KIMMITT, ROBERT M.: FILES, 1981-1985 Office of the Legal Advisor, NSC, 1981-1983 Office of the Executive Secretariat, NSC, 1983-1985: Executive Secretary Biography Robert Michael Kimmitt is a former public official with multiple service at the White House, Department of Treasury, Ambassador to Germany and Congress. His is also a retired army officer, attorney and businessman. Robert M. Kimmitt was born in Logan, Utah on December 19, 1947. His father, Joseph Stanley "Stan" Kimmitt, left the army in the 1960s and became a Senate staff member and Secretary of the Senate (Secretary for the Majority from 1978-1981). He relocated his family to the Washington, DC area and Robert Kimmitt graduated from high school in 1965 at Bishop Denis J.O'Connor High School in West Arlington, VA. Kimmitt attended the U.S. Military at West Point graduating with distinction in 1969. After leaving the Army, Kimmitt graduated from Georgetown University Law School in 1977 where he was the editor-in-chief of The Law and Policy in International Business. Kimmitt's Army career included additional training in field artillery and airborne schools and he graduated first in his class at Army Ranger's school. Kimmitt served 17 months with the 173rd Airborne Brigade in Vietnam (1970-1971) and was awarded multiple medals. Upon his return to the United States, Kimmitt was assigned to the 101st Airborne Division at Fort Campbell, Kentucky where he completed Jumpmaster school and became a senior parachutist. Kimmitt retired from the Army Reserve in 2004 with the rank of major general. Following his active military career, Kimmitt entered a long period of public service. From 1976 to 1977 Mr. Kimmitt was a member of the NSC Staff focusing on legal issues and arms transfer and sales issues. From 1977 to 1978, he served as a law clerk to Judge Edward A. Tamm of the United States Court of Appeals for the District of Columbia District. He returned to the NSC from 1979-1983 in much the same capacity as earlier working on legal and arms transfer/sales July 1, 2021. Bolded folders are available for use TODAY. No need to FOIA. Kimmitt - 2 issues. He served at the White House as National Security Council Executive Secretary and General Counsel from 1983 to 1985, with the rank of Deputy Assistant to the President for National Security Affairs. From 1985 to 1987, Mr. Kimmitt served as General Counsel to the U.S. Treasury Department, where he received the Alexander Hamilton Award, as well as the Arthur Fleming award for distinguished public service. Mr. Kimmitt then left public service, and from 1987 to 1989, served as a partner in the law firm of Sidley & Austen. Kimmitt resumed his public service career in 1989, serving as Under Secretary of State for Political Affairs until 1991. For his service during the Gulf Crisis and War, President George H.W. Bush presented Mr. Kimmitt with the Presidential Citizens Medal, the Nation's second- highest civilian award. He served from 1991 to 1993 as United States Ambassador to Germany and was awarded the U.S. Defense Department Distinguished Public Service Award as well as Germany's Order of Merit. During 1997 Kimmitt was a member of the National Defense Panel. From 1998 to 2005, he was a member of the Director of Central Intelligence's National Security Advisory Panel. He also served as a member of the Panel of Arbitrators of the World Bank's International Centre for the Settlement of Investment Disputes. Kimmitt is also a recipient of the CIA Director’s Award. Moving into the private sector, Mr. Kimmitt was a managing director of Lehman Brothers from 1993 to 1997. He was a partner at Wilmer, Cutler & Pickering from 1997 to 2000. Mr. Kimmitt was Vice Chairman and President of Commerce One, a software company headquartered in the San Francisco Bay area. Mr. Kimmitt was Chairman of the International Advisory Council of Time, Warner, Inc., where he had served from July 2001 to February 2005 as Executive Vice President, Global Public Policy. From March through August 2005, he was also Senior International Counsel in the law firm of Wilmer Cutler Pickering Hall and Dorr. Kimmitt was the independent chairman of the Deloitte Center for Cross-Border Investment from 2009-2012, and currently is Senior International Counsel at the WilmerHale law firm. He has also served on many company boards such as Facebook and Afinit. On March 26, 2020 Facebook announced that Robert Kimmitt has been appointed by the company's Board of Directors as lead independent director. Kimmitt is a member of the Council on Foreign Relations, the American Academy of Diplomacy, and the Trilateral Commission. He is Chairman Emeritus of the American Council on Germany. Kimmitt comes from a distinguished family of public service. As mentioned, his father is Stan Kimmitt, former Secretary of the Senate and army colonel, who died in 2004. Kimmitt's brother, Brigadier General Mark Kimmitt is the former Assistant Secretary of State for Political-Military Affairs and former Deputy Assistant Secretary of Defense for Middle East. Mr. Kimmitt and his wife Holly Sutherland Kimmitt have two daughters, three sons, and multiple grandchildren and reside in Arlington, Virginia. July 1, 2021. Bolded folders are available for use TODAY. No need to FOIA. Kimmitt - 3 Scope and Content Note Robert Kimmitt was a holdover at the National Security Council from the Carter Administration. He continued to work on the same issues, arms transfer and legislative issues, as he had during the Carter years. His formal title at this time was Legal Counsel for the Freedom of Information/Legal Policy office at the NSC. The Library has elected to keep all of these separate office functions within a single Kimmitt collection. The files are easily identifiable by tags added at the front of most folder titles: AT (Arms Transfer); Legal; and LA (Legislative Affairs). A number of Kimmitt's legal folders were pulled and then sent on to various Independent Counsel investigations. No effort was made to identify or to redistribute this material to the Kimmitt collection when it was returned. Kimmitt, whose father was the Secretary of the Senate during the early years Kimmitt was at the NSC, had a personal interest in legislative affairs. He was never officially a part of this office and some of his legislative affairs folders appear to contain work product of other members of that office, particularly Peter Sommer. Kimmitt left the NSC in 1982, but returned in 1983 as Executive Secretary and Legal Advisor. The Library has not located specific files that are Kimmitt’s from his time as Executive Secretary.
