Sec. 17-46. Approved Truck Routes. No person, individual, firm, partnership, or corporation shall operate or drive a truck upon a street within the corporate limits of the Charter Township of Delta, except on the following streets: 1. Interstate 96 Pierson Hwy. Canal Rd. west to Guinea Rd. 2. Interstate 69 9. Lansing Rd. 14. Rickle Street 3. Interstate 496 10. Mt. Hope Hwy. from Lansing Rd. 15. Ena Dr. 4. M-43 west to I-96/I69 bridge 16. Lanac St. 5. Canal Rd. from Mt. Hope Hwy 11. Pierson Hwy. from Snow Rd. west 17. North Port Dr. south to Davis Hwy. to Sanders Rd. 18. Central Circle 6. Creyts Rd. from I-496 interchange 12. Millett Hwy. from Lansing Rd. to 19. Sloan Hwy. south to Lansing Rd. Sanders Rd.; and from Creyts Rd. 20. Westland Way 7. Sanders Rd. from Pierson Hwy. west to Nixon Rd. 21. Empire Way south to Millett Hwy. 13. Davis Hwy. from Lansing Rd. west 8. Snow Rd. from Mt. Hope south to to CN Railroad Tracks; and from (Ord. No. 01-02, & 1, 5-7-01) Sec. 17-47. Definitions. [For purposes of this article, the following words and phrases shall have the meanings hereinafter defined:] Local Truck Traffic shall mean trucks operated to transport products, good, commodities, or raw materials either from within Delta Charter Township to another place within or outside the Township, or from outside the Township to a place within the Township. Incidental or emergency local truck traffic, as defined in Section 17-48 shall be permitted. Truck shall mean any commercial motor vehicle, common carrier, delivery truck, dump truck, double bottom truck, pole trailer, semi-trailer, tank vehicle, truck tractor, wrecker, or any other vehicle designed, used or maintained primarily for the transportation of property including, but not limited to raw materials, products, commodities or other commercial items. (Ord. No. 01-02, & 2, 5-7-01) Sec. 17-48. Incidental or Emergency Local Truck Traffic. No provision of this Ordinance shall restrict the emergency use of nor the casual or incidental commercial truck pickup or delivery to any individual, residence or business upon the streets within the corporate limits of the Charter Township of Delta. Use of “Approved Truck Routes” for such casual or incidental pick up or delivery is mandatory only if such delivery or pickup can be made without operation on streets other than said established truck routes. All trucks within the Township shall return to the nearest “Approved Truck Route” by the most direct route when finished delivering or picking up goods on non-designated routes. This includes trucks having additional destinations within the Township. Short cuts on non-truck routes are expressly prohibited. (Ord. No. 01-02, & 3, 5-7-01) Sec. 17-49. Parking. No person, individual, firm, partnership, or corporation shall park a truck as hereinabove defined, upon private property or upon public streets within the corporate limits of the Charter Township of Delta; except that trucks, as hereinabove described, shall be allowed to be parked upon private property which is zoned commercial or industrial so long as access to said property is entirely on designated truck routes and so long as the trucks do not physically or visually block or interfere with entry to or exit from public or private streets, roadways, alleys, and driveways. (Ord. No. 01-02, & 4, 5-7-01) Sec. 17-50. Signs. The Road Commissioner of the Eaton County Road Commission shall erect signs at all entrances to the Charter Township of Delta giving notice of the restrictions on truck traffic and shall erect signs on the appropriate streets, designating them as truck routes. (Ord. No. 01-02, & 5, 5-7-01) Sec. 17-51 Violations. Violation of this ordinance is a civil infraction which shall be punished by a fine for the first offense not to exceed One Hundred Dollars ($100), plus other costs, damages, or sanctions which the court in its discretion may impose. 1. Increased civil fines may be imposed for repeat violations by a person of any requirement or provision of this Ordinance. As used in this section, repeat offenses means a second (or any subsequent) municipal civil infraction violation of the same requirement or provision (i) committed by a person within any one year period (unless some other period is specifically provided by this Ordinance) and (ii) for which the person admits responsibility or is determined to be responsible. Unless otherwise specifically provided by this Ordinance for a particular municipal civil infraction violation, the increased fine for a repeat offense shall be as follows: a. The fine for any offense, which is a first, repeat offense, shall be no less than $250.00, plus costs. b. The fine for any offense, which is a second, repeat offense or any subsequent repeat offense shall be no less than $500.00, plus costs per offense. 2. Failure to answer a citation or notice to appear in court for a municipal civil infraction is a misdemeanor violation punishable by a fine of not more than $500.00, plus other costs, or by imprisonment for term not to exceed 90 days, or both fine and imprisonment. 3. Failure to comply with an order, judgment, or default in payment of a civil fine, costs, damage, or expenses so ordered may result in enforcement actions, including but not limited to imprisonment, collections, placement of liens or other remedies as permitted in Chapter 87 of Act 236 of Public Acts of 1961 as amended. 4. A municipal civil infraction is not lesser included offense of a criminal offense or an ordinance violation that is not a civil infraction. 5. Impounding of Motor Vehicles: Motor vehicles which have failed to answer six (6) or more parking violation notices or citations under this Ordinance may be immobilized or impounded by the Township. 6. Continuing Offenses: Each day on which a violation of the ordinance continues, constitutes a separate or repeat offense and shall be subject to penalties or sanctions as a separate or repeat offense. (Ord. No. 01-02, & 6, 5-7-01) Sec. 17-52. Enforcement Actions. This article shall be enforced by the person or persons designated by the Charter Township of Delta Board of Trustees. A municipal civil infraction action may be commenced upon the issuance of a municipal civil infractions citation directing the alleged violator to appear in court. (Ord. No. 01-02, & 7, 5-7-01) .
