Councilmember(s) presented the following Resolution and moved its adoption:

RESOLUTION DESIGNATING DEPOSITORIES

WHEREAS , during each year certain funds are collected by the City of Gloversville through its various taxing methods, and, in addition, the city receives certain other revenues, all of which money comes into the possession of the Commissioner of Finance of the City, and

WHEREAS , it is necessary that such funds be deposited in banking institutions.

NOW THEREFORE , be it hereby

RESOLVED , that the following banks be designated as depositories of the City of Gloversville for the year 2015

AND BE IT FURTHER RESOLVED , that the Commissioner of Finance is hereby authorized and directed to invest funds as provided in the Local Finance Law of the State of New York.

RESOLUTION DESIGNATING OFFICIAL NEWSPAPER

WHEREAS , Section C-27 of the Charter of the City authorizes and permits the Common Council to designate an official newspaper for the City of Gloversville, and

WHEREAS , the newspaper, The Leader Herald, has a general circulation in said City.

NOW THEREFORE , be it hereby

RESOLVED , that pursuant to Section C-27 of the Charter of the City of Gloversville, the Common Council hereby elects to continue the designation of the Leader Herald as the official newspaper for the City of Gloversville for the year 2015.

RESOLUTION DESIGNATING LEGAL LINE RATE FOR 2015

NOW THEREFORE , be it hereby

RESOLVED , that the legal rate per line at which all notices, ordinances, by-laws, rules and Regulations and other proceedings of the Common Council, Board of Water Commissioners, and other departments and officials of the City of Gloversville, that shall be published in the official newspaper of the City, is hereby fixed at the rate established by Section 70-a of the Public Officers Law of the State of New York which is based on circulation at the rate of 32.5 cents per line plus .09 cents for the first insertion of the Legal Notice.

Councilmember presented the following Resolution and moved its adoption:

RESOLUTION TO APPROVE THE 2015 RULES

OF THE COMMON COUNCIL OF THE CITY OF GLOVERSVILLE

WHEREAS , §C-26 B of the Charter of the City of Gloversville states “ The Common Council shall determine its own rules and order of business, and the minutes of its proceeding shall be a public record”, and

WHEREAS , the Common Council, in conducting its affairs and proceedings, should follow a certain set of rules which experience has shown be best adapted for that purpose, and

WHEREAS , these rules should ensure orderly meetings, expedite City business and facilitate equal participation of all policy-making City officials in the work of the Common Council, and

WHEREAS , these rules shall be adopted at the annual Organizational Meeting and may be suspended or amended in any respect or manner at any time by the majority of the authorized number of Common Council members, and

WHEREAS , a copy of the proposed 2015 Common Council Rules being attached hereto and incorporated herein by reference.

NOW, THEREFORE , be it hereby

RESOLVED , that the Common Council hereby approves the above-referenced 2015 Rules of the Common Council.

Councilmember(s) presented the following Resolution and moved its adoption:

RESOLUTION TO APPOINT A DEPUTY COMMISSIONER OF FINANCE

WHEREAS , the Charter of the City of Gloversville states that the City shall have a Deputy Commissioner of Finance appointed annually by the Mayor.

NOW, THEREFORE , be it hereby

RESOLVED , with Common Council approval, the appointment of Tammie Weiterschan to the position of Deputy Commissioner of Finance effective: January 1, 2015 - December 31, 2015 at an annual salary of $50,000.

BE IT FURTHER RESOLVED , that the Deputy Commissioner of Finance will be represented under Resolution 81-2011: Personnel Policy for Non-Represented Employees of the City of Gloversville with the exceptions that were passed in Resolution 97-2014 at time of hire.

RESOLUTION TO APPOINT A DEPARTMENT OF PUBLIC WORKS DIRECTOR

WHEREAS , the Charter of the City of Gloversville states that the City shall have a Department of Public Works Director appointed annually by the Mayor.

NOW, THEREFORE , be it hereby

RESOLVED , with Common Council approval, the appointment of Kevin Jones, C.E.T. to the position of Department of Public Works Director effective: January 1, 2015 - December 31, 2015 at an annual salary of $67,650.00.

BE IT FURTHER RESOLVED , that the Department of Public Works Director is represented under Resolution 81-2011: Personnel Policy for Non-Represented Employees of the City of Gloversville with one exception. Two weeks’ vacation will provided in the year 2015.

RESOLUTION TO COVER CERTAIN ACTIVITIES AND EVENTS UNDER

THE CITY OF GLOVERSVILLE INSURANCE LIABILITY

WHEREAS, the Common Council of the City of Gloversville recognizes the importance of certain long time activities and events and their benefit to the quality of life to the residents of the City of Gloversville, and

WHEREAS, the Common Council of the City of Gloversville desires that certain long time activities and events continue with support from the Common Council of the City of Gloversville, and

WHEREAS, the Common Council of the City of Gloversville hereby identifies these long time activities and events as: - The Gloversville Civic Band, July – September 2015 - Railfest, August 2015

NOW, THEREFORE, be it hereby

RESOLVED, that in lieu of monetary support of these long time activities and events, the Common Council of the City of Gloversville hereby acknowledges its support of the above named activities and events by allowing said activities and events to be covered under the City’s liability insurance policy for the year of 2015.

Resolution

Councilmember presented the following Resolution and moved its adoption:

RESOLUTION AUTHORIZING THE CITY OF GLOVERSVILLE TO CONTINUE UTILIZING

GOLDBERGER AND KREMER ATTORNEYS & COUNSELORS AT LAW

FOR LABOR RELATED SERVICES

WHEREAS , the current Agreement between the City of Gloversville and Goldberger and Kremer Attorneys and Counselors at Law to provide labor relation and employment law services has expired on December 31, 2014, and

WHEREAS , the law firm is currently paid a base retainer of $2,595 per month for collective bargaining services with all City bargaining units. The firm is also paid $190 per hour for services outside the scope of the base retainer, such as mediation, interest arbitration, contract and disciplinary arbitration and litigation. Below is the proposal to continue to provide labor relation legal services to the City for the next three (3) year period:

January 1, 2015- December 31, 2015: Base monthly retainer of $2,650 and an hourly rate of $200.

January 1, 2016 – December 31, 2016: Base monthly retainer of $2,675 and an hourly rate of $205.

January 1, 2017 – December 31, 2017: Base monthly retainer of $2,700 and an hourly rate of $210.

NOW, THEREFORE , be it hereby

RESOLVED , that the City of Gloversville continue to have Goldberger and Kremer Attorneys and Counselors at Law to provide labor relation legal services for the next three (3) years at the above rates.

Councilmember(s) Anadio, Simonds, Wentworth presented the following Resolution and moved its adoption:

RESOLUTION TO ACCEPT A DRAFT 2015 COMPREHENSIVE PLAN DOCUMENT

WHEREAS, the City of Gloversville has received a Draft 2015 Comprehensive Plan Document and Full Environmental Assessment Form for this action from its consultant, Greenman-Pedersen, Inc.

NOW, THEREFORE , be it hereby

RESOLVED, that the City of Gloversville hereby accepts the Draft 2015 Comprehensive Plan and accompanying Full Environmental Assessment Form, and be it further

RESOLVED, that the City of Gloversville proposes that the City of Gloversville Common Council act as the lead agency for the coordinated review of the Full Environmental Assessment Action, and be it further

RESOLVED, that a Public Hearing for the review of the Draft 2015 Comprehensive Plan is hereby scheduled to occur on January 27, 2015 at 6:00 pm in the Common Council Chambers of the City of Gloversville.
