CALL TO ORDER PLEDGE OF ALLEGIANCE CALL TO THE PUBLIC: •Call to the Public is held for public benefit to allow individuals to address issue(s) within the Board's jurisdiction. Board members may not discuss items that are not specifically identified on the agenda. Therefore, pursuant to Arizona Revised Statute §38-431.01(H), action taken as a result of public comment will be limited to directing staff to study the matter, responding to criticism, or scheduling the matter for further discussion and decision at a future date. •Anyone who is concerned about COVID-19 and does not want to be put into an open setting can submit an email “Call to the Public” statement at: [email protected] These email forms of Public Comment will be accepted until 8:00 a.m. the morning of the meeting. All public comments will be read aloud during the Yuma County Board of Supervisors meeting that starts at 9:00 a.m. YCBOS PACKET -- Regular Session: October 19, 2020 2 of 288 PRESENTATIONS, PROCLAMATIONS & APPOINTMENTS: Note: During this segment of the agenda, board members may discuss the presentations and proclamations, and may announce appointments to the Yuma County Planning and Zoning Commission and the Yuma County Board of Adjustment. No legal actions will be taken. 1. Presentation of "The County Line" by Yuma 77, the Yuma County Government Channel. 2. Chairman proclaims October 2020 as "Domestic Violence Awareness Month". CONSENT CALENDAR: The following items listed under the Consent Agenda will be considered as a group and acted upon by one motion with no separate discussion, unless a Board Member so requests. In that event, the item will be removed from the Consent Calendar for separate discussion and action. 1. Assessor: Approve Tax Roll Corrections as listed in batch dated October 19, 2020, pursuant to ARS Title 42, Chapter 16, Article VI. (A full listing of all corrections is in the agenda packet on the web at: https://www.yumacountyaz.gov/government/board-of-supervisors/meetings) 2. Financial Services: a) Approve the Accounts Payable Demands disbursed in the amount of $2,036,112.92 and Payroll in the amount of $1,679,406.58 during the period of September 10, 2020 through September 27, 2020) and b) Approve the reissuance of stale dated Treasurer's Check #54150 in the amount of $179.14 payable to McFadden Hayward Jr. (A detailed listing is available for review from the agenda packet on the web at: https://www.yumacountyaz.gov/government/board-of-supervisors/meetings.) 3. Clerk of the Board: Approve the following minutes: a) September 21, 2020 Regular Session; and b) October 5, 2020 Regular Session. 4. County Administrator/Emergency Management: Authorize the Chairman to sign Subgrantee Agreement No. 200407-01 between Yuma County Emergency Management and the State of Arizona Department of Homeland Security for the State Homeland Security Grant Program (SHSGP) effective October 1, 2020 through September 30, 2020, for CERT Program training. 5. Treasurer: Per A.R.S. §42-19118, approve Certificate of Clearance No. 20-009, thereby removing taxes due which are considered to be uncollectible. 6. Superior Court Administration: Authorize the Chairman to sign the Certification Statement verifying that monies collected in Fiscal Year 2019-2020 by Superior Court, Clerk of Superior Court, and Yuma County Justice Courts totaled $6,038,614.02 which is 5% in excess of collections of the baseline year, of which 5% or $267,815.46 is eligible for the "set aside" fund pursuant to A.R.S. 41-2421(C). Recorder/Elections: Pursuant to A.R.S. §§ 16-821 (B.) and 38-291 (11), determine that vacancies exist for the eight (8) precinct committeeman offices of the Yuma County Libertarian Party, and appoint John Manning, Layton Pace, John Paul Plante, Chris Harmon, Albert Ustaszewski, Jr., Deborah Clark, Howard J. Blitz and Jordan Fountain, whose names appear on the attached list submitted by Howard Blitz, county chairman of the Yuma County Libertarian Party, to fill the vacant precinct committeeman offices. The precinct committeeman appointed pursuant to this board action shall be deemed elected precinct committeeman. (The list of names is available for review at the office of the Clerk of the Board of Supervisors.) 8. Recorder/Elections: Approve the Amended Intergovernmental Agreement between the County of Yuma, the Yuma County Recorder and the Gadsden Elementary School District No. 32, for the provision of election services, a copy of which is attached hereto, and authorize the Chairman to execute said Amended IGA. 9. AZ@Work: The Yuma County Administrator is requesting that the Yuma County Board of Supervisors approve the following re-appointments to the Local Workforce Development Board for terms that will expire on June 30, 2023: Maria Chavoya, and Marisol Kelland to represent the business sector; Kevin Imes to represent the workforce sector; and Gregory LaVann to represent the government, economic, and community development sector. DISCUSSION AND ACTION ITEMS: The Board will open each of the following items separately for discussion and action, as appropriate. 1. Recorder/Elections: Hear a presentation and update regarding the 2020 election cycle, and provide feedback and direction if appropriate. 2. County Administration/Public Health Services District/Emergency Management: Discussion and possible action regarding COVID-19 updates and activities. 3. Financial Services: Discussion and possible action to: a) Provide guidance and direction regarding the possibility of issuing pension obligation bonds to fully fund the County's current unfunded liability for its Public Safety Personnel Retirement System (PSPRS) and Corrections Officers Retirement Plan (CORP) pension plans; b) If the Board considers it appropriate to issue bonds, Pursuant to A.R.S. §11-391, schedule a Public Hearing to receive comments on authorizing the County to secure obligations by November 16th, 2020; and c) Approve the necessary budget adjustments to complete the transactions. 4. Engineering: Discussion and possible action to cancel the contract with DPE Construction, Inc. for the construction of the Smucker Park Detention Basin Project (CIP No. 3.9703), and move forward with a new bidding process for the project. 5. Public Works: Discussion and possible direction on budgeting options recommended by Infrastructure Management Services, LLC (IMS) for pavement management strategies. YCBOS PACKET -- Regular Session: October 19, 2020 4 of 288 DISCUSSION REGARDING LEGISLATIVE ISSUES: When County Attorney notifies us it's time to place these items on each agenda until further notice, they're the last item on the Discussion calendar & just before Event Calendar. (County Administrator reports on legislative issues each year, just before &/or during Legislative Sessions.) 1. County Administration: Discussion and possible action regarding the following legislative items: a) A report to the Board of Supervisors regarding proposed bills in the Arizona State Legislature with impact to Yuma County, and; b) Update regarding strategies relating to federal legislative priorities. EVENTS CALENDAR/CURRENT EVENTS: 1. Board members and County Administrator will report on and may discuss events attended or to be attended on behalf of the County, may present a brief summary of current events and may update the schedule for future Board of Supervisors meetings, as appropriate. No legal action will be taken, pursuant to A.R.S. §38-431.02(K). Action to adjourn. The Board may vote to hold an Executive Session for the purpose of obtaining legal advice from the Board's attorney on any matter listed on the agenda, pursuant to Arizona Revised Statute §38-431.03(A)(3).
