Report No R392/05 ANGUS COUNCIL DEVELOPMENT CONTROL COMMITTEE 17 MARCH 2005 DELEGATED APPROVALS REPORT BY THE DIRECTOR OF PLANNING & TRANSPORT Abstract: This report recommends that the Committee notes the applications detailed in Appendix 1 of the report granted by the Director of Planning & Transport in accordance with the Scheme of Delegation detailed in Standing Orders. 1.0 RECOMMENDATION 1.1 The Committee is asked to note the applications, detailed in the Appendix, granted approval under delegated powers. 2.0 INTRODUCTION 2.1 In terms of the Scheme of Delegation to officers, the Director of Planning & Transport is authorised to approve planning applications in accordance with the Development Plan, the Local Plans or established policies and where there are no objections, except those which raise a general issue affecting a large area, or are of major land or economic development significance. 3.0 APPROVALS 3.1 Attached as an Appendix is a list of applications granted under delegated authority during the period to 16 February 2005 to 9 March 2005. 4.0 FINANCIAL IMPLICATIONS 4.1 There are no financial implications. 5.0 HUMAN RIGHTS IMPLICATIONS 5.1 There are no Human Rights issues arising directly as a result of this report. 6.0 CONSULTATION 6.1 The Chief Executive, Director of Law & Administration and Director of Roads have been consulted in the preparation of this report. Uniform\DCDELGAT Report No R392/05 5 That prior to the commencement of the development, details of the means of site enclosure proposed to be used, shall be submitted for the prior approval of the planning authority and be erected on or before completion of the development. 6 That no development takes place until there has been submitted to and approved by the planning authority, a scheme of landscaping, including, where appropriate, an indication of all existing trees and hedgerows on the land and details of these to be retained and cleared, together with the measures for their protection in the course of development. 7 That the landscaping along the southern boundary comprises of semi-mature native species suitable as a screen to the satisfaction of the Director of Planning and Transport. 8 That the existing hedge and wall along the western boundary are retained and semi-mature rowan trees be planted adjacent to this boundary to the satisfaction of the Director of Planning and Transport. 9 That all planting comprised in the approved details of landscaping be carried out in the first planting season following the completion of the development or at earlier stages and any plants or trees which within a period of five years from the commencement of the use die; are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species. 10 That none of the existing trees within the site be felled, topped, lopped or otherwise interfered with without advance discussion with and without the prior written consent of the Director of Planning & Transport. 11 That before development commences protective fencing in accordance with BS 5837: 1991, Section 8.2.2. shall be erected around all trees to be retained, to enclose at least the protected rooting zones hatched on the approved plans. This fencing should remain in situ until development is completed and there shall be no passage of vehicles; excavations; storage of soil, plant, vehicles or other materials within the protective fencing. 12 That the route of any public utilities or other excavations that may affect the trees to be retained or planted, be agreed with the Director of Planning & Transport prior to any excavations being undertaken. 13 That prior to the commencement of works on site, an amended block plan shall be submitted indicating the widening of the access from the road to the north of the site, as required by the Director of Roads, for the approval of the Director of Planning & Transport. 14 That the disposal of sewage effluent be in accordance with the standards required by the building control authority. 15 That the rainwater run-off from all surfaces be directed to a soakaway system to the satisfaction of the building control authority. Uniform\DCDELGAT Report No R392/05 04/01211/FUL FM Construction (Letham) Change of Use from Former Smithy Buildings Ltd to Dwellinghouse and Garage at:- 16 Guthrie Street Letham Forfar Angus DD8 2PS Conditions 1 That the development hereby permitted shall be begun before the expiration of five years from the date of this permission. 2 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the planning authority. 3 That notwithstanding that the doquetted plan shows a slate blue tiled roof, that the existing stone slates are retained and reused where possible otherwise using second hand blue slates to the satisfaction of the Director of Planning and Transport. 4 That the window(s) on the east elevation be constructed in sash and case style or appearance. 5 That the external walls be finished with materials to match the existing building(s) to the satisfaction of the Director of Planning & Transport. 6 That the existing boundary wall(s) be retained. 7 That prior to the commencement of development a photographic record be taken of all elevations of the steading and should include shots of any unusual internal or external feature/s. Photographs, which may be digital, should be of good quality, showing all views and features clearly. Any scanned, digitised or copied images must be printed on good quality paper and be free from flaws. Photographs should be clearly marked with place name, grid reference and view for identification and shall be submitted for approval of the Councils Archaeologist and the Director of Planning and Transport. 8 That prior to the commencement of development precise details of a scheme to deal with contamination on the site will be submitted to and approved in writing by the Director of Planning and Transport. The scheme shall contain details of proposals to deal with contamination to include: i. measures to cap the site to ensure it is fit for the use proposed ii. measures to deal with contamination during construction works iii. programme for implementation of the remediation measures iv. condition of the site on completion of decontamination measures. Before any residential unit is occupied the measures to decontaminate the site shall be implemented in accordance with the approved details and programme of works to the written satisfaction of the Director of Planning and Transport.
