Report No. 502/04 ANGUS COUNCIL DEVELOPMENT CONTROL COMMITTEE 6 MAY 2004 DELEGATED APPROVALS REPORT BY THE DIRECTOR OF PLANNING & TRANSPORT Abstract: This report recommends that the Committee notes the applications detailed in Appendix 1 of the report granted by the Director of Planning & Transport in accordance with the Scheme of Delegation detailed in Standing Orders. 1.0 RECOMMENDATION 1.1 The Committee is asked to note the applications, detailed in the Appendix, granted approval under delegated powers. 2.0 INTRODUCTION 2.1 In terms of the Scheme of Delegation to officers, the Director of Planning & Transport is authorised to approve planning applications in accordance with the Development Plan, the Local Plans or established policies and where there are no objections, except those which raise a general issue affecting a large area, or are of major land or economic development significance. 3.0 APPROVALS 3.1 Attached as an Appendix is a list of applications granted under delegated authority during the period 7 April 2004 to 27 April 2004. 4.0 FINANCIAL IMPLICATIONS 4.1 There are no financial implications. 5.0 HUMAN RIGHTS IMPLICATIONS 5.1 There are no Human Rights issues arising directly as a result of this report. 6.0 CONSULTATION 6.1 The Chief Executive, Director of Law & Administration and Director of Roads have been consulted in the preparation of this report. Uniform\DCDELGAT Report No. 502/04 ANGUS COUNCIL DEVELOPMENT CONTROL COMMITTEE LIST ‘A’ - DELEGATED APPROVALS Application No. Promoter Location 03/00996/FUL A Husband Erection of an Essential Workers Dwellinghouse at:- Land at East Adamston Farm Muirhead Dundee DD2 5QT Conditions 1 That the development hereby permitted shall be begun before the expiration of five years from the date of this permission. 2 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the planning authority. 3 That prior to the commencement of the development, details of the means of site enclosure proposed to be used, shall be submitted for the prior approval of the planning authority and be erected on or before completion of the development. 4 That no development takes place until there has been submitted to and approved by the planning authority, a scheme of landscaping, including, where appropriate, an indication of all existing trees and hedgerows on the land and details of these to be retained and cleared, together with the measures for their protection in the course of development. 5 That all planting comprised in the approved details of landscaping be carried out in the first planting season following the completion of the development or at earlier stages and any plants or trees which within a period of years from the commencement of the use die; are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species. 6 That the rainwater run-off from roofs and hard surfaces be directed to a soakaway system to the satisfaction of the building control authority. 7 That the disposal of sewage effluent be in accordance with the standards required by both the building control authority and the Scottish Environment Protection Agency. 8 That the crossing(s) over the footpath and/or verge be constructed in accordance with the standards required by the Director of Roads to the satisfaction of the planning authority. 9 That the finished floor level of the dwellinghouse shall be at least 111.2 metres above ordnance datum. Uniform\DCDELGAT Report No. 502/04 03/01110/FUL West Residential Ltd Erection of a Dwellinghouse at:- Land at Ashludie Hospital Monifieth Dundee DD5 4HR Conditions 1 That the development hereby permitted shall be begun before the expiration of five years from the date of this permission. 2 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the planning authority. 3 That the drainage system of the proposed development be connected to the public sewerage system. 4 That the rainwater run-off from roofs and hard surfaces be directed to a soakaway system to the satisfaction of the building control authority. 5 That the crossing(s) over the footpath and/or verge be constructed in accordance with the standards required by the Director of Roads to the satisfaction of the planning authority. 6 That before work is commenced a sample of roof covering be submitted for the prior approval of the Director of Planning & Transport. 7 That the external wall finishes be agreed in consultation with and be to the satisfaction of the Director of Planning & Transport prior to the commencement of work. 8 That elevational details of the proposed double garage building shall be submitted to and approved in writing by the Director of Planning and Transport prior to commencement of development. 9 That the close boarded timber fence detailed on the combined east elevation, drawing number 1756 S1/PL06, is hereby not approved. 10 That prior to the commencement of the development, details of the means of site enclosure proposed to be used, shall be submitted for the prior approval of the planning authority and be erected on or before completion of the development. 11 That no development takes place until there has been submitted to and approved by the planning authority, a scheme of landscaping, including, where appropriate, an indication of all existing trees and hedgerows on the land and details of these to be retained and cleared, together with the measures for their protection in the course of development. 12 That all planting comprised in the approved details of landscaping be carried out in the first planting season following the completion of the development or at earlier stages and any plants or trees which within a period of five years from the commencement of the use die; are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species. 13 That none of the existing trees within the site be felled, topped, lopped or otherwise interfered with without advance discussion with and without the prior written consent of the Director of Planning & Transport. Uniform\DCDELGAT Report No. 502/04 14 That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 no fences, gates, walls or ancillary buildings shall be erected within the curtilage of any dwellinghouse without the prior written approval of the Director of Planning and Transport. 03/01574/FUL Angus Estates Ltd Conversion of Steading to Four Dwellinghouses at:- Powmill Farm Farnell Brechin Angus DD9 6UD Conditions 1 That the development hereby permitted shall be begun before the expiration of five years from the date of this permission. 2 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the planning authority. 3 That the disposal of sewage effluent be in accordance with the standards required by the building control authority. 4 That the rainwater run-off from the dwellinghouses be directed to a soakaway system to the satisfaction of the building control authority. 5 That, prior to the commencement of works on site, a photographic record of the exterior and interior of the farm steading shall be provided for Angus Council's Archaeologist and the Director of Planning & Transport. 6 That, prior to the occupation of any of the houses hereby approved, the following shall be completed to the satisfaction of the Director of Planning & Transport; (a) the demolition and removal of the farm building at the front of the site; (b) the access road and car parking areas; (c) the erection of approved boundary treatrment. 7 That this consent is only granted on the understanding that a drainage porosity test conducted under the auspices of the building control authority is successful. The test should be undertaken at an early date and certainly before the development is commenced or the site sold. Proof of successful completion must be forwarded to the Director of Planning & Transport prior to submission of a detailed application or commencement of works, whichever comes first. Failure to successfully complete a porosity test will make this consent impossible to implement unless another method of sewage disposal acceptable to the drainage authorities and approved by the Director of Planning & Transport is proposed. 8 That the water supply to the proposed houses be connected to the public main or alternatively a scheme of treatment is adopted and implemented for the improvement of the private supply, all being subject to prior approval of the Director of Planning & Transport. 9 That the roof(s) be finished with blue slates. Uniform\DCDELGAT Report No. 502/04 10 That the roof and external wall finishes be agreed in consultation with and be to the satisfaction of the Director of Planning & Transport prior to the commencement of work. 11 That precise details of the style of window to be utilised be submitted to and approved by the Director of Planning & Transport prior to installation. 12 That prior to the commencement of the development, details of the means of site enclosure proposed to be used, shall be submitted for the prior approval of the planning authority and be erected on or before completion of the development.
