Res. 1028] The Committee on Rules, having had under consideration House Resolution 1028, by a record vote of 8 to 4, report the same to the House with the recommendation that the resolution be adopted. SUMMARY OF PROVISIONS OF THE RESOLUTION The resolution provides for consideration of H.R. 2, the Moving Forward Act, under a structured rule. The resolution provides two hours of general debate on the bill equally divided and controlled by the chair and ranking minority member of the Committee on Transportation and Infrastructure. The resolution waives all points of order against consideration of the bill. The resolution provides that an amendment in the nature of a substitute consisting of the text of Rules Committee Print 116–54, modified by the amendment printed in Part A of this report, shall be considered as adopted and the bill, as amended, shall be considered as read. The resolution waives all points of order against provisions in the bill, as amend- ed. Section 2 of the resolution provides that following general de- bate, it shall be in order for the chair of the Committee on Trans- portation and Infrastructure or his designee to offer an amendment en bloc consisting of the further amendments printed in part B of this report. The amendment en bloc shall be considered as read, shall be debatable for one hour equally divided and controlled by the chair and ranking minority member of the Committee on Transportation and Infrastructure or their respective designees, shall not be subject to amendment, and shall not be subject to a demand for division of the question. Section 5 of the reso- lution provides that after consideration of the amendment en bloc described in section 4, it shall be in order for the chair of the Com- mittee on Transportation and Infrastructure or his designee to offer an amendment en bloc consisting of the further amendments print- ed in part E of this report. The amendment en bloc shall be consid- ered as read, shall be debatable for one hour equally divided and controlled by the chair and ranking minority member of the Com- mittee on Transportation and Infrastructure or their respective designees, shall not be subject to amendment, and shall not be sub- ject to a demand for division of the question. Section 6 of the reso- lution provides that after consideration of the amendment en bloc described in section 5, it shall be in order for the chair of the Com- mittee on Transportation and Infrastructure or his designee to offer an amendment en bloc consisting of the further amendments print- ed in part F of this report. The amendment en bloc shall be consid- ered as read, shall be debatable for 30 minutes equally divided and controlled by the chair and ranking minority member of the Com- mittee on Transportation and Infrastructure or their respective designees, shall not be subject to amendment, and shall not be sub- ject to a demand for division of the question. Section 7 of the reso- lution provides that after consideration of the amendment en bloc described in section 6, it shall be in order for the ranking minority member of the Committee on Transportation and Infrastructure or his designee to offer an amendment en bloc consisting of the fur- ther amendments printed in part G of this report. The amendment en bloc shall be considered as read, shall be debatable for 30 min- utes equally divided and controlled by the chair and ranking mi- nority member of the Committee on Transportation and Infrastruc- ture or their respective designees, shall not be subject to amend- ment, and shall not be subject to a demand for division of the ques- tion. Section 8 of the resolution provides that after consideration of the amendment en bloc described in section 7, each further amend- ment printed in part H of this report shall be considered only in the order printed in the report, may be offered only by a Member designated in the report, shall be considered as read, shall be de- batable for the time specified in the report equally divided and con- trolled by the proponent and an opponent, shall not be subject to amendment, and shall not be subject to a demand for division of the question. The resolution provides that any amendment designated pursuant to section 9 shall be in order after consideration of the further amendments printed in part H if offered by a Member designated in this report, shall be debatable for 10 minutes equally divided and controlled by the pro- ponent and an opponent, shall not be subject to amendment, and shall not be subject to a demand for division of the question. The resolution waives all points of order against amendments en bloc described in sections 2 through 7 and the further amendments de- scribed in sections 8 and 9. The resolution provides one motion to recommit with or without instructions. EXPLANATION OF WAIVERS The waiver of all points of order against consideration of H.R. 2 includes waivers of the following: • Clause 3(d) of rule XIII, which requires the inclusion of a committee cost estimate in a committee report. A CBO cost es- timate on H.R. 2 was not available at the time the Committee on Transportation and Infrastructure filed its report. • Clause 3(e) of rule XIII, which requires the inclusion of a comparative print for a bill proposing to repeal or amend a statute. • Clause 12(a)(1) of rule XXI, which prohibits consideration of a bill unless there is a searchable electronic comparative print that shows how the bill proposes to change current law. • Clause 12(b) of rule XXI, which prohibits consideration of a bill unless there is a searchable electronic comparative print that shows how the text of the bill as proposed to be considered differs from the text of the bill as reported. • Section 306 of the Congressional Budget Act, which pro- hibits consideration of legislation within the jurisdiction of the Committee on the Budget unless referred to or reported by the Budget Committee. The waiver of all points of order against provisions in H.R. 2, as amended, includes waivers of the following: • Clause 4 of rule XXI, which prohibits reporting a bill car- rying an appropriation from a committee not having jurisdic- tion to report an appropriation. • Clause 5(a) of rule XXI, which prohibits a bill carrying a tax or tariff measure from being reported by a committee not having jurisdiction to report tax or tariff measures. Although the resolution waives all points of order against the amendments en bloc described in sections 2 through 7 of the reso- lution, the further amendments described in section 8, and the fur- ther amendments described in section 9, the Committee is not aware of any points of order. The waiver is prophylactic in nature.
