1 The Lord Provost welcomed to the House Mr Tom McInally, who had been elected as Deacon Convener of the Trades House of Glasgow for the ensuing year, and expressed the hope that he would enjoy the ancient association of this House with the Trades House during his term of office. Mr McInally replied in suitable terms.

Emergency motions dealt with.

2 The Director of Governance and Solicitor to the Council intimated that, in terms of Standing Order No 12 (3), emergency motions by Councillor Susan Aitken on the Channel 4 Hub and by Councillor Martin McElroy on striking workers, had been delivered to the Chief Executive prior to the meeting.

The Lord Provost having agreed that the motions were relevant, competent and urgent, the House agreed to deal with them at this meeting.

Correspondence - Letter from Scottish Government in response to Council motion on transient visitors tax noted.

7 With reference to the minutes of 13th September 2018 (Print 4, page 257) approving the terms of a motion in respect of a proposed transient visitors tax, there was submitted and noted a letter from the Scottish Government in response to that motion.

9 The Council agreed to suspend the provisions of

(1) Standing Order No 13 (5) in respect of the notice of motion at item 7(a) on the agenda only, to allow the time to deal with this motion to be increased to 60 minutes; and

Channel 4 Hub – Emergency motion approved.

10 With reference to paragraph 2 above, Councillor Aitken, seconded by Councillor McDonald, moved that

“Council warmly welcomes the news that Channel 4 will locate one of their 2 new creative hubs in Glasgow, agrees that they could not have made a better choice, and believes the depth and breadth of diverse talent that exists in the city was one of the key drivers for Channel 4 making this decision.

Council commends the outstanding work that was done by the ‘G4C4’ partnership bid team, chaired by Stuart Cosgrove and supported by Glasgow City Council and the thriving and dynamic independent broadcast sector in the city.

Council instructs the Leader and senior Council officers to continue to engage with Channel 4 and the wider TV, film and creative industries sectors in the city and to report back to elected members on the detailed arrangements for the establishment of the creative hub.”

The Council approved unanimously.

Striking workers - Emergency motion dealt with, after division.

13 With reference to paragraph 2 above, Councillor McElroy, seconded by Councillor Murray, moved that

“Council notes that the industrial action taken by Unison and the GMB on the 23rd and 24th of October were legitimate strikes called in accordance with legislation and with the support of the workforce concerned. Council further notes reports in the press concerning threats of legal action for refusing to cross picket-lines.

Council reaffirms its strongly-held belief that workers have the right to withdraw their labour and further reaffirms its belief, agreed unanimously by this Council in September 2015, that the ‘criminalisation of striking workers on the picket line are a politically motivated attack on the rights of working people and their fundamental right to withdraw their labour’.

Council therefore confirms that no worker will face legal action for standing in solidarity with striking workers.”

Councillor Aitken, seconded by Councillor Ferns, moved as an amendment that the second sentence be removed and the following added at the end:-

“Council notes that at no point was any threat made of legal action against striking staff.

Glasgow City Council, City Chambers, Glasgow G2 1DU Council further notes however that secondary action without a ballot has been unlawful in the UK since 1980, reinforced by further legislation of 1992, endorsed by the subsequent Labour government. Council notes that the Council’s chief legal officer has an obligation to inform trade unions of this legal position.

Council therefore confirms that no worker will face legal action for standing in solidarity with striking workers.”

Bailie Thornton, seconded by Councillor Meikle, moved as an amendment that

“Council notes that the industrial action taken by Unison and the GMB on the 23rd and 24th October were legitimate strikes called in accordance with legislation and with the support of the workforce concerned. Council further notes reports in the press concerning threats of legal action for refusing to cross picket-lines.

Council reaffirms its strongly-held belief that workers have the right to withdraw their labour. Council believes that industrial action should be undertaken within the law and matters to do with individual Council employees is a matter for the proper processes of this Council.

Council believes in principle that pursuing individual employees of the Council with legal action in regards to not crossing picket lines would likely be resource intensive and sour industrial relations at this difficult time.”

On a vote being taken electronically, 41 members voted for the amendment by Councillor Aitken, 7 for the amendment by Bailie Thornton and 31 for the motion.

The amendment by Councillor Aitken was accordingly declared to be carried.

Brexit – Motion approved, after division.

14 Councillor Aitken, seconded by Councillor McDonald, moved that

"Council welcomes the publication of the Fraser of Allander report 'Brexit and the Glasgow City Region' which was launched at the Brexit summit held in Glasgow City Chambers on 2nd October 2018 and notes with concern the very serious consequences, highlighted in the report, for the Glasgow economy of leaving the EU, Single Market and Customs Union.

Council notes that the people of Glasgow voted overwhelmingly to remain in the EU and believes that this remains the best option for the social and economic wellbeing of the city.

Council agrees that, short of this outcome, the 'least worst' option for Glasgow would be a plan in which the UK remains a member of the Single Market and Customs Union; and further agrees that a No Deal scenario would be catastrophic for ordinary people here and across the UK. Council endorses calls, including from the First Minister, for an extension of the transition period to avert a cliff-edge scenario when the UK leaves the EU.

Council also notes on-going discussion around a second 'People's Vote' and urges Glasgow's MPs to support this opportunity.

Council instructs the Leader to write to the Secretary of State for Exiting the European Union highlighting the evidence compiled in the Fraser of Allander report and setting out the Council's position as agreed above; and further instructs the Chief Executive to establish how the Council can use its role as a provider of information and advice to support EU citizens in Glasgow through the process of having to apply for settled status by June 2021, as well as Glaswegians with family living in the EU."

Councillor McAveety, seconded by Councillor Jane Morgan, moved as an amendment that

(1) the following be inserted after the first paragraph:-

“These preliminary assessments suggest that over 20,000 jobs in Glasgow City are supported by exports to the European Union, and over 40,000 in the wider city region.

Further, Council notes that there were over 57,000 EU nationals living in the Glasgow City Region in 2017. These citizens play a full role in the life of our city, are likely to be younger and more likely to be in work.

Council believes that Brexit poses a significant risk to Glasgow's economy; that the EU's environmental regulation and social protections are beneficial to Glasgow citizens; and the ending of freedom of movement is contrary to the values of this Council.”;

(2) in the 3rd paragraph, the words from “the UK remains a member of the Single Market” to “across the UK.” Be deleted and replaced with:-

“the following 6 tests are met. These are, does a Brexit deal:

(a) ensure a strong and collaborative future relationship with the EU;

(b) deliver the "exact same benefits" as we currently have as members of the Single Market and the Customs Union;

(c) ensure the fair management of migration in the interests of the economy and communities;

(d) defend rights and protections and prevent a race to the bottom;

(e) protect national security and our capacity to tackle cross-border crime; and

(f) does it deliver for all regions and nations of the UK?

Glasgow City Council, City Chambers, Glasgow G2 1DU Council considers that the potential impacts of Brexit have only become widely evident and understood post-referendum, while the subsequent handling of Brexit negotiations has not been in working people's best interests.”; and

(3) in the 3rd paragraph, the last sentence be deleted and replaced with:-

“Council therefore resolves to:

 support the campaign for a referendum on the terms of a Brexit deal where, in the event that these 6 tests are not met, remaining inside the European Union is an option on the ballot paper;

 call on the Government of the United Kingdom to bring forward such a vote in time for such a vote to be held before March 2019;

 endorse calls, including from the First Minister, for an extension of the transition period to avert a cliff-edge scenario when the UK leaves the EU;

 instruct the Leader of the Council to write to the Secretary of State for Exiting the European Union and the Prime Minister of the United Kingdom highlighting the evidence compiled in the Fraser of Allander report and setting out the Council's position as agreed above;

 instruct the Leader of the Council to write to representatives of COSLA, as the representative body of Local Authorities in Scotland, requesting that COSLA joins these calls and takes a collective position;

 instruct the Chief Executive to establish how the Council can use its role as a provider of information and advice to support EU citizens in Glasgow through the process of having to apply for settled status by June 2021, as well as Glaswegians with family living in the EU."

Councillor Curtis, seconded by Bailie Aibinu, moved as an amendment that

“Council notes the Fraser of Allander report.

Council also notes that Scotland voted to remain in the United Kingdom and that the United Kingdom voted as a whole to leave the European Union. Council believes that the results of referendums must be respected by all democrats and all elected representatives.

Council believes that both the UK and Scottish Governments should work together to secure a comprehensive free trade deal with the European Union so that the interests of businesses, consumers and citizens in Glasgow are fully protected as we leave the European Union.

Glasgow City Council, City Chambers, Glasgow G2 1DU Council encourages businesses throughout Glasgow to seize the new trading opportunities that Brexit will bring, as the United Kingdom pursues new and exciting free trade agreements with economies around the world.

Council considers that Brexit also presents a range of opportunities – not least for the to gain significant extra powers – but the SNP are only interested in stirring up division. Council therefore believes the biggest uncertainty facing Scotland now is not Brexit, but the ongoing threat of a second independence referendum and the SNP should take it off the table altogether.”

Councillor Molyneux, seconded by Bailie Wisely, moved as an amendment that paragraph 4 be deleted and replaced with:-

“Council supports the campaign for a second ‘People’s Vote’, where remaining in the European Union is an option on the ballot paper, and urges elected members at all levels of government in Scotland to support this opportunity.”

Councillor Aitken, with the approval of her seconder, accepted the amendment by Councillor Molyneux and part of the amendment by Councillor McAveety, with the adjusted motion now reading as follows:-

"Council welcomes the publication of the Fraser of Allander report 'Brexit and the Glasgow City Region' which was launched at the Brexit summit held in Glasgow City Chambers on 2nd October 2018 and notes with concern the very serious consequences, highlighted in the report, for the Glasgow economy of leaving the EU, Single Market and Customs Union.

 support the campaign for a referendum on the terms of a Brexit deal where remaining inside the European Union is an option on the ballot paper;

 call on the Government of the United Kingdom to bring forward such a vote in time for such a vote to be held before March 2019;

 endorse calls, including from the First Minister, for an extension of the transition period to avert a cliff-edge scenario when the UK leaves the EU;

Glasgow City Council, City Chambers, Glasgow G2 1DU  instruct the Leader of the Council to write to the Secretary of State for Exiting the European Union and the Prime Minister of the United Kingdom highlighting the evidence compiled in the Fraser of Allander report and setting out the Council's position as agreed above;

 instruct the Leader of the Council to write to representatives of COSLA, as the representative body of Local Authorities in Scotland, requesting that COSLA joins these calls and takes a collective position;

 instruct the Chief Executive to establish how the Council can use its role as a provider of information and advice to support EU citizens in Glasgow through the process of having to apply for settled status by June 2021, as well as Glaswegians with family living in the EU.

Council supports the campaign for a second ‘People’s Vote’, where remaining in the European Union is an option on the ballot paper, and urges elected members at all levels of government in Scotland to support this opportunity.

Council instructs the Leader to write to the Secretary of State for Exiting the European Union highlighting the evidence compiled in the Fraser of Allander report and setting out the Council's position as agreed above; and further instructs the Chief Executive to establish how the Council can use its role as a provider of information and advice to support EU citizens in Glasgow through the process of having to apply for settled status by June 2021, as well as Glaswegians with family living in the EU."

Thereafter a vote was taken electronically when 7 members voted for the amendment by Councillor Curtis and 72 for the motion as adjusted, which was accordingly declared to be carried.

Primary 1 stage testing – Motion approved, after division.

16 Councillor Blockley, seconded by Councillor Connelly, moved that

"Council believes that good quality pupil assessments are an essential tool to assist teachers to improve education standards and to ensure pupils receive a good quality education.

Council notes that the Scottish Parliament recently voted to stop testing at the Primary 1 stage. Council notes that this was after concerns raised by parents, teachers and education professionals.

Council agrees that although formal, standardised testing is essential in Primary 4 and Primary 7, it should not happen in Primary 1 where it cannot deliver the

Glasgow City Council, City Chambers, Glasgow G2 1DU same meaningful results. Council notes that Glasgow does not currently carry out Primary 1 tests.

Recognising the Scottish Parliament vote against this testing in Primary 1 and the subsequent will of MSPs who voted based on clear and concise information as to whether the new Primary 1 texts are in line with the play-based learning philosophy of the early years provision in the Curriculum for Excellence, Council therefore resolves that these tests should not be introduced at the Primary 1 stage in Glasgow.

Further, Council instructs the Chief Executive to write to the Scottish Government to inform them of this Council's opposition to Primary 1 testing and to express this Council's belief that these tests should be scrapped across Scotland in light of the parliamentary vote against them."

Councillor Cunningham, seconded by Councillor Bell, moved as an amendment that all after the first paragraph be deleted and the following inserted:-

“Council therefore affirms its commitment to a regime of age and curriculum appropriate assessment that serves to reinforce teachers’ professional judgement and allows education authorities to assess the progress of pupils throughout the broad general education.

Council recognises the educational debate on the changing nature of P1, as it moves away from a traditional system of formal learning to one based on play and a natural extension of nursery, and therefore welcomes the decision of the Education Secretary to commission a review of the P1 assessment system.

Council is clear that it is not the job of Councillors to dictate in detail what happens in the classroom and that our schools will continue to assess P1 pupils in line with guidance developed locally and nationally.

Council supports the view that teachers are best placed to make decisions about assessments being used to inform the next steps in children’s learning. Council further agrees that our schools will continue to assess pupils, including as appropriate at P1, in line with guidance developed locally and nationally.

Council looks forward to the outcome of the review of P1 assessments.”

Bailie Siddique, seconded by Councillor Curran, moved as an amendment that the last sentence in paragraph 3 be replaced by the following:-

“Council further notes the tremendous progress that has been made over the last decade in Glasgow’s schools, with the number of pupils leaving with at least one higher almost doubling, and that this Council is committed to delivering sustained improvement in future years. Council recognises that Glasgow has already pioneered significant interventions in early years, including through the development of the city’s ‘nurture’ programmes, and that these programmes have brought much success.

Glasgow City Council, City Chambers, Glasgow G2 1DU Council believes that the Cabinet Secretary for Education’s continued wilful defiance of the will of the Scottish Parliament is a further insult to the professional judgement of teachers, who often go above and beyond the call of duty in spite of increasing demands and pressures, yet feel isolated from the decision making process around education in Scotland.”

Councillor Wisely, seconded by Councillor Young, moved as an amendment that

(1) paragraph 1 be replaced with:-

“Council believes that good quality assessment is an essential tool assisting teachers to improve education standards.”;

(2) paragraph 2 be amended to read as follows:-

“Council notes that the Scottish Parliament recently voted to stop standardised testing at the Primary 1 stage. Council notes that this was after concerns raised by parents, teachers and education professionals.”; and

(3) paragraph 3 be deleted and paragraph 4 amended to read as follows:-

“Recognising the Scottish Parliament vote against this testing in Primary 1 and the subsequent will of MSPs who voted based on clear and concise information as to whether the new Primary 1 tests are in line with the play- based learning philosophy of the early years provision in the Curriculum for Excellence, Council therefore resolves that these Scottish National Standardised Assessments (SNSAs) should not be used at the Primary 1 stage in Glasgow.”

Councillor Blockley, with the approval of his seconder, accepted the amendments by Bailie Siddique and Councillor Wisely, resulting in the following adjusted motion:-

19 Councillor Wardrop, seconded by Councillor Molyneux, moved that

"Council notes the recent Intergovernmental Panel on Climate Change (IPCC) report which provides a stark account of the catastrophic environmental breakdown we can expect if global mean surface temperature increases by more than 1.5oC compared with pre-industrial levels.

Council notes the report concludes that we have only 12 years to prevent climate breakdown and therefore believes that there is an overwhelming need for radical, urgent and systemic action at local, national and international levels.

Council recognises that in Glasgow and across Scotland, there has been progress made to reduce emissions, but there are also areas such as transport, agriculture and renewable heat where urgent action is necessary.

Council therefore agrees to support the strongest possible commitments in the Climate Change (Emissions Reduction Targets) (Scotland) Bill, including a target for net-zero greenhouse gas emissions by 2040.

Council further agrees to inject fresh urgency and impetus into its own emissions reduction efforts, including supporting the review of its energy and carbon masterplan and ensuring full implementation of its energy policy across all services."

Councillor Richardson, seconded by Bailie Balfour, moved as an amendment that the last two paragraphs be replaced with:-

“Council therefore agrees to support the strongest possible evidence based commitments in the Climate Change (Emissions Reduction Targets) (Scotland) Bill, Council commends the commitment that the Bill will not allow for Carbon offsetting, ensuring that the proposed emissions reduction of 90% by 2050 is one of the most stringent global targets, and further commits to achieving net zero as soon as possible. Council does however acknowledge that the Scottish Government has sought further advice from the commission on climate change in

Glasgow City Council, City Chambers, Glasgow G2 1DU light of the IPCC report and expects the most stringent targets recommended by the commission to be enshrined in law.

Council further agrees to inject fresh urgency and impetus into its own emissions reduction efforts, including supporting the ongoing work on the development of the Local Heat and Energy Efficiency strategy and ensuring full implementation of the recommended actions across all services.”

On a vote being taken electronically, 35 members voted for the amendment and 32 for the motion. The amendment was accordingly declared to be carried.
