YAKIMA COUNTY Shoreline Master Program DRAFT Effective Date: Month Day, Year 1 SHORELINE MANAGEMENT ACT Washington State’s citizens voted to approve the Shoreline Management Act of 1971 in November 1972. The adoption of the Shoreline Management Act (Act) recognized “that the shorelines of the state are among the most valuable and fragile of its natural resources and that there is great concern throughout the state relating to their utilization, protection, restoration, and preservation” and that “coordinated planning is necessary in order to protect the public interest associated with the shorelines of the state while, at the same time, recognizing and protecting private property rights consistent with the public interest” (RCW 90.58.020). The Act seeks to provide environmental protection for shorelines, preserve and enhance shoreline public access, and encourage appropriate development that supports water-oriented uses. Under the Act, shoreline master programs are created and implemented based on a “cooperative program of shoreline management between local government and the state” (RCW 90.58.050). The roles are defined as: “Local government shall have the primary responsibility for initiating the planning required by this chapter and administering the regulatory program consistent with the policy and provisions of this chapter. The Department [of Ecology] shall act primarily in a supportive and review capacity with an emphasis on providing assistance to local government and on insuring compliance with the policy and provisions of this chapter.” (RCW 90.58.050) The Washington State Department of Ecology (Ecology) reviews and approves local master programs and certain local permit decisions. This SMP has been prepared to meet the requirements of the Shoreline Management Act (RCW 90.58), the implementing State rules codified as Chapter 173-26 and Chapter 173-27 of the Washington Administrative Code (WAC) “State Master Program Approval/Amendment Procedures and Master Program Guidelines” that were revised in 2011, and other applicable local, state, and federal laws. The SMP is developed locally, but must meet the Shoreline Management Act and implementing State rules, and is subject to approvalDRAFT by the Washington State Department of Ecology (Ecology) before it can be implemented. 2 GOALS AND POLICIES GOALS AND POLICIES ............................................................................................................... 6 Shorelines .................................................................................................................................... 6 Shoreline Environments .............................................................................................................. 7 General Shoreline Policies ........................................................................................................ 10 Shoreline Use Policies ............................................................................................................... 14 Shoreline Modification Policies ................................................................................................ 18 CHAPTER 16D.01 GENERAL PROVISION .......................................................................... 28 16D.01.01 Authority. ............................................................................................................ 28 16D.01.02 Language Interpretation. ..................................................................................... 29 16D.01.03 Applicability ........................................................................................................ 29 16D.01.04 Science and Protection of Anadromous Fish. ..................................................... 30 16D.01.05 Applicability of Permit System to Federal Agencies. ......................................... 30 16D.01.06 Administrative Authority. ................................................................................... 31 16D.01.07 Severability.......................................................................................................... 32 16D.01.08 Liberal Construction. ........................................................................................... 32 16D.01.09 Effective Date. ..................................................................................................... 32 CHAPTER 16D.02 DEFINITIONS .......................................................................................... 33 CHAPTER 16D.03[SMP Scrub] SHORELINES ..................................................................... 62 16D.03.01[SMP Scrub] Purpose and Intent. ......................................................................... 62 16D.03.02[SMP Scrub] Restriction as Affecting Fair Market Value of Property. ............... 63 16D.03.03[SMP Scrub] Shoreline Jurisdiction. .................................................................... 63 16D.03.04[SMP Scrub] Shoreline Environments. .................................................................. 64 16D.03.05[SMP Scrub] Shoreline Land Use Table. ............................................................. 69 CHAPTER 16D.04 GENERALDRAFT REGULATIONS [SMP Scrub -
