Our City

Longyearbyen might be one of the most fascinating cities to visit. Located at 78 degrees north it is officially the northern-most civilization in the world. Food has to be imported, being surrounded by an arctic desert. Houses are built on stilts and the infrastructure runs above ground due to the permafrost. Time feels relative during the summer, when the sun doesn’t move from the mid sky. A city you cannot leave without being required to bring a high calibre rifle and flair gun, because we are not on top of the food chain as there are more polar bears than humans. People where never meant to live here, but through determination and effort a city was built in the midst of the most vulnerable but yet extreme nature on the planet. This city, an oasis located in the middle of the largest island of Svalbard; Spitsbergen, has become a “Mekka” for adventure. Whether it be dogsledding before champagne tasting, fjord safari with high powered polarcircle boats before a sauna or the local pub after eating dinner over an open fire in an Norwegian Lavvu, we can insure contrasts in a city reflected by its inhabitants, colourful and steadfast.

General Terms and Conditions 2013

Where the travel agency/events agency sells to its customers under its own name travel and arrangements organised by us, the agency is the organiser of the travel under the Package Tours Act and has the ensuing obligations. The relationship between us and the agency is governed by the present terms and conditions and not by the provisions of the Package Tours Act. The conditions below regulate the parties' rights and obligations:

1. VALIDITY: These conditions apply to the extent that there is no other written agreement for group arrangements booked between Spitsbergen Travel AS, hereinafter called the Operator, and the customer, hereinafter called the Customer.

2. PRICING: Prices are calculated in accordance with the quotation. Arrivals after the start of the arrangement and departures before the end of the arrangement do not provide entitlement to a price reduction in the quotation unless otherwise previously agreed in writing. Any price increases due to changes to the agreement caused by the Customer are the sole responsibility of the Customer.

3. BOOKING: The contract in its entirety (hotels, meals, activities, transport, etc.) is binding for both parties once the Customer has signed the contract for the arrangement, and Spitsbergen Travel has reconfirmed in writing. When booking extra accommodation, meals, activities, transport etc. after the original contract has been signed, all extra bookings shall be confirmed in writing by both the Operator and the Customer, and these extra bookings shall be subject to the same conditions as in the original contract.

4. PAYMENT: Group arrangements must be prepaid in full before the group's arrival. On confirmation by Spitsbergen Travel, an invoice of the total price of the arrangement is invoiced to the Customer. After the due date, payments are subject to an interest charge of 1% per month and a reminder fee of NOK 50. NB! If the programme is changed by the Customer after arrival (for example, activities or meals cancelled in favour of a different option), the original reservations must be paid for in full in addition to any new elements in the programme.

5. GROUP MEMBERS: Information about any food allergies or special needs of individual group members, must be informed to Spitsbergen Travel at the latest 7 days upon arrival.

6. UNFORSEEN EVENTS Our activities and excursion information sheet is described with a time schedule. In the case of events outside of the Operator’s control (aviation strikes, delays, weather/road conditions, fire, missing deliveries, etc.) the Operator is not liable for compensation for additional costs and/or losses. Should any events affect the time schedule, the Operator will shorten or change the timing necessary to prevent any issues regarding the sailing time of the ship. Any affects this may have on the product will not be covered or refunded by the Operator.

7. TRANSPORTATION The Operator and its suppliers have valid and appropriate insurance cover. The vehicles used by the Operator and its suppliers follow safety standards in conjunction with local regulations, and comply with all local public transport laws. None of the vehicles used by the Operator and its suppliers have toilet facilities. None of the vehicles used by the Operator and its suppliers are modified for easy access regarding disability.

8. SPECIAL CONDITIONS: Due to the special Arctic weather conditions, the Operator reserves the right to amend the agreed programme during the arrangement. However, the Operator, in collaboration with the Customer, will make every effort to find suitable alternative solutions within the framework of the package price. If parts of the arrangement cannot be carried out and alternative activities are not satisfactory, the package price will be adjusted subject to agreement between the Operator and the Customer. The Operator is not financially liable for any extra costs incurred due to weather conditions.

9. LIABILITY FOR DAMAGE: The Customer is liable for damage caused to the accommodation premises and equipment, meeting rooms, restaurants etc. as a result of the negligent or intentional conduct of the group members. For snowmobile trips, special conditions apply that each individual member must accept and sign before the trip starts. The Operator is not liable for damage to property or personal injury affecting the Customer's group members and which are not due to circumstances the Operator should or could have avoided, or the group members' own subjective circumstances, including a lack of adherence to instructions or similar from the individual event organisers.

10. COMPLAINTS: If the Customer believes that there is a deficiency in the arrangement, this must be taken up with the Operator’s representative immediately. If the deficiency is not rectified and the Customer wishes to complain about the arrangement on returning home, a written statement of complaint must be submitted as soon as possible and no later than one month after the trip was completed. Since this is not a package tour, Pakkereisenemnda (the package tour complaints body) will not be able to consider any complaint. If the parties are unable to agree on how to resolve a dispute based on the contract for the arrangement, voluntary arbitration will be accepted in accordance with the provisions of the Dispute Act. Each of the parties then appoints an arbitrator no later than 3 weeks after the final rejection/acceptance of the claim/offer, and these two shall agree on an arbitration judge within the deadlines set by the parties.

11. CANCELLATION The Customer is obligated to inform the Operator on any changes regarding booked activities, food and beverage and excursions. All cancelation must be made in writing. Cancellation and reduction of any arrangement must be made no later than 24 hours before arrival and is free of charge. The Customer will be charged with the cost price of any booked arrangement by cancelling or reducing guests within 24 hours before arrival.
