1. DECLARATION OF INTERESTS & REQUESTS FOR DISPENSATIONS TO SPEAK ON ITEMS ON THE AGENDA: 1.1. To receive declarations of interest from councillors on items on the agenda 1.1.1. Cllr. J. P. Candy declared a disclosable pecuniary interest relating to item 4.1.2., being the applicant of planning application PA13/11471. 1.1.2. Cllr. S. J. Parry declared a disclosable pecuniary interest relating to item 13.1.2., (Tanver Yate), because of a business connection with an interested party relating to that land.

1.2. To receive requests for dispensations for disclosable pecuniary interests (if any) No requests were made. 1.3. To grant any requests for dispensations as appropriate It was noted that a dispensation had been granted at the previous meeting for Cllr. S. J. Parry to speak for information on item 13.1.2. for a six month period from that meeting.

Notice of Order for Tree Preservation on Land to the north of Chy An Drea, Keveral Lane, Seaton (Ref: 39003/JB 17 th December 2013) Request for comments from the Parish Council as part of the consultation process by 28 th January 2014 The Vice-Chair proposed support of this T.P.O.; this was seconded by Cllr. Mrs. M. C. Williams and agreed unanimously by the Meeting.

7. MATTERS RAISED BY MEMBERS 7.1. Cllr. Ms. H. M. Brockbank informed members that during recent storms a large branch had fallen onto Main Road, Downderry, from a Monterey Pine tree, located at Briar Cottage, Trewall Hill, Downderry. This tree was subject to a recent T.P.O. The Clerk was instructed to contact the Mr. Colin Hawk, Tree Officer, in order to request that this tree be inspected.

The Vice-Chair handed back chairmanship of the Meeting to the Chair.

8. MINUTES: 8.1. Minutes of the Ordinary Meeting of 14th November 2013 It was proposed from the Chair, seconded by the Vice-Chair and AGREED by the Meeting to accept the minutes as a correct record.

9. REPORTS ON MATTERS ARISING FROM THE MINUTES: There were no matters arising.

10. POLICE MATTERS: 10.1. Police matters 10.1.1. Vandalism of public toilets and Parish noticeboards The Clerk stated that the Perspex in the notice board outside St. Nicolas Church, Downderry had been broken and replaced 3 times over the last couple of months. It had now been broken again and had not yet been replaced. This matter had been reported to the police. Small windows in the door of the gents’ toilet at Downderry Public Toilets had been broken on two occasionsFROM in December 2013. THE PARISH WEBSITE

10. POLICE MATTERS (continued): 10.1.1. Vandalism of public toilets and Parish noticeboards (continued) The Seaton toilets had been blocked with rolls of toilet paper and paper smeared on the walls and floor in December 2013. These matters had also been reported to the police.

10.1.2. Speed Watch in Deviock Parish The Clerk stated that he was currently waiting on Police Sgt. Angela Crow to confirm the suggested speeding hot spots in the Parish. Speed checks can only be carried out where there is already a speed limit of 40mph or less in place. So far three people had offered to take part in the scheme. The Clerk was advised to advertise the scheme locally.

10.1.3. The Chair stated that he had spoken to the new Chief Inspector regarding P.C.S.O. presence in the parish. The Chair proposed that the Clerk be instructed to write to the Chief Inspector lodging a formal complaint regarding the lack of local policing and supporting the deployment of more resources at the Torpoint police station; this was seconded by Cllr. Mrs. A. Robinson and agreed unanimously by the Meeting.

11.5.2. The Chair proposed that a letter of thanks be send to Mr. John Bird for his work to keep the public toilets in good order through difficult times; this was seconded by the Vice-Chair and agreed unanimously by the Meeting.

It was proposed from the Chair; seconded by Cllr. Mrs. A. Ratsey and RESOLVED by the Meeting to ratify the above expenditure.

11.7. FINANCIAL CORRESPONDENCE No correspondence had been received.

11.8. TO RATIFY THE REVISED 2014/15 PRECEPT REQUEST OF £22,221.81 The Clerk informed members that further to recent notification that Cornwall Council would be making a Council Tax Support Grant of £1,693.19 to the Parish Council, a straw poll of councillors expressed the view that the Parish Council Precept Request 2014/15 should be reduced by that amount. This reduced amount request of £22,221.81 had been submitted to Cornwall Council. The Chair proposed that the Council ratify the revised 2014/15 Precept request of £22,221.81 ; this wasFROM seconded by the THEVice-Chair and agreedPARISH unanimously by the WEBSITEMeeting.

11.9. FINANCIAL BUSINESS RECEIVED AFTER THE PUBLICATION OF THE AGENDA: There was no business to consider.

12. HIGHWAY MATTERS: 12.1. TRAFFIC & PARKING ISSUES: Downderry, Seaton & Hessenford 12.1.1. Speed limit for The Clerk stated that he had received no response to the Council’s request for the provision of a 30 mph limit through Narkurs. The Clerk was advised to chase up this with Mr. Robert Constance (Cornwall Council, Highways Officer) The Clerk also informed members that Mr. Constance had offered to attend a Parish Council meeting in order to update councillors on the Hessenford Valley repair work. Cllr. Mrs. A. Ratsey requested that the increasing presence of cracks in the B3247 road at the “S” bend to the east end of Downderry be reported to the Highways Dept. and that an inspection be carried out.

12.1.2. Church Hill, Hessenford: Road maintenance / Gully clearance (emails from Mr. Jeff Small 18 th November 2013 & 6 th January 2014) The Chair informed members that current programme of maintenance was for drains / gullies on this road to be cleared twice a year. Because of poor conditions the maintenance schedule has slipped in 2013.

12.1.3. Drain / Gully clearance (email from Cllr. Scott Parry 7 th January 2014) Regarding the Seaton Valley Road, the Chair suggested that Cllr. S. J. Parry identify the drains that were blocked so that they could receive attention from Cornwall Council, Highways Dept. Cllr. R. J. Daniel informed members that a culvert under Treliddon Lane, Downderry, had been blocked by debris.

12.2. PUBLIC TRANSPORT ISSUES 12.2.1. Cllr. G. A. J. Beach requested data information relating to the 2007 Parish Plan as part of his research into current public transport needs in the Parish. The Chair praised the Downderry & Seaton Community Bus Charity for having maintained the daily school run during the recent Brenton Road closure period. The Chair also expressed regret that a public bus / taxi service had not been provided for the residents of Seaton because of budgetary constraints at Cornwall Council.

13. CURRENT / ONGOING BUSINESS: - 13.1. PARISH PROJECTS 13.1.1. Rocknose Footpath: The Chair agreed to contact Mr. Derek Elliott (Project manager) in order to determine whether he was happy to continue in his role as project manager, further to his recent illness. It was agreed that a card should be sent to Mr. Elliott. The Chair stated that the current position regarding the project was that Mr. Graham Gilham of the John Grimes & Partnership was still in negotiations with Cornwall Council regarding the revised design of the proposed path.

13.1.2. Tanver Yate: To consider possible alternative uses for this land Cllr. Mrs. A. Ratsey informed members that she and the Chair had met with the covenant holders. The meeting had been very positive and agreement had been reached that the existing covenant on the land could be amended to allow for the provision of allotments at the site. The covenant holders were concerned that the allotments should be well managed with an unclutteredFROM appearance. Cllr.THE Ratsey advised PARISH that an informal meeting WEBSITE was to be held with the covenant holders in order to design a scheme to progress the project.

13.2. SEATON COUNTRYSIDE PARK 13.2.1. Distance Markers – Update: Cllr. S. J. Parry stated that the markers should be in place by the end of January 2014 The Clerk was informed that Friends of Seaton Countryside Park would be contributing £200.00 to the Parish Council towards the costs of providing the distance markers.

13.2.2. – Update on management of the river Cllr. Scott Parry wished to debate whether the river’s current position had contributed towards the extraordinary damage, predicted by many locals. The Chair stated that an estimated cost by Cornwall Council for redirecting the course of the River Seaton at Seaton beach had been many thousands of pounds. Temporary repairs were being undertaken to the sea wall at Bridge Road, Seaton. A full structural survey and design for a permanent flood defence scheme would need to be carried out. It was planned for Cornwall Council to hold a public meeting on this matter. After discussion Cllr. Mrs. M. C. Williams proposed that Cornwall Council be asked to redirect the course of the River Seaton at Seaton Beach; this was seconded by Cllr. Mrs. A. Thorpe and agreed by the Meeting (one abstention). Cllr. Mrs. A. Ratsey stated that works relating to flooding could be eligible for funding from the “Coastal Communities affected by Climate Change” organisation. The Clerk was asked to investigate this. Cllr. G. A. J. Beach stated that on the evening that damage to the sea wall at Seaton was occurring he contacted “Silver Command” in order to request urgent action be taken to warn the public that this wall was in a dangerous state and to cordon off the area. No action was taken until later the following day. An attempt to flag down a police car at Downderry, in order to alert the police to his concerns, was unsuccessful, the police car simply reversing away and driving off. The Clerk was asked to report these matters.

Cllr. S. J. Parry also reported that a fallen tree close to the first river bridge up the Seaton Countryside Park was causing the river undermine the bank and alter its course.

Regarding the River Seaton at Hessenford, the Clerk was asked to contact St. Austell Brewery in order to request that the river adjacent to the Copley Arms, Hessenford, be dredged and debris be removed to increase water flow under the road bridge. The Clerk was also requested to chase up a report on the River Seaton from the Environment Agency.

13.2.3. Sewage Outflows at Seaton (Email from Cllr. Scott Parry 7 th January 2014) The Chair stated that, leaking sewage was reported by Cllr. S. J. Parry and himself to S.W. Water on 27 th December 2013. The Chair had written a strong letter of complaint to the Chief Executive of S.W. Water on 6 th January 2014, concerning the lack of attendance and warning signage at Seaton. The Clerk was asked to write to Mr. David Owens, Head of Environmental Services, Cornwall Council on this matter.

13.3. Cornwall Community Flood Forum Cllr. Ms. H. M. Brockbank stated that there was no new information to report.

13.3.1. Request for the provision of sandbags – Hessenford Residents Association (Dug Parry, Chairman of Hessenford Residents Association - Letter dated 18 th October 2013) This item had been deferred from the last meeting. The Chair proposed a time extension of the meeting until 21.40 hrs ; this was seconded by the Vice-Chair and agreed unanimously by the Meeting.

13.3.2. Hessenford sewage disposal (Email from Cllr. Scott Parry 7 th January 2014) Cllr. S. J. Parry has requested that this item be placed on the agenda in order to discuss whether the Parish Council could provide any support to the residents of Hessenford regarding this matter. Cllr. D. T. Parry (as Chair of the Hessenford Residents Association) had informed members by e-mail that there was an ongoing dispute between the Hessenford Residents Association, the Environment Agency and South West Water, regarding the sewerage disposal into the River Seaton. No resolution had yet been reached after six months of negotiation. After discussion the Clerk was requested to write to S.W. Water and the E.A. on this matter.

13.4. Neighbourhood Plan: It was decided to consider this item at the next meeting.

13.5. Affordable Housing: There was no new information to report.

13.6. Sale of Graveyard Extension Strip Land at Hessenford – Update The Clerk informed members that the solicitor acting for the Parish Council had written to the buyers solicitor, setting out the recently agreed terms of sale including the covenant and was waiting on a response to this.

13.7. Possible transfer of Downderry Memorial Gardens and other Cornwall Council assets to Deviock Parish Council. The Chair informed members that he had had a meeting with Mr. Scott Sharples (Cornwall Council Devolution Officer). Discussion had taken place regarding the transfer of the Downderry Memorial Gardens to Deviock Parish Council. Other pieces of land close to these gardens were also owned by Cornwall Council and could also be subject to possible asset transfer being:- 1) The coastal slope adjacent to the Memorial Garden, Downderry 2) The Downderry Beach Foreshore (boat hitching rail) 3) The toe of the slipway onto Downderry Beach 4) Broads Yard car park, Downderry

14. REPORT BY CORNWALL COUNCILLOR :- The Chair (in his capacity as Cornwall Councillor) stated that Cornwall Council had had to deal with many issues relating to the recent storms. In the forthcoming vote to take place at Cornwall Council regarding the proposed recommended new housing development numbers for Cornwall, C. Cllr. Candy would be voting to adopt the higher figure of 47,250 new homes.

15.6. MATTERS RAISED BY MEMBERS FOR POSSIBLE INCLUSION ON THE NEXT AGENDA: 15.6.1. Cllr. Ms. H. M. Brockbank requested two items being Bus Shelters and beach dog waste bin for Downderry 15.6.2. Cllr. Mrs. M. C. Williams requested that play equipment for children at Seaton Countryside Park be considered. 15.6.3. Cllr. R. J. Daniel requested that the Council discuss the statutory duties of the Parish Clerk and Parish Councillors.
