GENERAL TERMS AND CONDITIONS

Cover
The Applicant undertakes to pay the cover on demand and in any case not later than two banking days prior to the due date. If a documentary credit is denominated in a currency outside the euro area and the cover is to be paid or debited in euro, the applicable rates of exchange shall be the selling rate of the respective currency as quoted by the Bank at the time of processing, unless otherwise agreed. The Bank shall obtain the required currency amount for the account and at the risk of the Applicant. Any cover amounts that may remain unutilised shall be reimbursed to the Applicant at the buying rate quoted by the Bank at the time of reimbursement.
Expenses, taxes and feesThe Applicant undertakes to pay on demand the Bank's fees for the documentary credit in question, any interest payable and any mailing, telecommunication, courier or other expenses incurred in this connection. The Applicant also undertakes to pay any expenses and fees charged by foreign banks and any taxes and collection expenses that may arise from the documentary credit in question.
Interest on overdue paymentsIf the Applicant fails to meet his obligations under this documentary credit, the Bank shall be entitled to charge interest on any payments made by it under the documentary credit, any overdue fees and any expenses incurred by it in this connection. Unless otherwise agreed, the rate of interest applicable to such overdue payments shall be seven percentage points above reference rate in accordance with the Interest Rate Law. The interest is calculated from the date on which the Bank paid the amount or a part of it or the expense item in question or the date on which the fee became payable, until the date on which the Applicant pays the required cover, compensates the expenses or pays the fee to the Bank.
DocumentsThe Applicant undertakes to check the documents immediately upon receipt and to acknowledge receipt to the Bank without delay, and at the same time either to indicate his approval of the documents or to point out possible discrepancies.
PledgesAs security for the due performance of his obligations under the documentary credit in question, the Applicant hereby pledges to the Bank all amounts paid in cover of the documentary credit, the related documents received by the Bank or its correspondent bank, the goods therein specified and/or the corresponding rights to insurance claims. If the Applicant fails to fulfil the terms and conditions of this undertaking, the Bank shall be entitled, without consulting the Applicant, without applying for a judgement or decision, without observing the statutory formalities and without announcing the pledged assets for sale, to convert the pledged assets into cash in a public auction or in any other way it sees fit. If necessary for the purpose of liquidating the pledged assets, the Bank shall be entitled, without further consultation with the Applicant, to transfer documents issued to Applicant's order to third parties and to sign other documents on behalf of the Applicant if required for that purpose.
The Bank shall be entitled but not obliged at the Applicant's expense to take such measures as it deems necessary to protect the value of the pledged assets.
JurisdictionAny disputes arising from these general terms and conditions shall be settled in the Helsinki District Court. / ENCLOSURES:

This documentary credits are subject to The Uniform Customs and Practice for Documentary Credits issued by ICC which are valid at the time of issuance
Documents requiredGeneralThe documentary credit application should stipulate by whom documents are to be issued and/or their wording or date content. Documents are required to be presented as originals unless otherwise stipulated in the application.
Transport documentsUnless otherwise stipulated in the applicantion
- the Bill of Lading is required as full set, consigned to order, blank endorsed and notify applicant
- Airwaybill, Road or Railway Transport Document is to be consigned to applicant
Other documentsIn case goods are to be insured by the seller insurance policy/certificate covering either Institute Cargo Clauses A or other clauses named by the applicant is required to be presented. In case GSP Certificate of Origin of EUR 1 Movement Certificate is required as certificate of origin, the applicant must stipulate it in the application.
