SITUATION AND DIRECTIONS

The land is situated adjoining, and between, Holmes Chapel Road and Byley Lane, Middlewich, approximately 1 mile east of Middlewich town centre and 2 miles west of M6 Junction 18. The land is shown on the attached location plan and the individual lots will be indicated by ‘For Sale’ boards.

DESCRIPTION The land, currently forming part of Kinderton Hall Farm, lies in a noted agricultural area, is shown within Grades II and III on the Agricultural Land Classification map and is widely regarded as among some of the best and most versatile land in the County. Lot 1 is currently in arable cropping. Lots 2, and 3 are currently in established pasture, Lot 3 being a river meadow adjoining the River Dane. The boundaries between the lots are mostly well maintained hedges.

The land is mostly level or slightly sloping and in good sized fields suitable for cultivation by modern agricultural machinery. The land lies in a Nitrate Vulnerable Zone.

BASIC PAYMENT SCHEME The land is registered on the Rural Land Register. Basic Payment Scheme entitlements have been established and activated by the vendor and a claim made against these entitlements in 2018, payment for which will be retained by the vendor. Purchasers will be required to maintain the cross compliances obligations up to 31st December 2018.

The entitlements are not included in the sale but may be purchased separately by negotiation.

VIEWING Interested parties may view the land on foot at any time of day following prior notification to the vendor’s agents, Wright Marshall Ltd, taking care not to damage unharvested crops. FISHING RIGHTS Fishing rights on the River Dane in Lot 3 are currently let to Middlewich Anglers on an annual but informal basis, future terms being negotiable by the new owners. Other sporting rights over the land are in hand, the benefit of which will pass to purchasers of the individual lots.

ENVIRONMENTAL SCHEME The land is not currently under an Environmental Scheme.

EASEMENTS, WAYLEAVES AND RIGHTS OF WAY There are no public footpaths crossing any of the lots. Members of Middlewich Anglers have pedestrian access only along the river bank in Lot 3. Lots 1, 2 and 3 are crossed by electricity lines on poles and pylons for which annual Wayleave payments are received, the future benefit of which will pass to purchasers of the respective lots.

The vendor or his successors in title, reserve the right to lay, by easement, and maintain any services in the future for the benefit of the vendor’s retained land making good any damage caused and paying compensation for any crop loss.

DEVELOPMENT UPLIFT CLAUSE All lots will be sold subject to a development uplift clause reserving unto the vendors 30% of any increase in value attributable to the grant, within 40 years, of planning permission for alternative use over and above its existing use at the time of the grant. MODE OF SALE The land is offered for sale in 3 Lots by Informal Tender.
