HSBC Bank Malaysia Berhad (“HSBC”) Universal Terms & Conditions (May 2019 Edition) EFFECTIVE DATE: 21 May 2019 for all new customers of HSBC Bank. 11 June 2019 for all existing customers of HSBC Bank as at 21 May 2019. These Universal Terms & Conditions consist of: Generic Terms & Conditions (applicable to every account/ product/service (including banking & financing facilities) opened with or provided by HSBC); Specific Terms & Conditions for HSBC Premier and HSBC Advance; Specific Terms & Conditions for Retail Banking and Wealth Management; and Cardholder Agreement for HSBC Visa Platinum/Platinum Mastercard® /HSBC Advance Visa Platinum/HSBC Visa Signature/HSBC Premier World Mastercard® Credit Card/HSBC Premier Travel Mastercard® Credit Card. Consolidation & Set-Off Conditions of the relevant account/product/service opened with or provided by HSBC and HSBC Bank’s Terms and Conditions for Personal Internet Banking as may be amended from time to time at the absolute 3. Customer’s Details and Obligations discretion of the Bank. 4. Joint Accounts Account Statements 5. Specimen Signature of Authorised Signatory(ies) 1. (i) Where account statements are applicable, they are sent monthly or, at such other intervals as instructed by the Customer or as stated in the applicable Specific Terms & Conditions or account-related 6. Amendment of Terms & Conditions documentation. The Customer agrees to promptly check and reconcile the contents of each account statement and 7. Financial Crime Risk Management Activity transaction record from the Bank with the Customer’s own records to see if there are any errors, omissions, discrepancies or irregularities (collectively “Irregularities”). 8. Suspension/Closure of Account If the Customer does not notify the Bank in writing of any Irregularities within 60 days from the account 9. Collection, Processing statement date, the contents of the account statement including the Irregularities shall be taken to be in and Sharing of Customer order and conclusively authorised by and binding on the Customer. Information (ii) The Customer agrees that if the Customer did not register: (a) for email statements, or provide the Bank 10. Tape Recording with any e-mail address; and/or (b) did not register for PIB e-statements, or as a user of PIB, the account 11. Document Management statement would be sent via paper statement in hard copy to the last known address in the Bank’s record and a fee (as stated in the Bank’s Tariff and Charges which can be viewed at www.hsbc.com.my) would be 12. “Know Your Customer” charged for each account statement issued. 13. If the Customer owes any debt (whether actual, contingent, present or future) to the Bank and/or HSBC Amanah Malaysia Berhad (“HSBC Amanah”) (the Bank’s wholly-owned subsidiary) solely or jointly with any 16. Customer’s Security Duties other person including any unpaid withholding tax (collectively “Indebtedness”), the Customer agrees that the 17. Use of Card Bank may do the following: 18. Use of Debit Card (a) consolidate the credit balances in all the Customer’s accounts with the Bank (where balances are in different currencies, the Bank may convert one currency to another using its spot rate of exchange on the 19. Cheque & Cash Deposits day of conversion); 20. Foreign Currency Cheques (b) put a hold on such amount of the credit balances which the Bank estimates in good faith to be sufficient, 21. Inward Remittances including taking into account exchange rate fluctuations (if applicable) of the amount of the Indebtedness plus any accruing interest or other charges; 22. Outward Remittances (c) after the end of 7 days’ prior notice, apply such credit balances (even if it involves uplifting any deposit 23. Carrying Out Payment/ before maturity date) against the Indebtedness (where the balances and Indebtedness are in different Remittance Instructions currencies, the Bank may convert one currency to another using its spot rate of exchange on the day of 24.
