Mathew Muratore (R) Summary Amends GL 175 (Insurance) to prohibit an insurer who utilizes an applicant’s driving history as a rating or underwriting factor for private passenger motor vehicle insurance in the Commonwealth from providing a quote to an applicant, or accept a down payment for a policy, without first verifying said applicant’s Massachusetts driving history through the use of a reliable third party database. Compromise language: An insurer that utilizes an applicant’s Massachusetts driving history as a rating or underwriting factor for private passenger motor vehicle insurance in the Commonwealth, a licensed insurance producer, or third party representative shall verify the applicant’s Massachusetts driving history through the use of the Massachusetts Registry of Motor Vehicles database or a reliable third party database prior to processing payment or issuing a policy, unless said driving history is unavailable at the time of initial inquiry due to a temporary website outage, service interruption, or other circumstance beyond the control of the insurer, producer, or third party representative. This Section shall apply to all policies issued on or after January 1, 2020. When providing a private passenger automobile insurance quote, an insurer, licensed insurance producer or third party representative shall provide a disclosure regarding the verification of an applicant’s Massachusetts driving history. Mathew Muratore (R) Summary Adds a new Section 4F to GL Chapter 175, which requires insurers who use driving records to determine motor vehicle insurance premiums from providing quotes or accepting down payments without first verifying an applicant's driving record through the use of a third-party database. Michael O. Moore (D) Summary Amends provisions of GL 175:193R relative to group marketing plans for automobile and homeowner insurance. As written the statute provides, inter alia, that an insurer may not cancel the insurance of an individual member of a group except for nonpayment of premium, fraud or unless the insurance for the entire group is canceled, but that the insurer may cancel for loss of registration or operator’s license; as amended, the statute would also provide that an insurer may not cancel the motor vehicle insurance of an individual member based upon the underwriting standards for non-group members.
