Clearly a large number of club The ACT Cross Country Club year in 2009 members are concerned about the dispute, was as usual a very full program are keen to see it resolved and have also comprising some 60 events that expressed strong support for the committee incorporated over 90 races. The thanks of in its attempts to retain ownership of the the committee go to those who undertook event. Since my last report on this matter the important role of event manager and to CSM commenced proceedings against the all club members who assisted in the club in the Federal Court under the conduct of each of our events. We provisions of the Trade Practices Act 1974. concluded the year with over 1200 A directions hearing was held in early members which makes the ACTCCC one of September and this led to the Court the biggest (if not the biggest) running directing that mediation be conducted by clubs in the country. The committee has the Federal Court Registrar acting as developed a draft program of events for mediator. Three committee members 2010 and the Sumer Series is now on the together with our legal representatives were website. I would like to encourage required to attend the first mediation members to make suggestions about new session in Sydney in November. At that courses that you think we should evaluate session the progress was extremely slow with a view to adding them to the annual and we spent half the day waiting while program in future years. CSM conferred with their legal team. A further directions hearing was held in A successful AGM was conducted in November and we were again directed to September 2009 with the committee participate in a further mediation session in reporting to members on the achievements, Sydney. The second mediation session was goals and challenges for the future. It was unsuccessful in achieving an agreement pleasing to see a number of new people join between the two parties. The mediator the committee (Scott Yates, Jane Burndred, urged us to continue discussions through Robbie Costmeyer, Ken Eynon) to fill our respective lawyers in an effort to reach places vacated by several long serving an out of Court agreement. Given that our committee members (Steve Mackenzie, attempts to continue discussions following Debbie Cowell, Kerrie Tanner, James the first mediation were stopped by CSM’s Minto). My thanks go to those who retired lawyer it’s unlikely that any further for their help and support. Our Treasurer discussion will occur. This probably means Matt McKerrow also retired at the AGM that the matter will now be decided through because of a pending move overseas. At the the Court and it’s unlikely that the hearing AGM we didn’t have a replacement for will take place before April 2011. A Matt. However, I am very pleased to report consequence is that the conduct of the 2010 that we now have a new Treasurer, Beryl and possibly the 2011 events are in doubt. Lowry. We look forward to Beryl’s The ACT Government has also indicated contribution to the work of the committee. that it will not provide approvals to conduct the Canberra Marathon while the dispute I commented in my last Canberra runner exists. CSM made an offer to the Club in message about the situation regarding the early December which we took to members dispute between the Club and Cundy Sports via an open letter.
