Report on ongoing interinstitutional negotiations Amending Directive 2013/34/EU on disclosure of income tax information by certain undertakings and branches - Trilogue of 1 June On 1 June, in the third trilogue, a provisional political agreement was reached on the proposal for a Directive of the European Parliament and of the Council amending Directive 2013/34/EU as regards disclosure of income tax information by certain undertakings and branches: the proposal on public country-by-country reporting. PV\1234045EN.docx PE693.862v01-00 EN United in diversityEN I would like to congratulate the co-rapporteurs, Evelyn Regner for ECON and Iban Garcia del Blanco for JURI, and the negotiating team for this achievement. I would also like to thank the Portuguese Presidency for their efforts in bringing back this important file to the negotiation table after five years dormant in Council, and thank the Commission for their role as loyal broker between the Parliament and the Council. On the content, I will briefly sum up the main features of the agreement: - Regarding the content of the report on income tax information, co-legislators agreed in including, together with other items, the number of employees on a full-time equivalent basis and the list of all subsidiary undertakings established in the Union or in tax jurisdictions included in Annex I and Annex II of the Council conclusions on the EU list of non-cooperative jurisdictions for tax purposes. - The report should be made available on the undertakings' websites, using a common template, and in a machine-readable format. The disaggregation will occur in relation to MS and to jurisdictions in Annex I of the Council conclusions of the list of non- cooperative jurisdictions for tax purposes (the so-called black list) but also in relation to Annex II (the grey list). - Anti-avoidance clause is included covering all subsidiaries and branches regardless of their size. We are now awaiting confirmation of the agreement by COREPER in order to proceed with a vote on the provisional political agreement in ECON/JURI very soon (possibly on 14 June). Subsequently, after the usual linguistic verification, Council will adopt its first-reading position and the ECON/JURI Committee will vote on a recommendation to Plenary. The votes on the amendments on item 5 and 6 took place - following the announcement of the Chair - from 09:08 to 10:38 and the final votes on items 5, 6 and 7 took place between 12:30 and 13:30. 5.
