Optus Sport Terms and Conditions V.2 What is Optus Sport Paid Subscription Optus Sport Subscription (“Service”) is a content subscription for viewing selected Optus Sport Content (“Content”) on a limited access basis, or a live and on-demand basis, using your compatible devices, which may include your TV, personal computer, or compatible mobile or tablet device. The Service is available as set out in the ‘Ways to Watch’ section below. Subscription The Service contains content which is provided to consumers at no charge (“Non-Premium/Basic Subscription”) and a Premium Subscription is provided to consumers for a fee or included as an optional extra with eligible Optus services (“Premium Subscription”), but can also be provided to consumers on a promotional basis for a reduced or no fee (“Promotional Premium Subscription): Non-Premium/Basic Subscription includes - Access to browse the App but specifically excludes viewing audiovisual content. - Stats, tables, fixtures, rankings Premium Subscription (including Promotional Premium Subscription). In addition to Non- Premium/Basic subscription content described above, this includes: - Live audiovisual content, including matches - On-demand audiovisual content including replayed matches, highlights, news, press conferences, short form content Ways to Watch You can watch the Service using a number of different devices and access technologies. Note that the ways to watch the Service may change from time to time, if this happens, we will try to notify you in advance, but it may not always be possible to do so. The features and functionality of the Service will differ depending on the device and access technology used, as well as whether you have a Premium or Non-Premium/Basic Subscription. Mobile and Tablet – the Service is available via a mobile application (“App”) on compatible mobile phones or tablet devices and is streamed in standard definition format. Computer - The Optus Sport Website www.sport.optus.com.au/ is available on PC or Mac computers (including laptops). The browsers that are supported are listed on the Optus Sport Website. You may not be able to access some or all of the Service if you use an unsupported browser. Apple TV – you can access the App via the app store on Gen 4 or later Apple TV. You can also use AirPlay to view the Service on Apple TV-enabled TV sets. Fetch – you can access the Content on your compatible television, through the Fetch service using a Fetch Set Top Box (STB) provided by Optus including ‘Mini’ STB and 2nd Generation or later STB. Fetch retail customers (who have not purchased their STB from Optus) can purchase an Optus Sport Subscription and use their Optus Sport credentials to login via their Fetch STB. Microsoft Xbox – you can access the App via the Xbox store on Xbox One and Xbox One S. Amazon Fire TV – you can access the Content through the App via your Fire TV device on your compatible television. Accessing the Service You must be an Australian resident, viewing the content in Australia for personal, non-commercial use. If you are under 15 you need parental permission. Consumers who want to subscribe to the Service on their mobile or mobile broadband device can go to the App Store or Google Play Store and download the Optus Sport App. All subscribers need to: - Create an Optus Sport account – register your email and create a password in the App to create a Non-Premium/Basic Subscription; - Subscribe and pay through the App to upgrade to a Premium Subscription. Non- Premium/Basic Subscription There are currently no fees or charges to access the Service with a Non-Premium/Basic Subscription, although data charges from your service provider apply. Optus may choose to charge a fee for Non-Premium/Basic Subscription at any time or withdraw the Non-Premium/Basic Subscription with 21 days’ notice. Promotional Premium Subscription Your access to the Service with a Promotional Premium Subscription is on the terms we provided and you agreed to at the time you accepted the offer. How to get a Premium Subscription If you are an Optus customer, you may be eligible for a Premium Subscription: a) as an optional extra at no extra cost with your eligible Postpaid or Fixed plan; b) as an Add-On to your eligible Postpaid or Fixed plan for an additional $14.99 per month (“Add-On”); or c) as an Add-On to your Optus Fetch service for an additional $14.99 per month (“Add- On”) d) as a prepaid recharge for $5/28 days (for eligible Prepaid customers) (“Prepaid”). Updated: 1/07/2020 2 Optus Sport Terms and Conditions V.2 If you are an existing Optus customer, please check your eligibility before signing up to pay for a Premium Subscription to ensure you are not charged twice. If you are not an Optus customer, you can purchase a Premium Subscription: a) Directly through Optus Sport via the App for $14.99 per month (“Direct Purchase via App”); b) Directly through Optus Sport website (sport.optus.com.au/signup) for $14.99 per month or $139 for an Annual Pass (“Direct Purchase via Optus Sport website”); c) In the form of a gift cards ($14.99 for 30 days access, or $139 for 1-year access) at participating retailers (“Gift Card)”. How you will be charged Premium Subscriptions are charged at either $14.99 per month for Monthly Subscription or $139 for an Annual Pass. This price is subject to change. We will provide you reasonable notice if the price changes. The minimum subscription period is 1 month for the Monthly Subscription, or 1 year for the Annual Pass (“Subscription Period”). You are entitled to cancel your Service at any time, after this minimum period. If you cancel part way through a Subscription Period, you will not be refunded for any charges for the remainder of your Subscription Period, however you will have access to the Premium Subscription until the end of your Subscription Period. The monthly charge for the Add-On Premium Subscription will be added to your Optus bill. Direct Purchase via App The monthly charge for Monthly Subscription when purchased by Direct Purchase via App is incurred via the App Store or Google Play Stores. Optus may choose to introduce alternative billing mechanisms to add to or replace these methods in the future. You will continue to be charged a monthly subscription fee, until you unsubscribe through Google Play Store or the Apple App Store. You must cancel the subscription through the App Store or Google Play Store to stop incurring further charges. Optus cannot cancel your Optus Sport Premium Subscription on your behalf. Uninstalling the App will not automatically stop your subscription. If the App is removed from the app store where you downloaded the App, your subscription will be cancelled and any future subscription charges will be automatically cancelled but past charges will not be refunded. Direct Purchase via Optus Sport Website The charge for a Monthly Subscription or Annual Pass purchase using Direct Purchase via the Optus Sport Website is incurred via your chosen credit card. Optus may choose to introduce alternative billing mechanisms to add to or replace these methods in the future. You will continue to be charged a monthly or yearly subscription fee, until you unsubscribe through your Optus Sport settings (manage preferences). You must cancel the subscription through your Optus Sport settings to stop incurring further charges. Uninstalling the App will not automatically stop your subscription. If the App is removed from the app store where you downloaded the App, your subscription will be cancelled and any future subscription charges will be automatically cancelled but past charges will not be refunded. Updated: 1/07/2020 3 Optus Sport Terms and Conditions V.2 The Gift Card and Prepaid Premium Subscriptions are paid in advance and (subject to your consumer rights) cannot be refunded once activated. The Gift Card Premium Subscription provides the Service for the time set out on the relevant gift card (either 30 days access or 1-year access, from the date activated online) and are subject to the terms set out on the Gift Card itself. The Prepaid Premium Subscription provides the Service for 28 days from the time you purchase your Optus Sport voucher via the MyOptus App. Service We will send you information relating to your account (including notices) in electronic form only (e.g. within the App, by email or SMS). In order to watch the Service on your devices, you must authorise those devices for use with your Service. You may authorise a maximum of four (4) devices at any one time for use with your Service and you may only de-authorise one authorised device per calendar month. You can manage your authorised devices using your Optus Sport Account. Please login to your account at www.sport.optus.com.au and go to settings - devices. You can only watch the Service on one of your authorised devices at any one time. We may change this entitlement and with 21 days notice. The Service is delivered using Adaptive Bitrate Streaming Technology at a resolution of up to 720p. The Service will work best when you have internet bandwidth of 3.5Mbps or greater (7Mbps or greater for 2nd Generation Fetch boxes). Note that the use of other internet applications on the same internet connection at the same time may cause a degradation in video quality. The Service is supported on Web (Chrome, Safari, Edge and Firefox), IOS, Android, Apple TV (4th Generation).
