PART B – THE AMENDMENT consisting of the following text and Schedule T2, and the replacement Schedule K constitute Amendment No. XX to the Official Plan for the City of Ottawa. Page 1of 9 PART A – THE PREAMBLE 1. Purpose The purpose of this amendment is to amend the Official Plan to update the policies on Source Water Protection, Environmental Noise and for the Interpretation of settlement areas. Changes to the Schedules of the Official Plan correct Schedules L1 and L3 - Natural Heritage System and replace Schedule K. Minor alterations, updates and corrections are proposed to the Table of Roads Right-of-Way protection. 2. Location This Official Plan Amendment affects the entire area of the City of Ottawa. 3. Basis This section of the preamble to the proposed Official Plan Amendment explains why the amendments are proposed, whereas Part B includes the technical amendments that will be applied to the Official Plan. The basis is divided into six Sections as follows: Source Water, Noise and Interpretation policies and Schedules L1, L3 and K a) Section 4.8.2, Wellhead Protection This section is updated to also reference surface water protection areas identified by the work undertaken on source water protection. Changes include a new heading, preamble and reference to the updated source water protection information on Schedule K. b) Section 4.8.7. Environmental Noise Control This section is updated to remove reference to specific provincial guidelines that no longer exist or have been incorporated into the City’s Environmental Noise Control Guideline. c) Section 5.4 Interpretation Policy 5 is amended to clarify those areas that constitute Settlement Areas, as defined by the Provincial Policy Statement, for the purposes of the Plan. d) Update of Schedule L1 and L3 When Schedules L1 and L3 were prepared and added to the Official Plan through OPA 150 the Urban Natural Feature that is the Montfort Woods was not included in the Natural Heritage System overlay. Schedule T2 attached this amendment corrects this omission. e) Schedule K –Environmental Constraints The amendment replaces the existing Schedule K in its entirety with a new mapping base and corrects the locations and extent of environmental Page 2 of 9 constrains depicted on the map. The revised wellhead and new Source Water Protection areas are identified on the map. Policies related to Wellhead Protection have been updated to include Surface Water Protection. Updated Road Rights-of-way f) Annex 1 Road Right-of –Way Protection The proposed amendment revises Table 1 – Road Right-of-Way Protection to make a number of changes to address: Completion of recent road EA studies or on-going EA studies such as Ottawa Road 174 where an interim Right-of-Way (ROW) protection is being established. More detailed planning decisions at the implementation stage of a Community Design Plan modifying the previous protected ROW. Road name changes such as the Ottawa River Parkway now being the Sir John A. Macdonald Parkway, sections of Richmond Road are now named Old Richmond Road, and the proposed Kanata North-South arterial is to be referenced as the Stittsville North-South arterial (Founder Avenue). Removal of a requirement for a ROW widening on a section of roads that, due to road realignment, no longer exist. Page 3 of 9 PART B – THE AMENDMENT 1. Introduction All of this part of this document entitled Part B – The Amendment consisting of the following text and the amending and replacement schedules attached, constitute Amendment No. XX, to the Official Plan for the City of Ottawa. 2. Details The Official Plan for the City is hereby amended in the following ways: a. Amend, Section 4.8.2- Wellhead Protection by deleting the heading, the preamble and Policy 1 and replacing them with the following new heading and preamble and policies and by renumbering subsequent policies accordingly: “4.8.2 Source Water Protection Within the city, the urban area and a number of rural communities rely on municipal drinking water systems. Areas contributing ground or surface water to those municipal drinking water systems are referred to as Wellhead Protection Areas or Intake Protection Zones. Wellhead Protection Areas and Intake Protection Zones are identified on Schedule K of this plan. Consistent with the Clean Water Act and the Mississippi Rideau Source Water Protection Plan and the Raisin South Nation Source Water Protection Plan, water resources contributing to the municipal water systems will be protected from incompatible development and/or threats to water quality. Policies 1 Planning applications for new development or a change of use within the Wellhead Protection Areas and the Surface Water Intake Zones identified on Schedule K will be reviewed in the context of vulnerability to the associated municipal water supply. As more information becomes available through the Source Water Protection Plans or subsequent technical studies the mapping of these protection areas and zones and the policies of this section will be updated. 2 The City is required to implement the approved Source Water Protection Plans in this Plan, the Zoning By-law and through development review. Certain land use activities that pose a threat to municipal drinking water within Wellhead Protection areas or Intake Protection Zones identified on Schedule K may be restricted or prohibited.” b. Amend, Section 4.8.2 Wellhead Protection – Policy 2 by deleting the words “resource in” and adding the words “resources and surface water supply in the” and by adding after the words “Wellhead Protection Areas” the words “or Intake Protection Zones consistent with approved Source Water Protection Plans.” Page 4 of 9 c. Amend, the preamble text in Section 4.8.7 – Environmental Noise Control that follows Policy 6 and the existing heading “Noise from Stationary Sources” by deleting the words in the last sentence “in Land Use Planning (Publication LU- 131)” and the words “Sound Level Limits for Stationary Sources in Class 1&2 Areas (Urban)(NPC-205), and Sound Level Limits for Stationary Sources in Class 3 Areas (Rural)(NPC-232)” d. Amend, Section 4.8.7 – Environmental Noise Control, Policy 9, by replacing the words “certificate of approval” in the last sentence with the words “Environmental Compliance Approval” e. Amend, Section 5.4 – Interpretation, Policy 5, by deleting the words “boundary of the urban area is” in the first sentence, and replacing them with the words “boundaries of settlement areas comprised of the urban area and the rural villages are”. f. Delete, Schedule K – Environmental Constraints and replace it with the new Schedule K, attached to this amendment. g. Amend Schedules L1 and L3 to include the land identified on Schedule T2 as part of the Natural Heritage System Overlay. h. Amend, Annex 1 – Table1- Road Rights-of-Way Protection, to correct and add text that is highlighted and to remove text that is struck out in the following table and to insert the new streets in the correct alphabetical order.
