DOMINIC PERROTTET, MP Minister for Industrial Relations 1664 NSW Government Gazette No 54 of 12 May 2017 Government Notices Planning and Environment Notices BIODIVERSITY CONSERVATION REGULATION 2017 Public exhibition of proposed Biodiversity Conservation Regulation 2017 and related products NOTICE is given, in accordance with Section 5 of the Subordinate Legislation Act 1989, of the intention to make the Biodiversity Conservation Regulation 2017. The regulation is being progressed as part of the Land Management and Biodiversity Conservation reforms. A draft of the proposed regulation has been released for public comment. The object of the proposed regulation is to prescribe further details to support the Biodiversity Conservation Act 2016 including details for: • the protection of animals and plants • areas of outstanding biodiversity value • listing criteria for threatened species and ecological communities • provisions relating to private land conservation agreements • the Biodiversity Offsets Scheme, and biodiversity assessment and approvals under the Environmental Planning and Assessment Act 1979 • the biodiversity certification of land • public consultation and public registers • the Biodiversity Conservation Trust • regulatory compliance mechanisms and criminal and civil proceedings The following proposed regulations and other products related to the Land Management and Biodiversity Conservation reforms have also been released for public comment: •a draft Local Land Services Amendment Regulation 2017 •a draft Environmental Planning and Assessment Amendment (Biodiversity Conservation) Regulation 2017 • an Explanation of Intended Effect for a State Environmental Planning Policy (Vegetation) • a draft Biodiversity Assessment Method • a draft Accreditation Scheme for the Application of the Biodiversity Assessment Method • an example Sensitive Biodiversity Values Land Map • draft guidance for considering serious and irreversible impacts • a draft offsets payment calculator and user manual.
