rules of navigation and staying of the vessels in the Seaports of the Russian Federation and Approaches to them 2) (hereinafter referred to as General Rules). 2. These Compulsory Regulations contain a description of the seaport Kavkaz (hereinafter referred to as the Seaport); rules for the arrival of vessels into the seaport and the departure of vessels from the seaport, including arrangements for the safety of navigation for the arrival of vessels into the seaport and the departure of vessels from the seaport; rules of navigation in the water area of the seaport and in approaches to it; the description of the service area of vessel traffic control systems and the rules of navigation in these areas; rules for the staying of the vessels in the seaports with indication of their staying; rules for marine environmental protection including the establishment of types of shipboard wastes to be collected in the seaport, enforcement of the rules of quarantine regulations in the seaport; rules for special means of communication within the territory of the seaport; information about the seaport limits; information about the sea port approaches; information on the limits of the sea areas A1 and A2 of the Global Maritime Distress and Safety System (hereinafter referred to as 1 Russian Federation Code, 1999, No.18, art.2207; 2001, No.22; art.2125; 2003, No.27, art. 2700; 2004, No.15, art.1519, No.45, art. 4377; 2005, No.52, art.5581; 2006, No.50, art. 5279; 2007, No.46, art. 5557, No.50, art. 6246; 2008, No.29, art. 3418, No.30, art.3616, No.49, art. 5748; 2009, No.1, art. 30, No.29, art. 3625; 2010, No.27, art. 3425, No.48, art. 6246; 2011, No.23, art.3253, No.25, art. 3534, No.30,art. 4590, 4596, No.45, art. 6335, No.48, art. 6728; 2012, No.18, art. 2128, No.25, art. 3268, No.31, art. 4321; 2013, No.30, art.4058; 2014, No.6, art.566, No.42, art.5615, No.48, art. 6659; 2015, No.1, art. 89, №13, art. 1810, No.29, art.4339, 4356; 2016, No.27, art. 4186, art. 4215, 2017, No.7, art. 1029, No.27, art. 3945, No.30, art. 4457, No.52, art.7923; 2018, No.1, art.44. 2 Order of Ministry of Transport of the Russian Federation dated 26 October2017 No.463 «About approval of general rules for navigation and mooring of vessels in the seaports of the Russian Federation and in approaches to them" (registered by the Ministry of Justice of Russia of 23d March, 2018, registration number No. 50497). GMDSS); information on technical capabilities subject to vessel processing; information about period of navigation; information about the areas of compulsory pilotage of vessels; information about the depths of the water area of the seaport and approaches to it; information about dangerous cargoes handling; information about navigation in ice-covered waters and in their approaches to it; information about transmitting data by the Masters of the vessels which are in the seaport, if there is a threat of acts of unlawful interference within the seaport; information about transmitting navigational and hydro meteorological data by Masters of the vessels which are in the seaport; any other information stipulated in the statutory and legal acts of the Russian Federation in the field of merchant shipping. 3. These Compulsory Regulations are subject to execution by the vessels irrespective of their national and departmental identity, as well as by individuals and juridical persons, regardless of the business category that carry out activities in the seaport. 4. Navigation of vessels in the seaport and in approaches to it, vessels staying in the seaport water area shall be carried out in accordance with the General Rules and these Compulsory Regulations. II. Description of the seaport 5. The seaport is located in the north-eastern part of the Kerch Strait on the Taman Peninsula in the southern extremity of the Chushka Spit on its western coast and consists of the following Areas: - Area 1 of the seaport waters (hereinafter referred to as Area No. 1). It includes the northern port area (the inner boot basin of the northern area with turning circle, the approach channel to the northern area, the area of perspective development of the north- eastern cargo area, the channel No. 28 (the area of the south-eastern elbow in the direction 323.5°-143.5° as far as crossing the direction of 67°-247° Fairway No. 50), the southern area, the approach fairway to the southern area; - Area 2 of the seaport waters (hereinafter referred to as Area No. 2). includes deep-water road cargo transfer area No. 2; - Area 3 of the seaport waters (hereinafter referred to as Area No. 3). includes deep-water road cargo transfer area No.3; - Area 4 of the seaport waters (hereinafter referred to as Area No. 4) includes anchorage place No. 455. 6. The seaport limits are established by Government Resolution of the Russian Federation dated August 12th, 2009 No. 1150-p3). 7. Navigation in the seaport is provided all-year-round, the seaport operates within 24 hours and has the cargo stationary multilateral checkpoint through the state border of the Russian Federation 4). 3 Russian Federation Code, 2009, No.33, art.4156; 2011, No.34, art.5046; 2012, No.27, art.3841; 2014, No.33, art.4608; 2017, No.45, art.6701. 4 Government Resolution of the Russian Federation dated 29 November 2017. No. 2665-р. (Russian Federation Code, 2017, No.49 art. 7527) 8. Sailing conditions in the seaport are distinguished by negative and positive surge oscillations during the strong southerly winds. When wind speed is of 15 meters per second or more (hereinafter referred to as a gale warning), the current speed in the Kerch Strait increases up to 2.8 knots, the waves reach height of 5 meters. 9. The seaport Kavkaz is not a sheltering place for ships in stormy weather. 10. The seaport is included in the operation zone of the sea areas A1 and A2 of the GMDSS. 11. Kerch-Yenikal Canal (hereinafter referred to as KYC), the Tamansky navigable waterway, consisting of the fairway No. 50, the passage area between the fairways No. 50 and No. 52 and the fairway No. 52 (hereinafter referred to as TNW), are located in the approaches to the seaport, as well as prohibited area for navigation in the zone of construction of the transport passage through the Kerch Strait 5 and the ferry port zone (hereinafter referred to as FPZ), as described in paragraph 31 of these Compulsory Regulations. Information on approaches to the seaport is given in Annex No. 1 to these Compulsory Regulations. 12. Information on TNW, KYC, northern port area, the approach channel to the northern port area and the turning circle of the northern port area, the southern port area and the approach channel for the southern port area are given in Annex No. 2 to these Compulsory Regulations. - Information on technical capabilities of the seaport with regard to vessels acceptance is given in Chapter X of these Compulsory Regulations and in Annex No. 3 to these Compulsory Regulations. - Information on the very high frequency communication channels used in the seaport (hereinafter - VHF) are given in Annex No.4 to these Compulsory Regulations. - Information on anchorages in the seaport is given in Annex No. 5 to these Compulsory Regulations. 13. The seaport provides the towing service for vessels. Information on the minimum number and minimum capacity of tugboats for mooring operations of vessels in the seaport is given in Annex No.6 to these Compulsory Regulations. 14. The seaport provides icebreaker assistance in accordance with the General Rules and these Compulsory Regulations from the beginning of ice formation and before the end of the ice floe. Restrictions of ice navigation of vessels in the water area of the seaport are given in Annex No. 7 to these Compulsory Regulations. 15. The water area of the seaport Kavkaz is the area of compulsory pilotage for ships, with the exception of the Area 4. Information on the area of compulsory pilotage of vessels in the seaport is given in Annex No.8 to these Compulsory Regulations. 5 Order of Ministry of Transport of the Russian Federation dated 29 December 2015. The seaport carries out cargo handling, including dangerous goods of hazard classes 2-9 of the International Maritime Organization (hereinafter referred to as IMO). 17. The seaport has capability to supply the ships stores with food, fuel, fresh water, reception of sewage and oily water from ships, all categories of garbage, with the exception of Class 1 and 2 hazard wastes. III. Rules of the arrival of vessels into the seaport and the departure of vessels from the seaport including arrangements for the safety of navigation.
