The site is undergoing remediation under DOE's Formerly 1 Utilized Sites Remedial Action Program (FUSRAP). The Department of Energy is proposing to grant an easement right-of-way over a portion of the CISS to the Niagara Mohawk Power Corporation to accommodate DOE's needs for relocating an existing transmission line and associated tower structures to I the new right-of-way. This action will enable DOE to accomplish remediation and stabilization of soil having radiological and chemical contamination within the existing right-of-way. Although DOE will grant a permanent easement, there will be no change in ownership of the property. The area in the immediate 1 vicinity of the tower structures in the new right-of-way will be remediated prior to their installation. The remediation of the remaining area of the new easement right-of-way is scheduled as part of the remaining 1 remedial actions to be completed at the CISS. A review of government records and an inspection of the property was performed in accordance with Section 120(h) of the Comprehensive Environmental Response, Compensation, and Liability Act to identify 1 any areas on the property where hazardous substances and petroleum products were stored for one year or more, known to have been released, or disposed of. Section 120(h) also requires that DOE include in any contract for the sale or transfer of real property, which is owned by the United States, a notice of the i time at which storage, release, or disposal of hazardous substances or petroleum products have taken place. The following is a summary of the results of the CERCLA 120(h) evaluation performed: • There is documentation that hazardous substances and other hazardous chemicals were stored at the CISS for one year or more during the period of commercial operation by the property's previous owners in quantities meeting or exceeding the 1000 kg reporting threshold of 40 CFR 373, the implementing regulations for CERCLA 120(h). Chemical inventories were also present on site when DOE assumed ownership of the property and remained on-site pending off-site disposal. • There is evidence that a release or disposal of hazardous substances or petroleum products in excess of the substance's reportable quantity (RQ) occurred at the CISS during its operation by National Lead Industries. • There is radiological contamination at the CISS in excess of the release limits specified in DOE Order 5400.5 and 10 CFR 835. Additionally, surveys found radiological contamination at 56 vicinity properties. Fifty-three of these properties have been remediated. This radiological contamination occurred during the period of ownership by National Lead Industries as a result of airborne stack emissions from the plant. • The CISS is not on the Environmental Protection Agency's National Priorities List (NPL) of Superfund sites under CERCLA. • There is surface and subsurface radiological, chemical, and metals contamination in, and adjacent to, the footprint of the proposed easement. in I I 1. PROPERTY IDENTIFICATION The Colonie Interim Storage Site (OSS) is located at 1130 Central Avenue in the Town of Colonie, Albany County, New York and consists of approximately 11.2 acres in area. The location of this property is depicted 1 in Figure 1 and Figure 2'. The U.S. Department of Energy (DOE) is planning to grant an easement to Niagara Mohawk Power Company for the installation of overhead electrical transmission lines and associated tower structures at the C1SS. The new easement will replace an existing easement over the property. The general I area of the proposed easement is shown on the site drawing in Appendix A, page A-2. The exact location of the easement is subject to minor changes before the final real estate documents are prepared between DOE and I the Niagara Mohawk Power Company. 1 I 1 I I I 1 I I I I 1 The main building and small storage sheds to the southwest depicted on Figure 2 have been demolished. The figure also shows the relation to the site of the former Patroons Lake which was partially I filled by National Lead. The remaining portion of the lake was drained. TITLE SEARCH On June 30, 1997, the Albany County (New York) Clerk's Office was visited and a review was conducted I of the recorded deeds documenting previous ownership of the land that comprises the present CISS property. These deed records document that on April 28, 1923, the Embossing Company purchased two parcels of land (single purchase) from Redacted - Privacy Act . These two parcels comprise most of the present-day CISS. A review of deeds documenting ownership of the parcels before their sale by the Fords to the I Embossing Company produced no evidence that they had been utilized for the storage or disposal of hazardous substances and/or petroleum products. I On January 17, 1927, the Magnus Company, Inc. purchased the above-mentioned parcels from the Embossing Company. Magnus Company, Inc. expanded the size of the site with the purchase of two additional small parcels of land on March 25,1927. Separate transactions consummated the purchase of these I parcels, one parcel being conveyed by George Ford, and the other being conveyed by Lillian Ford. A review of deeds documenting previous ownership of these latter two parcels before their sale to Magnus Company, Inc. produced no evidence that they had been utilized for the storage or disposal of hazardous substances 1 and/or petroleum products. On October 31, 1936, the National Lead Company purchased the property from Magnus Metal Corporation I (formerly known as Magnus Company, Inc.). Following this initial purchase, National Lead Company purchased an adjacent land parcel on August 25, 1937, from Redacted - Privacy Act (Executor and Trustee of the estate of Redacted - Privacy Act ). Recorded as part of the deed of conveyance is an Albany County Clerk's I Subdivision Map No. 592, which contains a March 12, 1936, boundary survey of the parcel that was made by Sham brook and Browne. Facilities and other features shown on the map indicate that this parcel was 1 previously utilized for recreational purposes only. On January 15, 1940, National Lead Company conveyed a parcel of land containing approximately 2.48 acres of land to the New York Power and Light Corporation. This parcel accommodated the needs of the New I York Power and Light Corporation for a right-of-way for an electrical transmission line system and construction of a substation near Central Avenue. I On May 21, 1956, the Niagara Mohawk Power Company, the successor company of New York Power and Light Corporation, purchased an additional parcel of land for its electrical transmission line right-of-way from Redacted - Privacy Act containing approximately 0.86 acres of land. 1 On March 6, 1959, National Lead Company acquired an adjacent parcel of land (designated as Parcel No.
