CITY OF SUNSET VALLEY A-23 AGENDA DATE 516108 SUBJECT: 25 MPH speed limits on residential streets BACKGROUND: In response to citizen concerns of traffic and pedestrian safety, increases in pedestrian traffic and increased use of our trails and traillink(s) which have put more people walking on our roads, the Public Safety Committee discussed and recommends to council that the speed on residential streets be reduced from 30M PH to 25MH. Numerous public notices were given in the newsletter, and at Council meetings and citizen input was solicited and received. Numerous citizen comments in favor were received at Council and one comment not in favor was received by the Chief of Police. RECOMMENDATION: Reduce the speed limits on residential streets from 30MPH to 25MPH Funding Source: A total of 14 signs are needed at $50.00 each total of $700.00 (both replacement for speed limits are needed - we can use the existing posts) Public works director and Chief of Police met and decided that the funding should come from the PW street fund Requesting Department: Police Dept For More Information Contact: PSC Chairman, John Moore Prior Council Action: none Committee Public Safety Committee recommends approval ORDINANCE NO. _ AN ORDINANCE ESTABLISHING SPEED LIMITS ON OAKDALE DRIVE, YELLOWTAIL COVE, LOVEGRASS LANE, CURLEY MESQUITE COVE, SUNSET TRAIL, REESE ROAD, PILLOW ROAD, AND LONE OAK TRAIL IN THE CITY OF SUNSET VALLEY, DIRECTING THE PUBLIC WORKS DEPARTMENT TO ERECT SIGNS POSTING SUCH NEW SPEED LIMIT, PROVIDING FOR A PENALTY FOR A VIOLATION, REQUIRING PUBLICATION OF A CAPTION OF THIS ORDINANCE, MAKING FINDINGS AND A DETERMINATION IN SUPPORT OF SUCH SPEED LIMITS, ESTABLISHING AN EFFECTIVE DATE, AND PROVIDING FOR SEVERANCE WHERAS, the existing speed limit for vehicles traveling on the locations of the residential streets listed and defined in Section 1 ofthis Ordinance is 30 miles per hour; WHEREAS, the City Council finds and determines that the existing speed limit on each of the Residential Streets (hereinafter used as that term is defmed in Section 1 of this Ordinance) is unreasonable and unsafe, in view of the width of such streets, the close proximity of residences to such streets, lighting conditions on such streets, and the rural character ofdevelopment on such streets; WHEREAS, each ofthe Residential Streets is located in an "urban district" as that term is defined in Texas Transportation Code § 541.102; WHEREAS, each ofthe Residential Streets is less than 35 feet wide, has three or fewer lanes used for vehicular travel, and parking is not prohibited on either side ofany ofsuch streets; WHEREAS, the City council is authorized, pursuant to Texas. Transportation Code § 545.356 to establish a speed limit of25 miles per hour based on the findings provided in this Ordinance WHEREAS, the City Council desires to reduce the speed limit for vehicular traffic on each ofthe Residential Streets to a safe speed of25 miles per hour; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SUNSET VALLEY: Section 1. The locations on the streets in the City ofSunset Valley listed in this Section 1 are defmed, for purposes ofthis Ordinance, as the Residential Streets. a. Oakdale Drive, from the intersection ofOakdale Drive and Brodie Lane to the easterly dead end ofOakdale Drive adjacent to the property located at 800 Oakdale Drive; b. Yellowtail Cove from its intersection with Lovegrass Lane to its dead end adjacent to the property located at 29 Yellow Tail Cove; c. Lovegrass Lane from its intersection with Brodie Lane to its intersection with Yellowtail Cove; d. Curly Mesquite Cove from its intersection with Lovegrass Lane to its dead end adjacent to the property located at 5 Curley Mesquite Cove; e. Sunset Trail from its intersection with Jones Road to its intersection with Reese Drive; f. Reese Drive from its intersection with Jones Road to its southerly dead end adjacent to the property located at 32 Reese Drive; g. Pillow Road from its intersection with Jones Road to its southerly dead end adjacent to the property located at 50 Pillow Road h. Lone Oak Trail from its intersection with Jones Road to its southerly dead end adjacent to the property located at 42 Lone Oak Trail. Section 2. The maximum speed limit for any motor vehicle traveling on any ofthe Residential Streets shall be 25 miles per hour. Section 3. The Public Works Department ofthe City shall erect signs, in compliance with applicable regulations for traffic signage, on each ofthe Residential Streets. Such signs shall be erected in a manner as to give notice to drivers ofmotor vehicles ofthe speed limit established by this Ordinance. Section 4. A person who violates the speed limit established by this Ordinance on a Residential Street shall be guilty ofa Class C misdemeanor. A violation ofthe speed limit established by this Ordinance is punishable by a fine ofup to $500.00. Section 5. A caption that summarizes the purpose ofthis Ordinance and the penalty for violating this ordinance shall be published as provided by Tex. Loc. Gov't Code § 52.011. Section 6. This Ordinance shall be effective immediately upon adoption. However, no speed limit established by this Ordinance shall be enforced on any Residential Street until: (i) a sign has been erected on such Residential Street in compliance with Section 3 ofthis Ordinance; and (ii) publication has occurred in compliance with Section 5 ofthis Ordinance. Section 7. The factual recitations, findings and determination included in the recitals of this Ordinance are specifically made and determined by the City Council in the adoption ofthis Ordinance. Section 8. Ifany provision ofthis Ordinance is found by a court ofcompetent jurisdiction to be void or unenforceable, such void or unenforceable provision shall be severed as though it never formed a part ofthis Ordinance, and all other provisions hereof shall remain in full force and effect.
