Reports and Bylaws from Departments a Planning Department 20 - 23 i) Committee of Adjustment Minutes May 17, 2017 meeting THAT Council accepts this Report “Committee of Adjustment Minutes May 17, 2017 meeting” as information only, as submitted by the Building/Planning Clerk. 24 - 31 ii) Bylaw 2017 – 055 to authorize permanent closing of Shore Road Allowance THAT Council accepts this report “Bylaw 2017-055 to authorize permanent closing of Road Allowance” as submitted by the Building/Planning Clerk; and THAT Council passes Bylaw 2017 – 055 1. To authorize the permanent closing of : Firstly: Part of Lot 29, Concession 11, as shown as Road Allowance on Registered Plan 1712, Part 1, Plan 21R- 24875, in the Geographic Township of Bangor, and Secondly: Parts of the Shore Road Allowance along Kamaniskeg Lake in front of Lot 29, Concession 11 (shown as Road Allowance on Registered Plan 1712), Parts 2, 3 & 4, Plan Page 2 of 297 21R-24875, in the Geographic Township of Bangor now in the Municipality of Hastings Highlands, County of Hastings (Cone/Finley-601 B Parchers Road, Barry’s Bay) 2.To declare surplus to the Municipality’s needs the foregoing portion of Shore Road Allowance 3.To authorize the sale of the foregoing portion of Shore Road Allowance in accordance with sections 34 and 268 of the Municipal Act, 2001, S.O. 2001, c.25. 32 - 37 iii) Bylaw 2017 – 061 to establish certain lands as a public travelled highway and authorize execution of a Transfer. THAT Council accepts this report “Bylaw 2017-061 to establish certain lands as a public travelled highway and authorize execution of a Transfer” as submitted by the Building/Planning Clerk; and THAT Council passes Bylaw 2017 – 061 to accept the transfer of lands from Cheryl Ann Bandel and David Bandel of Part of Lot 7, Concession 1, in the Geographic Township of Wicklow, being Part 3 on Plan 21R-24873 being part of McLean Road. 38 - 45 iv) Bylaw 2017 – 065 Dori/McConnell Water Quality Impact Assessment Agreement THAT Council receives this report “Bylaw 2017 – 065 Dori/McConnell Water Quality Impact Assessment Agreement” as submitted by the Building/Planning Clerk; and THAT COUNCIL approves Bylaw 2017-065 being a Bylaw authorizing the execution of a Water Quality Impact Assessment Agreement between The Corporation of the Municipality of Hastings Highlands Zoli Istvan Dori and Jennifer Lynn McConnell as hereinafter described and to authorize the Municipality to execute documentation to register the Agreement. 46 - 61 v) Bylaw 2017-067 West Bay House Resort Ltd. Site Plan Agreement, 187 Storey Road, Baptiste Lake, being Part of Lot 32, Concession 5 and Part of Lot 32, Concession 6, Geographic Township of Herschel THAT Council accepts this report “Bylaw 2017-067 West Bay House Resort Ltd. Site Plan Agreement, 187 Storey Road, Baptiste Lake, being Part of Lot 32, Concession 5 and Part of Lot 32, Concession 6, Geographic Township of Herschel” as submitted by the Building/Planning Clerk; and Page 3 of 297 THAT Council passes Bylaw 2017-067 being a bylaw to enter into a Site Plan Control Agreement between The Corporation of the Municipality of Hastings Highlands and West Bay House Resort Ltd. with respect to Part of Lot 32, Concession 5 and Part of Lot 32, Concession 6, in the Geographic Township of Herschel, now in the Municipality of Hastings Highlands, County of Hastings and being municipally known as 187 Storey Road, Baptiste Lake. 62 - 65 vi) Bylaw 2017 – 068 to deem Lots 18 and 19, Plan 731, in the Geographic Township of McClure, to no longer be part of the Plan of Subdivision THAT Council accepts this report “Bylaw 2017 – 068 to deem Lots 18 and 19, Plan 731, in the Geographic Township of McClure, to no longer be part of the Plan of Subdivision” as submitted by the Building/Planning Clerk; and THAT Council passes Bylaw 2017 – 068 to deem Lots 18 and 19, Plan 731, in the Geographic Township of McClure, now in the Municipality of Hastings Highlands, in the County of Hastings to no longer be part of the Plan of Subdivision. 66 - 77 vii) Karn Severance B42/17, Part of Lot 17, Concession 9, Geographic Township of Monteagle, 59 Mooney Road THAT Council accepts this Report “Karn Severance B42/17, Part of Lot 17, Concession 9, Geographic Township of Monteagle, 59 Mooney Road” as submitted by the Building/Planning Clerk; and THAT Council supports the Consent of the Land Division to sever a 4 hectare (9.88 acre) parcel of land subject to the following: • $1,000.00 Cash-in-Lieu of Parkland • Taxes paid to date • Paper copy of reference plan • PDF format copy of reference plan • Safe Site Entrance • 66 feet deeded to Municipality centred on the travelled portion of Mooney Road for road widening purposes • Rezone severed lot to the Rural Residential (RR) zone. 78 - 89 viii) Pelley Severance B56/17, Part of Lots 59 and 60, East of Hastings Road, Geographic Township of Monteagle, 32044 Highway 62 and Graphite Road THAT Council accepts this Report “Pelley Severance B56/17, Part of Lots 59 and 60, East of Hastings Road, Geographic Township of Monteagle, 32044 Highway 62 and Graphite Road” Page 4 of 297 as submitted by the Building/Planning Clerk; and THAT Council supports the Consent of the Land Division to sever a 15.2 hectare (38.79 acre) parcel of land subject to the following: • $1,000.00 Cash-in-Lieu of Parkland • Taxes paid to date • Paper copy of reference plan • PDF format copy of reference plan • 33 feet deeded to Municipality for road widening purposes along Graphite Road or confirmation from the Surveyor that Graphite Road is situated entirely on the Road Allowance between Lots 60 and 61, East of Hastings Road, Monteagle. 90 - 101 ix) Pelley Severance B57/17, Part of Lots 59 and 60, East of Hastings Road, Geographic Township of Monteagle, 32044 Highway 62 and Graphite Road THAT Council accepts this Report “Pelley Severance B57/17, Part of Lots 59 and 60, East of Hastings Road, Geographic Township of Monteagle, 32044 Highway 62 and Graphite Road” as submitted by the Building/Planning Clerk; and THAT Council supports the Consent of the Land Division to sever a 4 hectare (9.88 acre) parcel of land subject to the following: • $1,000.00 Cash-in-Lieu of Parkland • Taxes paid to date • Paper copy of reference plan • PDF format copy of reference plan • 33 feet deeded to Municipality for road widening purposes along Graphite Road or confirmation from the Surveyor that Graphite Road is situated entirely on the Road Allowance between Lots 60 and 61, East of Hastings Road, Monteagle. 102 - x) Watson proposed purchase of Original Shore Road Allowance in 112 front of 24 Blueberry Island, Baptiste Lake, Part of Lots 26 and 27, Registered Plan 722, Part of Lot 11, Concession 7, in the Geographic Township of Herschel. THAT Council accepts this Report “Watson proposed purchase of Original Shore Road Allowance in front of 24 Blueberry Island, Baptiste Lake, Part of Lots 26 and 27, Registered Plan 722, Part of Lot 11, Concession 7, in the Geographic Township of Herschel” as submitted by the Building/Planning Clerk; and THAT Council gives tentative approval to the proposed closure Page 5 of 297 and sale of part of the Shore Road Allowance around Baptiste Lake in front of 24 Blueberry Island, Part of Lots 26 and 27, Registered Plan 722, Part of Lot 11, Concession 7, in the Geographic Township of Herschel; and THAT Council approves the Preliminary Reference Plan attached hereto and directs staff to complete the closure of part of the Original Shore Road Allowance around Baptiste Lake lying in front of 24 Blueberry Island, Part of Lots 26 and 27, Registered Plan 722, Part of Lot 11, Concession 7, in the Geographic Township of Herschel and to sell Parts 2 and 3 to the adjoining owners, Randy Thomas Watson and Ann Marie Watson.
