This report covers the Calendar years of 1933 and 1934. The regular work of the State Water Commissioner's Of-· fice covered by this report comprises the investigation of conditions surrounding all applications filed in the office for permit to construct reservoirs, store, and appropriate for bene­ ficial use, public waters of the state; the granting of permits under approved applications where non-conflict hlis been ascer­ tained; the issuing of certificates of water right to all per­ mittees who have completed their appropriations in accordance with the terms of their permits; the keeping of complete records of all applications filed, permits granted, certificates of water right issued, rejections, cancellations, and files in all cases containing all correspondence, data and other matter relative to same; the determination of relative rights to the use of waters of the streams of the State (Secs. 3293-3303, R. C. A., 1928), where the water rights were acquired prior to the enactment of the State Water Code in 1919 and have not been adjudicated and decreed by the courts, etc. The work of the office was carried on for the first half of the year 1933 by the regular office force of the pre­ vious biennium, but on July 1, 1933, the new appropriation made by the Eleventh "State Legislature went into erfect. The amount was so small that it provided for no salaries for clerical, engineering, nor stenographic assistants for this of­ fice. By augmenting the salary from his personal funds the State Water Commissioner was able to retain the secretary, and by paying the entire salary from his personal funds was able to secure a stenographic and clerical assistant, but was unab~e tO I provide an engineer for the department. The volume of work in this department has been steadily increasing during this biennium, but, due to lack of funds and necessary engineering, clerical, and stenographic assistants in the office, all determinations of water rights and engineer­ ing investigations have been practically at a standstill since July 1, 1933. -5- Not only is the office in daily receipt of many written requests for d&ta and information concerning status of water rights, but a constant stream of callers bring their water problems to this department. These matters must be given consideration. During this biennium, 219 applications were filed, 83 per­ mits granted, and 93 certificates of water rights issued. On this date there are 344 applications pending investigation and action, and 124 permits in effect. This report also embraces the work done during the first half of the year 1933 under cooperative agreement with the United States Geological Survey for Colorado Riv-er and Other Stream Gauging, appropriation for which has been made by successive legislative assemblies since 1922, but this work was discontinued June 30, 1933, owing to the failure of the Eleventh State Legislature to make appropriation for the pres­ sent biennium. It is of vital importance to this arid State of Arizona that her legislative body give serious and conscientious con­ sideration to the means necessary to carry out equitably and adequately her administration of the public water within her boundaries over "\vhich she has full jurisdiction.

APPROPRIATIONS The following tables show the certificates of water rights issued, permits granted, applications for permit to construct reservoirs and diversion works and applications for permit to store and appropriate for beneficial use public waters of the State, filed in the Office of the State Water Commissioner during the calendar years of 1933 and 1934; also permits granted prior to January 1, 1933, under the terms of which various projects are in the course of construction; and ap-· plications filed prior to January 1, 1933, which have not been investigated and acted upon for the reason that funds have not been available to provide necessary engineering, stenogra­ phic and clerical assistants for this office:

AUTHORITY

Work during the period January 1 to June 30, 1933 was carried on through cooperative agreement with the State Water Commissioner as authorized in Chapter 113, Section 1, Subdi­ vision 27, Session Laws of Arizona, 1931.

This cooperation was discontinued June 30, 1933, owing to failure of the State of Arizona to make further appropria­ tions.

This appropriation is made subject to the condition that, at least, a like amount be allotted to this state by the Federal Government and expended concurrently with this appropriation. -32- COOPERATIVE AGREEMENT FOR INVESTIGATION OF SURFACE WATER RESOURCES

THIS AGREEMENT is entered into as of the first day of July, 1932 by the UNITED STATES GEOLOGICAL SURVEY, party of the first part, and the State of Arizona party of the second part. 1. The parties agree, subject to the availability of appro­ priations, that, in accordance with their respective authorities, there shall be maintained in cooperation an investigation of the surface water resources of the State of Arizona during the period from July 1, 1932 to June 30, 1933 .. 2. The following amounts shall be contributed for the purposes of this investigtaion to cover all of the costs of the necessary field and office work, including the administrative, technical, and clerical work directly related to this investigation incurred in the offices of the cooperating parties, but exclud­ ing any general administrative or accounting work in the office of either party. and excluding the cost of publication, by either party, of the results of the investigations: (a) $22,500.00 by the party of the first part during the period from July 1, 1932 to June 30, 1933. (b) $22,500.00 by the party of the second part during the period from July 1, 1932 to June 30, 1933. 3. Expenses incurred in the performance of this investi­ gation may be paid by either party in conformity with the laws and regulations respectively governing each party, pro­ vided that so far as may be mutually agreeable all expenses shall be paid in the first instance by the party of the first part with appropriate reimbursement thereafter by the party of the second part. Each party to the cooperation shall furnish to the other party such statements or reports of expenditures as may be needed to satisfy fiscal requirements. 4. The field and office work pertaining to this investi­ gation shall be under the direction of an authorized represen­ tative of the party of the first part, who shall supervise the work and c;ertify to the expenditures of the funds contributed by both parties. 5.. The areas to be investigated and the scope of the investigation shall be determined by mutual agreement between the parties hereto or their authorized representatives and the methods of investigation shall be those usually followed by the party of the first part subject to modification by mutual agreement. -33- 6. During the progress of the work all operations and records of either party shall be open to the inspection of the other party, and if the work is not being carried on in a mutually satisfactory manner, either party may terminate this agreement on formal notice.

7. The original records shall be deposited with the party of the first part and shall become part of the official records. Official copies of all records of the investigation shall be fur­ nished on request to the party of the second part.

8. The results of the work contemplated in this agree­ ment shall be published in the regular official reports of the party of the first part. The party of the second part reserves the right to publish all results of said investigations. it being understood that at least sixty days notice shall be given the party of the first part for the proper assembling l':.nd compiling of any data desired for reports by the party of the second part. Publications by either shall contain a statement of the coopera·· tive relation between the parties hereto.

GEOLOGICAL SURVEY ORGANIZATION

For the purpose of stream-flow investigations, the State of Arizona is designated a district under the Water Resources Branch ,of the Geological Survey. The work in the State is carried on by the District Engineer under the direction of N. C. Grover, Chief Hydraulic Engineer of the Whter Re­ sources Branch, and of C. G. Paulson, Chief of the Division of Surface Waters.

STREAM-FLOW INVESTIGATIONS IN ARIZONA In Cooperation with the State of Arizona 1933 and 1934 On January L 1933, there were 44 regular gaging sta­ tions being maintained by the Geological Survey in Arizona. Although State cooperation ceased on June 30, 1933, it be­ came possible to continue all of these stations through the remainder of the water year ending September 30, 1933, and close up the cooperative work in an orderly manner. The work on Colorado River which had been principally supported by the Federal Government for several years past was continued, and was considerably increased in 1934. A few of the other stations which were of particular interest to the Federal Government and to some other interested par­ ties were also continued. Several new gaging stations were constructed in 1934 and maintained in cooperation with inter­ ested parties. Most of the gaging stations formerly constructed and op­ erated in cooperation with the State of Arizona are now stand­ ing idle, and stood idle during the critical drought period in 1934. Thf(Y are still available to be put back to work pro­ ducing the records for which they were intended, but they cannot go back and produce records for that critical period.

Future Stre'lm-Flow Investigations in Arizona The need for such investigations is continually increasing. The work which will be done will depend on recognition of such need, and financial provision for it. -35- The value of stream-flow records depends on both length and continuity of the records. The discontinuance of many of the records in progress in 1933 has created a loss severely disproportionate to the temparary saving, even if the records are resumed at an early date. A minimum of loss and handi­ cap to future development of Arizona's water resources will be had if these records are resumed at the earliest practicable date.
