Bill 08-2459 Ordinance PROPOSED BY: STAFF BILL NO: 08-2459 INTRODUCED BY: ORDINANCE NO AN ORDINANCE PROHIBITING WORK WITHIN THE RIGHT-OF-WAY ON DESIGNATED STREETS DURING CERTAIN HOURS DURING THE PERIOD OF THE I-64 HIGHWAY CLOSURE WHEREAS, St. Louis County is facing the closure of substantial portions of Interstate 64 (Highway 40) for a period of up to three years beginning January 1, 2008, which closure will significantly impact traffic patterns and congestion in the area, including traffic on Interstate 270, Ballas Road and Manchester Road in the City of Des Peres; and WHEREAS, The Missouri Department of Transportation and the St. Louis County Department of Highways and Traffic are imposing restrictions on non-emergency work in the public rights of way of the streets, controlled highways, and county arterial roadways over which they have jurisdiction in order to facilitate the flow of traffic during peak hours; and WHEREAS, the City of Des Peres believes it is in the best interest of the community to extend the state and county rules to certain local collector roadways and to provide an enforcement mechanism for violators of those restrictions; WHEREAS, it is the intention of the Board of Aldermen of the City of Des Peres that these restrictions shall remain in place until such time as Interstate 64 is reopened to traffic between Ballas Road and Interstate 170;. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF DES PERES, MISSOURI, AS FOLLOWS: SECTION ONE: It shall be unlawful for any person, firm, corporation or public utility personnel or agent to perform or cause to be performed any non-emergency construction, utility or other work between the hours of 5:00 AM and 7:00 PM on weekdays in such a manner as to cause blockage of or interference with the free flow of traffic, reduce lane width, or otherwise negatively affect traffic flow, on any of the following streets: State Routes: Interstate 270, Manchester Road, Ballas Road County Roads: Ballas Road, Dougherty Ferry Road, Barrett Parkway Drive City Streets: Bopp Road, Des Peres Road unless a special permit for such work shall have been issued by the Missouri Department of Transportation, the St. Louis County Department of Highways and Traffic, or the Department of Public Works of the City of Des Peres. SECTION TWO: Such restrictions shall be in effect until the earlier of (a) the reopening of Interstate 64 between Ballas Road and Interstate 170 by the Missouri Department of Transportation, or (b) the rescission of similar restrictions by MoDOT and St. Louis County Department of Highways and Traffic. SECTION THREE: This Ordinance shall be in full force and effect from and after its passage and approval.
