Legislative Recap Over the course of the interim, I will be including a Legislative Recap Section in the Newsletter. This section reviews meaningful legislation that became law in the 2018 session. Senate Bill 814: Judicial Vacancy Sunshine Amendment This session, the General Assembly passed 6 constitutional amendments that will be on the ballot this November. In this newsletter, I will go over Senate Bill 814, which allows for a new merit selection process to fill judicial vacancies. This bill only deals with vacancies and does nothing to I hope everyone is having a good week. The General Assembly was recently called into a special change the public’s power to vote for their judges. session to address concerns with the captions of the constitutional amendments on this year’s voting ballets. There were worries that political bias would be injected into the process to mislead Current law allows the Governor to fill all vacancies, without any public input or oversight on voters. Planning for interim committees has already begun, and I imagine most of the committees the individuals’ qualifications. This amendment, if approved by the voters, would create the new will begin meeting in September. Nonpartisan Judicial Merit Commission, which would consist of 9 members appointed by the Governor, General Assembly, and Chief Justice of the Supreme Court, with no entity having a Groundbreaking Ag Sciences Center majority of appointments. The public would recommend vacancy replacements to the Commis- sion, who would then vet them based on their qualifications. Political affiliation would not be one of the criteria used to vet candidates. The Commission would then make recommendations to the General Assembly, who would in turn make at least 2 recommendations to the Governor out of the pool of candidates. The Governor would have 10 days to act before the General Assembly would fill the vacancy in his place. The bill also directs the General Assembly to establish similarly structured local nonpartisan commissions to fill Superior and District Court vacancies. Judges and Justices selected to fill a vacancy will serve until the election after the next election of members of the General Assembly. Moving to this merit selection process will ensure that the public has a voice in replacing their elected judges when vacancies occur and will remove political bias by having a nonpartisan com- mission be the initial entity to determine qualified individuals for the bench. • Ag Groups Playing No Favorites in Secretary Sweepstakes
December 2, 2020 Volume 16, Number 46 Ag groups playing no favorites in secretary sweepstakes Farm groups are pledging to work with whomever President-elect Joe Biden picks for agriculture secretary and are steering clear of announcing a favorite for the position. That’s not the case with several other interest groups. So far, most of the public speculation has centered on a pair of longtime Capitol Hill farm hands: Former North Dakota Sen. Heidi Heitkamp and Ohio Rep. Marcia Fudge. Debate over the two has turned into a proxy battle for the direction of the Department of Agriculture under the Biden administration. And farm policy insiders haven’t been able to squeeze much out of the Biden transition team. “They do a lot of listening; they don’t do much Rep. Marcia Fudge (left) and former Sen. Heidi sharing about what they are looking for,” one source Heitkamp (right) told Agri-Pulse of his conversations with the transition team. “As you would expect with any transition team, they hold their cards very, very close.” In recent weeks, ag lobbyists told Agri-Pulse of their generally good relationships with both Heitkamp and Fudge and said they were also generally happy with some of the other people said to be in the running – former Obama administration veterans like USDA Deputy Secretaries Kathleen Merrigan and Krysta Harden and Michael Scuse, who served as deputy in an acting role, former Ag Secretary Tom Vilsack's Chief of Staff and current California Ag Secretary Karen Ross, even Vilsack himself – and none went as far as to endorse a favorite.
