AGREED TESTING STRATEGY, AGREED SCHEDULE OF TESTS AND AGREED TESTING PROGRAMME 1.1 The SP shall perform tests on the Units and Equipment in accordance with Applicable Laws and Standards including BS EN 50215 (1999) – "Railway applications. Testing of rolling stock after completion of construction and before entry into service" and tests on the DOO CCTV System in order to demonstrate (to the satisfaction of RfL) that the Units and Equipment have been built in accordance with every part of the Train Technical Requirements, the obligations of this Agreement and all Applicable Laws and Standards. 1.2 The SP shall perform tests and participate in the Central Section Testing in conjunction with the Systemwide Contractor responsible for the Central Section Testing in order to demonstrate the performance and compatibility of the Units with the Central Section. 1.3 Within three months of the Commencement Date, the SP shall provide to RfL for Assurance Acceptance an updated final version of its provisional testing strategy (in the form described in part 2 of this schedule B4), setting out how it shall satisfy the requirements of paragraphs 1.1 and 1.2 of this part 1 of schedule B4. 1.4 Within six months of the Commencement Date, the SP shall provide to RfL for Assurance Acceptance its schedule of tests and testing programme (in the form in parts 3 and 4 respectively of this schedule B4), setting out the proposed dates for satisfying the requirements of paragraphs 1.1 and 1.2 of this part 1 of schedule B4. 1.5 In the course of its review of the draft testing strategy, draft schedule of tests and draft testing programme for Assurance Acceptance, RfL may specify any additional tests which it requires in order to be assured that the Vehicle and/or Unit and/or item of Equipment and/or the DOO CCTV System (as the case may be) has satisfied any of the requirements specified in this Agreement. Upon Assurance Acceptance of such draft strategy, draft schedule and draft programme, they shall be the "Agreed Testing Strategy", the "Agreed Schedule of Tests" and the "Agreed Testing Programme" respectively for the purposes of this Agreement. 1.6 The Agreed Testing Strategy, the Agreed Schedule of Tests and the Agreed Testing Programme shall together describe and set out the nature of the tests, specifications, methodology, pass/fail criteria, test location and date for each test against the corresponding part of the Train Specification and shall comprise the following parts: (a) Type Tests (in accordance with paragraph 2); (b) Factory Acceptance Tests (in accordance with paragraph 3); (c) Testing on the Network Sections (in accordance with paragraph 4); (d) Testing on the Heathrow Spur (in accordance with paragraph 5); (e) Central Section Testing (in accordance with paragraph 6) which for the purposes of this Agreement includes: (i) Phase 4.0 (Joint Proving Tests); (ii) Phase 4.1 (Infrastructure – dynamic testing); (iii) Phase 4.2 (Units – dynamic testing); REDACTED VERSION Schedule B4 (Testing (Units)) (iv) Phase 4.3 (Infrastructure – systems integration); (v) Phase 5 (Trial Running Tests); and (vi) Phase 6 (Trial Operations); and (f) Equipment Acceptance Tests (in accordance with paragraph 13). 1.7 The SP shall identify in the Agreed Testing Strategy those tests to be initially carried out on the RLUs and which will need to be carried out again in relation to the additional Vehicles making up the FLUs and in relation to the functionality of the FLU as a completed Unit. 1.8 The SP shall set out in the Agreed Testing Strategy how it proposes to retest those Units that incur Modifications that arise during the manufacturing process. The SP shall make all necessary allowance in the Agreed Testing Programme for the said retesting. 1.9 Where the SP does not submit a full test specification to RfL in respect of each test described under paragraph 1.6 and 1.7, it shall indicate a date in the Agreed Testing Programme when such test specification shall be provided to RfL for Assurance Acceptance (which shall be no later than three months before such test is scheduled to be carried out). 1.10 If the SP wishes to change any tests in the Agreed Schedule of Tests or Agreed Testing Programme, it shall submit to RfL for Assurance Acceptance the proposed test specification with clearly defined pass/fail criteria at least two months prior to the conduct of any scheduled test. 1.11 For the purposes of testing (other than development testing under clause 21.3(a)) on the Network Sections and/or the Heathrow Spur in accordance with paragraphs 4 and 5 respectively, the SP shall only supply Units which have achieved, as a minimum, Pre- Provisional Acceptance in accordance with clause 21.3 of the Agreement. For the purposes of supplying Units for Central Section Testing, paragraph 6.5 shall apply. 2. TYPE TESTS 2.1 In the Agreed Testing Strategy, the Agreed Schedule of Tests and the Agreed Testing Programme, the SP shall: (a) describe those Type Tests or other tests that it will conduct on the Units (such as ride quality and emergency brake testing) and those Type Tests that will be conducted in relation to a particular Subsystem (such as body shell strength); and (b) identify any Type Tests that it will undertake in relation to the Units on: (i) the Network Sections; (ii) the Heathrow Spur; and (iii) the Central Section, drawing particular attention to those Type Tests that are required to be carried out in conjunction with the Systemwide Contractor; and (c) describe those Type Tests to be conducted on the various items of Equipment and the DOO CCTV System. 2.2 The SP shall conduct each of the Type Tests on each component, Subsystem, system, Vehicle, Unit and the DOO CCTV System in accordance with the Agreed Schedule of Tests and the Agreed Testing Programme provided that the SP may submit previous type test REDACTED VERSION Schedule B4 (Testing (Units)) results if it is able to demonstrate to the satisfaction of RfL that such type test results (and the type test itself) satisfy the requirements for the components, Subsystems, systems, Vehicles and Units set out in this Agreement. 2.3 Network/Central Section Proxy Tests (a) The Agreed Testing Strategy shall describe and detail the Proxy Test Facilities and the Agreed Schedule of Tests shall set out detailed specifications of the Network/Central Section Proxy Tests which are Type Tests to be carried out at each of the Proxy Test Facilities. (b) The SP shall procure the relevant Proxy Test Facilities by agreement with the providers of each relevant system and technical interface including the suppliers of the signalling systems, PED, ETCS and the DOO CCTV System. (c) Pursuant to clause 20.5(b) and clause 20.5(c), RfL or its representatives shall be entitled to witness any Network/Central Section Proxy Tests and the SP shall provide reasonable prior written notice to RfL of when such testing shall be undertaken.
