CONSENT OF THE PARTIES Counsel for the parties have consented to the filing of this brief. III. INTEREST OF THE AMICI CURIAE Amici represent songwriters, composers, musicians, and producers from the United States and other countries who create music in many different genres that is protected under U.S. copyright law. That music entertains and enriches the lives of countless people, in the United States and around the world. Amici and the professionals that they represent will therefore undoubtedly be affected by, and consequently have a significant interest in, the outcome of this critically important case. 1 IV. INTRODUCTION Amici are concerned about the potential adverse impact on their own creativity, on the creativity of future artists, and on the music industry in general, if the judgment in this case is allowed to stand. The verdict in this case threatens to punish songwriters for creating new music that is inspired by prior works. All music shares inspiration from prior musical works, especially within a particular musical genre. By eliminating any meaningful standard for drawing the line between permissible inspiration and unlawful copying, the judgment is certain to stifle creativity and impede the creative process. The law should provide clearer rules so that songwriters can know when the line is crossed, or at least where the line is. In typical music copyright cases – at least successful ones – the two works share the same (or at least similar) sequence of pitches, with the same (or at least similar) rhythms, set to the same chords. This case is unique, in that the two works at issue, Marvin Gaye’s “Got To Give It Up” and Appellants’ “Blurred Lines,” do not have similar melodies; the two songs do not even share a single melodic phrase. In fact, the two works do not have a sequence of even two chords played in the same order and for the same duration. They have entirely different song structures (meaning how and where the verse, chorus, etc. are placed in the song), and do not share any lyrics. 2 Quite clearly, the verdict in this case, if based upon the music at all, was based upon the jury’s perception that the overall “feel” or “groove” of the two works is similar, as songs of a particular genre often are. In essence, the Appellants have been found liable for the infringement of an idea, or a series of ideas, and not for the tangible expression of those ideas, which is antithetical to Section 102(b) of the Copyright Act.

PERFORMED IDENTITIES: HEAVY METAL MUSICIANS BETWEEN 1984 AND 1991 Bradley C. Klypchak A Dissertation Submitted to the Graduate College of Bowling Green State University in partial fulfillment of the requirements for the degree of DOCTOR OF PHILOSOPHY May 2007 Committee: Dr. Jeffrey A. Brown, Advisor Dr. John Makay Graduate Faculty Representative Dr. Ron E. Shields Dr. Don McQuarie © 2007 Bradley C. Klypchak All Rights Reserved iii ABSTRACT Dr. Jeffrey A. Brown, Advisor Between 1984 and 1991, heavy metal became one of the most publicly popular and commercially successful rock music subgenres. The focus of this dissertation is to explore the following research questions: How did the subculture of heavy metal music between 1984 and 1991 evolve and what meanings can be derived from this ongoing process? How did the contextual circumstances surrounding heavy metal music during this period impact the performative choices exhibited by artists, and from a position of retrospection, what lasting significance does this particular era of heavy metal merit today? A textual analysis of metal- related materials fostered the development of themes relating to the selective choices made and performances enacted by metal artists. These themes were then considered in terms of gender, sexuality, race, and age constructions as well as the ongoing negotiations of the metal artist within multiple performative realms. Occurring at the juncture of art and commerce, heavy metal music is a purposeful construction. Metal musicians made performative choices for serving particular aims, be it fame, wealth, or art. These same individuals worked within a greater system of influence. Metal bands were the contracted employees of record labels whose own corporate aims needed to be recognized.

  • Narrative Representations of Gender and Genre Through Lyric, Music, Image, and Staging in Carrie Underwood’S Blown Away Tour
COUNTRY CULTURE AND CROSSOVER: Narrative Representations of Gender and Genre Through Lyric, Music, Image, and Staging in Carrie Underwood’s Blown Away Tour Krisandra Ivings A Thesis Presented In Partial Fulfillment of the Requirement for the Degree Master of Arts in Music with Specialization in Women’s Studies University of Ottawa © Krisandra Ivings, Ottawa, Canada, 2016 Abstract This thesis examines the complex and multi-dimensional narratives presented in the work of mainstream female country artist Carrie Underwood, and how her blending of musical genres (pop, rock, and country) affects the narratives pertaining to gender and sexuality that are told through her musical texts. I interrogate the relationships between and among the domains of music, lyrics, images, and staging in Underwood’s live performances (Blown Away Tour: Live DVD) and related music videos in order to identify how these gendered narratives relate to genre, and more specifically, where these performances and videos adhere to, expand on, or break from country music tropes and traditions. Adopting an interlocking theoretical approach grounded in genre theory, gender theory, narrative theory in the context of popular music, and happiness theory, I examine how, as a female artist in the country music industry, Underwood uses genre-blending to construct complex gendered narratives in her musical texts. Ultimately, I find that in her Blown Away Tour: Live DVD, Underwood uses diverse narrative strategies, sometimes drawing on country tropes, to engage techniques and stylistic influences of several pop and rock styles, and in doing so explores the gender norms of those genres. ii Acknowledgements A great number of people have supported this thesis behind the scenes, whether financially, academically, or emotionally.

Cox 2018 DEDICATION For Charles and Bené S. Cox, whose unwavering faith in me has always shone through, even in the hardest times. The world is a better place because you both are in it. And for Laura Ingram Ellis: as much as I wanted this dissertation to spring forth from my head fully formed, like Athena from Zeus’s forehead, it did not happen that way. It happened one sentence at a time, some more excruciatingly wrought than others, and you were there for every single sentence. So these sentences I have written especially for you, Laura, with my deepest and most profound gratitude. ii ACKNOWLEDGMENTS Although it sometimes felt like a solitary process, I wrote this dissertation with the help and support of several different people, all of whom I deeply appreciate. First and foremost on this list is Prof. Charles Hiroshi Garrett, whom I learned so much from and whose patience and wisdom helped shape this project. I am very grateful to committee members Prof. James Borders, Prof. Walter Everett, Prof.

  • Rack Mount Edition by R.Stephen Dunnington
USER’s MANUAL for the Rack Mount Edition By R.Stephen Dunnington Here it is – the Minimoog Voyager Rack Mount Edition®. Moog Music has put more than 30 years of experience with analog synthesizer technology into the design of this instrument to bring you the fattest lead synthesizer since the minimoog was introduced in 1970. We’ve done away with the things that made 30-year- old analog synthesizers difficult – the tuning instability, the lack of patch memory, and the lack of compatibility with MIDI gear. We’ve kept the good parts – the rugged construction, the fun of changing a sound with knobs in real time, and the amazing, warm, fat, pleasing analog sound. The Voyager is our invitation to you to explore analog synthesis and express yourself. It doesn’t matter what style of music you play – the Voyager is here to help you tear it up in the studio, on stage, or in the privacy of your own home. Have fun! Acknowledgements – Thanks to Bob Moog for designing yet another fantastic music making machine! Thanks are also due to the Moog Music Team, Rudi Linhard of Lintronics for his amazing software, Brian Kehew, Nigel Hopkins, and all the great folks who contributed design ideas, and of course, you – the Moog Music customer.
