ORDINANCE NO.: 1375-19

AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA AMENDING TABLE 2.02.01 (ALLOWABLE USES IN ZONING DISTRICTS) OF THE LAND DEVELOPMENT CODE; REPEALING SECTION 2.02.07 (LAND USES ALLOWED WITHIN THE TRADITIONAL CITY CENTER) OF THE LAND DEVELOPMENT CODE; PROVIDING FOR REPEALER, SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

WHEREAS, the City Council has determined that it is in the City’s interest to update the Land Development Code from time to time to assure that the Land Development Code adequately meets the needs of the City; and

WHEREAS, the City Council wishes to amend the Land Development Code to create a clear, understandable, unified and effective document that better aids in the development and use of property in compliance with the goals, objectives and policies expressed in the City’s Comprehensive Plan.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida, as follows:

SECTION 1.

Land Development Code Table 2.02.01 (Allowable Uses in Zoning Districts) is hereby amended as reflected in Exhibit “A” attached hereto and by reference made a part hereof.

SECTION 2.

Land Development Code Section 2.02.07 (Land Uses Allowed Within the Traditional City Center) is hereby repealed in its entirety including the reference to Table 2.02.01.

SECTION 3.

Land Development Code Table 2.02.02 (Allowable Building Types in the Traditional City Center) is hereby repealed in its entirety. The contents of Table 2.02.02 have been included in the amended Table 2.02.01 adopted in Section 1, above.

SECTION 4. Repealer.

All provisions of the City of Zephyrhills Land Development Code including but not limited to Table 2.02.01 including footnotes thereto, which are in conflict herewith are hereby repealed in their entirety.

SECTION 5. Codification.

It is the intent of the City Council that the provisions of this Ordinance be included as revisions to existing Table 2.02.01 including footnotes thereto of the Land Development Code.

SECTION 6. Severability.

In the event any section, paragraph, subsection, sentence, clause, phrase or word of this Ordinance shall for any reason be held unconstitutional, invalid or ineffective, the same shall not repeal, nullify or in any way affect any other section, paragraph, subsection, sentence, clause or portion of this Ordinance, regardless of any other section, paragraph, subsection, sentence, clause or portion thereof. SECTION 7. Effective Date.

This Ordinance shall become effective upon passage on the second reading and signing by the Mayor.

The Ordinance 1375-19 was read and passed on the first reading in an open and regular meeting of the City Council of the City of Zephyrhills, Florida, on this 10th day of December, 2018.
