1. Standard Search Criteria – Included with many product types

Effective Date ❖ Current Effective Date from the County Register of Deeds or Recorder’s Office

Deeds/Conveyance Documents ❖ Chain-of- searched back to a “Good” or other acceptable conveyance o Examples of acceptable conveyances may include Deed, Special Warranty Deed, or any deed found recorded prior to the point in time established by the “Marketable Record Title Act” (40 Years in Michigan, Ohio and Illinois, 50 Years in Indiana)

Mortgages/Deeds of Trust ❖ Open Mortgages found recorded against subject property within the search period, including referenced documents such as Assignments, Modifications, Subordination Agreements and Partial Releases

Judgments/Involuntary

❖ 10 year (including variations) "General Name Index" search is conducted against the purchaser (if required), name(s) provided by the client and all parties within the chain-of-title in the most recent 10 years. Search does not include grantor(s) on stopping deed, if stopping point is within 10 years. A list of names searched will be provided with each report. ❖ 20 year name search conducted on the seller and purchaser for federal non-tax liens and federal judgments.

Easements/Restrictions ❖ /Restrictions found recorded within the search period that may affect the subject parcel

Affidavits ❖ Any affidavits found recorded that may affect parties in title or subject property (could include Affidavits of Affixture for Manufactured Homes, Affidavits to correct previously recorded documents or Affidavits to provide evidence of a lost document)

Miscellaneous Documents ❖ Any document found recorded during the required search period that may affect parties within the chain-of- title

Property Taxes ❖ Current property values ❖ Current tax amounts and status (paid, due or delinquent) ❖ Delinquent tax amounts owing with payoff dates ❖ Tax Exemptions (such as P.R.E./Homestead Percentage, Mortgage, Veteran’s Disability, Senior Citizen, Geothermal, Church or other Non-Profit Organizations) ❖ Special Assessments included in the tax bills or billed separate from the tax bills (NOTE: The following items are not included with tax information: Invoices, Citations, Special Charges and Miscellaneous Receivables that are billed separately from the tax bills ❖ School District Name (optional) ❖ Delinquent tax statement and assessed legal may be requested

*NOTE: Property searches for platted land will not be searched beyond the date of the recorded plat, unless otherwise indicated on the order (may include Master Deed for Condominiums), and may be subject to additional charges if we are required to search behind the plat

2. Residential and Commercial Searches

Current Owner Search ❖ Standard Search Criteria

Two-Owner or Three-Owner Search ❖ Standard Search Criteria ❖ Search will also include the specified number of previous owner deeds

30/40/50-Year or Other Specified Year Search ❖ Standard Search Criteria ❖ Search will be conducted back to obtain a deed recorded on or before the specified number of years

Legal and Vesting Deed Search ❖ Deed chain back to Vesting Deed (may be more than one deed) ❖ Mortgages, Judgments, Liens, Easements, Restrictions not searched

Back Searches ❖ Standard Search Criteria ❖ 3 Types Available to search back from the deed information provided by the client to either: o Next Warranty Deed o 40 Years o Easements/Restrictions to 1920 o Does not include tax information ❖ Does not include matching up mortgages found recorded within requested search period with discharges recorded outside of the requested search period

PMM (Purchase Money Mortgage) Search ❖ Standard Search Criteria ❖ Valid PMM is a Mortgage used to purchase property and usually recorded simultaneously with a deed: o Lender on PMM must be a institutional lender, such as a bank o Mortgage must be dated within 30 days of the signed date of the acceptable conveyance o Mortgage must be recorded within 90 days of the signed date of the acceptable conveyance ❖ PMM may be found on a current or previous owner ❖ If the PMM has been Discharged/Released, the recorded release information will be provided ❖ If no valid PMM is found, search continues back to the next full consideration warranty deed (MI - minimum of 15 yrs), with the maximum search requirement being the point in time established by the Marketable Record Title Act (30 yrs in Indiana)

Update – Bring Down – Date Down ❖ Applies to previous A.S.K. Search or previous Policy/Commitment provided by the client ❖ Search from provided Effective Date to the current Effective Date and report any new documents found recorded which affect the chain-of-title or Judgments/Liens ❖ Tax information will be updated and will include information as described under Standard Search Criteria ❖ Includes name search on anyone found with a newly recorded interest

Extended Update ❖ Same criteria as Update but will be used for searches greater than 13 months

Legal Description Search ❖ Client must specify where to search for legal description ❖ Search for and retrieve a copy of the specified legal description from last recorded deed or County Treasurer’s Office, depending on search request from client

Comprehensive Tax Search ❖ Same criteria as “Property Taxes” (see “Standard Search Criteria”)

❖ Note: Tax details provided will cover one tax parcel per search

Document Retrieval Options ❖ Search for and retrieve a copy of the client’s specified document(s): o Miscellaneous Document Retrieval ▪ Client must provide Liber and Page or Instrument Number of document(s) to be retrieved ▪ Includes up to five (5) instruments on one request per county o Document Search ▪ Client must provide enough information to retrieve the document ▪ Includes one (1) instrument per request per county ❖ Certified retrieval with the County Certification Seal is available ❖ Copy costs are not included with this product

Court Specific Document Retrieval ❖ Client must provide the Case number(s) and specific document name(s) to be retrieved ❖ Price includes up to five (5) instruments on one request for the same court per county Copy costs are not included with this product

Recorded Document Information ❖ Search for and return the requested recording information ❖ Copies are not provided with this product ❖ Recording information may include “Full Search Report” details, if requested

Title Policy Forward Search ❖ Search conducted from Effective Date on provided prior policy forward ❖ Deeds, Open Mortgages, Judgments and Liens, Easements and Restrictions

Easement & Restrictions Search ❖ Standard Search Criteria ❖ Chain-of-title covering 2 Owners, 40 Years or PMM and including Easements and Restrictions back to 1920 (NOTE: Pay close attention to Search Options, as the “acceptable stopping point” may vary by client)

Name Search ❖ Client must provide the full name of the party to be searched ❖ 10-year search for all Open/Unsatisfied Judgments and Involuntary Liens ❖ Search does not include property-specific liens, such as Mortgages or Construction Liens

Name Search Update ❖ Client must provide the full name of the party to be searched ❖ Client must provide date to “search from” for all Open/Unsatisfied Judgments and Involuntary Liens ❖ Search does not include property-specific liens, such as Mortgages or Construction Liens

Bankruptcy Search ❖ Client must provide full name or case numbers to be searched ❖ 10-year search will be conducted

Special Project ❖ This type is used when the search criteria does not fit within the parameters of another search offered

Clients will specify Search and Copy Options for each order placed – copies requested after a search is complete will be subject to additional charges

Chain Search Report – includes the following recording information for documents provided: ❖ Document Type ❖ Recorded Date of Document ❖ Liber and Page or Document Number

Property Ownership Report (POR) ❖ Includes typed legal description and ownership (limited by scope of search) ❖ Delivered in PDF and Word format so client can edit as necessary ❖ Listing of public records within the scope of the search. Easements, restrictions, right of ways, declarations, pipelines, agreements, or similar interests are NOT reported

TypeAssist Report ❖ Includes typed legal description and Requirement/Exception paragraphs as derived by a computer-generated routine from the A.S.K. title search completed. ❖ Delivered in PDF and Electronic Overlay file that may be imported into client’s production system ❖ Report is based on title search as specified by client. Client is responsible to examine report in conjunction with provided A.S.K. title search.

ExamAssist Report ❖ Includes typed legal description, ownership and Requirement/Exception paragraphs prepared by A.S.K. personnel. ❖ Delivered in PDF and Electronic Overlay file that may be imported into client’s production system ❖ Report is based on title search as specified by client. Client is responsible to examine report in conjunction with provided A.S.K. title search.
