Statutory Document No. 374108 ROAD RACES ACT 1982 THE TOURIST TROPHY MOTORCYCLE RACES ORDER 2OO8 Coming into Operation: I May 2008 In exercise of the powers conferred on The Department of Transport by sections I and 2 of the Road Races Act 19821, and of all other enabling powers, the following Order is hereby made:- Introductory 1. Citation and commencement This Order may be cited as The Tourist Trophy Motorcycle Races Order 2008 and shall come into operation on the 8 May 2008. 2. Interpretation In this Order - "the Act" means the Road Races Act 1982; "the Clerk of the Course" includes, in the absence of the Clerk of the Course, any Deputy Clerk of the Course appointed by the promoter; "closure period" means any period during which an authorisation under article 3 or 4 is in force in relation to the Course or any part of the Course; "the Course" means the roads and property areas specified in Schedule 1; "pedestrian" includes wheelchair users and any persons using another mobility aid other than a bicycle or motor vehicle; "postpone", in relation to a race or practice, includes annulling (declaring void) a race which has already begun; "prohibited area" means the areas listed in Schedule 4 that are not restricted areas; "restricted area" meaÍts the areas listed in Schedule 4 tha| are indicated as being restricted; "senior police officer" means a member of the Isle of Man Constabulary of the rank of sergeant 1 lgï2 c.r4 Price: f2.00 Price Code: B or above who is authorised by the Chief Constable to act as senior police officer for the purposes of this Order; and "signage" means any barrier, sign or structure referred to in article 15 Authorisation to use roads for races etc 3. Authorisation of use of Course for practices (1) The Promoter is authorised to use the Course for motorcycle practices at the times specified in Table 1 of Schedule 2. (2) The Clerk of the Course may for any reason - (a) cancel such a practice, or anypractice postponed under this paragraph, or (b) postpone such a practice from a time specified in Table I to a time specified in Table 2 or 3 of Schedule 2. 'Where (3) the Clerk of the Course cancels or postpones a practice under paragraph (2) he shall notify the senior police officer. 4. Authorisation of use of Course for races and parades (1) The Promoter is authorised to use the Course for motorcycle races and parades at the times specified in Table 3 of Schedule 2. (2) The Clerk of the Course may for any reason - (a) cancel or annul such a race or parade, or any race or parade postponed under this paragraph; or (b) postpone such a race or parade from a time specified in Table 3 of Schedule 2 to a time specified in Table 4 of that Schedule. (3) Where the Clerk of the Course cancels, annuls or postpones a race or parade under paragraph (2) he shall notify the senior police officer. (4) An authorisation under paragraph (1) or (2) shall not have effect during any period which falls within a time specified in Table 3 of Schedule 2 and during which the Course is being used for a practice postponed to that time under article 3(2Xb). Regulation of traffic etc. 5. Suspension of right of way etc. Subject to articles 7 and 8, during any closure period in relation to any part of the Course - (a) the right of way over it is suspended; and (b) no traffic may pass onto or over it. 6. Regulation of traffic on side roads 2 Subject to articles 7 and 8, during the closure period, a person must not enter or remain, or cause or permit any vehicle or animal to enter or remain on that part of any road - (a) that leads onto the Course; and (b) that is marked by signage in accordance with article 15, without the permission of a constable 7 Exemptions from articles 5 and 6 (1) Articles 5(a) and 6 do not apply to the following persons- (a) the Clerk of the Course; (b) persons appointed by the Clerk of the Course as officials for the purpose of the race in question; (") constables and fire ofnicers; (d) persons lawfully taking part in the race in question and any person authorised by the promoter to assist them; (e) on Glencrutchery Road in the period prior to or during the start of any race until after the final competitor has left the start line - (i) the Lieutenant Governor and members of his party; and (iÐ guests, sponsors and promotional persons invited by the promoter; (Ð media representatives and photographers approved by the promoter and bearing an official badge, armlet or tabard issued by the promoter; (g) persons driving or being carried in ambulances, medical vehicles, fire brigade vehicles, police vehicles or highway maintenance vehicles in use for emergency purposes and authorised by the Clerk of the Course; and (h) persons driving or being carried in maintenance vehicles authorised by the Clerk of the Course to travel and carry out works on the Course between specific locations before the start and after the completion of any race. (2) Articles 5(b) and 6 do not apply to - (a) vehicles for the conveyance of persons mentioned in paragraph 1(a) or (e); (b) vehicles approved by the Clerk of the Course for the conveyance of persons mentioned in paragraph (1) (b), (c),(g) or (h); and (c) motorcycles engaged in the race in question. 8 Temporary opening of Course to traffic (1) This article has effect despite anything in articles 3 to 6. J (2) If any practice or race is temporarily postponed or suspended during a closure period, the senior police officer may, with the consent of the Clerk of the Course, authorise traffic, in accordance with the directions of a constable, to cross or proceed along such part of the Course, and at such times, as that officer may specify. (3) In any interval between a practice or race during a closure period, the senior police officer ma¡ with the consent of the Clerk of the Course - (a) authorise pedestrians, in accordance with the directions of a constable, to cross or proceed along the Course at such places, and at such times, as that officer may specify; or (b) authorise vehicular traffic, in accordance with the directions of a constable, to cross or proceed along the Course at the piaces specified in Schedule 3, at such times as that officer may specify. (4) Nothing in paragraph (2) permits traffic to proceed in the reverse direction of the course, except with the express authorisation of the clerk of the course, (5) No person shall during a closure period, drive any vehicle or cause or permit any vehicle to be driven, on any part of the Course which is the subject of any authorisation under paragraph (2) ot (3), otherwise than pursuant to that authorisation and in accordance with the directions of a constable. 9. Footbridges (1) Nothing in articles 3 to 6 prevents a pedestrian crossing the Course by means of a footbridge erected for the purpose, unless he is forbidden by a constable to do so. (2) No person shall during a closure period stop or loiter on any footbridge referred to in paragraph (1). 10. Restricted areas (1) No person or vehicle shall, during a closure period, enter or remain on a restricted area other than race officials, marshals, police officers in the course of their duty or other persons or vehicles approved by the Clerk of the Course. (2) The extent of the restricted area shall be clearly marked and indicated by notices bearing the words "Restricted Area". 11. Prohibited areas (1) No person or vehicle shall, during a closure period enter or remain on a prohibited area, except to go to the aid of a person or {o prevent further danger or risk to the competitors or any other person, (2) The extent of the prohibited area shall be clearly marked and indicated by notices bearing the words "Prohibited Atea". 12. Parking on ambulance access routes 4 A person must not cause or permit a vehicle to wait on a road specified in Schedule 5 - (a) during a closure period; and (b) if the vehicle is within 100 metres of any signage erected on a road in accordance with article 15, without the permission of a constable. Administration 13 Publicity for cancellation, postponements and suspensions. (1) Where the senior police officer is notified of the cancellation or postponement of a practice or race under article 3(3) or 4(3), he shall take such measures as he considers appropriate to inform the public of the effect of it. (2) The senior police officer shall take such measures as he considers appropriate to inform the public of any authorisation under article 8(2) or (3). (3) The Department shall cause public notice of (a) the location of crossing places specified in Schedule 3 to be printed in one or more ne'wspapers published and circulating in the Island; and (b) crossing places specified in Schedule 3 to be announced on radio stations broadcasting in the Island. 14. Notifïcation of end of closure (1) At the end of the practice or race for which an authorisation under article 3 or 4 is in force (a) the Clerk of the Course; or (b) the senior police ofÍicer, after consulting the Clerk of the Course shall arrange for one or more motor vehicles, marked in accordance with paragraph (2), to travel the Course.
