CASTRO BOROUGH COMMISSIONER FOR MANHATTAN PARKS Request for Bids 02/04 Columbus Circle Newsstand Page 1 of 10 REQUEST FOR BIDS (RFB) For the operation and maintenance of a newsstand at Central Park West and Columbus Circle, Manhattan, for the sale of newspapers, magazines, candy, snacks, soft drinks, lottery tickets, cigarettes, film, batteries and other items if approved by City of New York/ Parks and Recreation. THE TERM Parks is offering a term of two (2) years for this concession with an option for a third year to be offered at the discretion of Parks. No longer term will be considered. This concession will be operated pursuant to a license issued by Parks; no leasehold or other proprietary right is offered. This concession will become available April 7, 2004. REQUEST FOR BIDS TIMETABLE The following schedule has been established for the Request for Bids for the operation and maintenance of a newsstand located at Central Park West and Columbus Circle, Manhattan: RFB Release Date: Thursday, February 12, 2004 On-Site Inspection Meeting: Tuesday, March 2, 2004 at 11AM Bids Due: Thursday, March 25, 2004 at 3:00PM PLEASE NOTE: THIS SCHEDULE IS SUBJECT TO CHANGE AS CIRCUMSTANCES WARRANT. If you have a physical disability and cannot deliver your bid to the Arsenal, please contact the Project Manager at least 48 hours prior to the deadline and special arrangements will be made for you. Request for Bids 02/04 Columbus Circle Newsstand Page 2 of 10 PROJECT BACKGROUND The newsstand is located at the southwest corner of Central Park at the intersection of Central Park West and Columbus Circle, Manhattan. The location is next to an entrance to the Columbus Circle/West 59 Street subway station, which is a major transfer point for the A, B, C, D, 1, and 9 trains. Numerous bus lines also interchange at Columbus Circle. This intersection is not only a transit hub and point of access to Central Park, but the Trump International Hotel & Tower and the new Time Warner Center attract scores of visitors to the area. FINANCIAL HISTORY The following chart lists the guaranteed minimum annual fees to the City by the previous operator: Year Minimum Annual Fees 2001 $110,000 2002 $115,000 2003 $121,000 2004 $127,000 ON-SITE INSPECTION MEETING There will be an on-site inspection meeting on Tuesday, March 2, 2004 at 11AM. We will meet in front of the newsstand on the southwest corner of Central Park, near the subway entrance at the intersection of Central Park West and Columbus Circle, Manhattan. If you are considering responding to this RFB, please make every effort to attend this meeting. In the event of inclement weather on this date, please contact the Revenue Division at (212) 360-1397 to determine whether Parks has postponed the on- site inspection meeting. CAPITAL INVESTMENT The required capital improvements will include, but are not limited to, the following: • Strip and apply three coats of paint to the exterior of the newsstand • Repair and maintain all exterior lighting • Replace OR repair and power wash roll down gate The successful proposer will also be required to make all necessary repairs to the licensed premises during the term of the license including, but not limited to roof repairs, window repairs, counter repairs and graffiti removal. Request for Bids 02/04 Columbus Circle Newsstand Page 3 of 10 REQUIREMENTS DURING THE TERM OF LICENSE 1. The successful bidder will be responsible for obtaining any and all necessary approvals, permits, and licenses for the construction and lawful operation of this concession. 2. The successful bidder will be required to present picture identification (such as a driver’s license or a passport) and proof of address (such as a utility bill) in order to sign your permit. In addition, you will be required to provide us with at least two telephone numbers (see bid form, at end of document) at which we will be able to reach you. If there are any changes in your address or phone number/s, you must inform the Parks Revenue office immediately. 3. The concessionaire will be responsible for all utility costs connected with the operation of this concession. This may include but is not limited to installing necessary utilities, service lines, conduits, water meters, pipes, etc. The concessionaire will be required to remove any unsuitable existing materials as required. Parks & Recreation makes no representations that there are adequate utilities in place at the site. 4. The concessionaire will supply all equipment necessary for the operation of this concession. All fixed equipment becomes the property of Parks upon installation, at Parks' option. Should Parks choose not to exercise this option, it will be the responsibility of the concessionaire to remove fixed equipment and return the licensed premises to Parks in a condition as good as or better than that at the commencement of the license term. 5. The concessionaire will not be permitted to cut down or remove any trees on the permitted premises without prior written approval from Parks. Any attachments to the trees, such as lights, will not be permitted. 6. The concessionaire will remove all rubbish generated by this concession. The concessionaire will be responsible for cleaning the licensed premises and the area within 50 feet of the licensed premises. The concessionaire will provide garbage cans approved by Parks and have these cans emptied on a daily basis by a private carter. 7. The concessionaire must comply with all City, state, and federal regulations regarding recycling. Bidders should submit a detailed plan for removal of rubbish generated by this concession. 8. The concessionaire will be responsible for regular and routine maintenance of the facility and its contents which shall include, but is not limited to, fixing or replacing any racks, stands and equipment as well as the newsstand’s structure. 9. The concessionaire will be required to make all necessary repairs to the licensed premises during the term of the license. 10. The permitted vending areas are inside the newsstand structures. No additional space on the sidewalk is to be used for vending, storage, advertising or any other purpose. Racks must be neat and sturdy. 11. The concessionaire is responsible for the appearance of the stand. The newsstand must be painted a color acceptable to Parks and it must be repainted as needed. No signs may be posted on the newsstand except for those signs approved in writing by Parks. The operator is responsible for removing all unauthorized signs, posters, flyers, stickers and graffiti within five (5) hours after appearing on the stand. Request for Bids 02/04 Columbus Circle Newsstand Page 4 of 10 12. No items may be placed or stored outside of the kiosk. The newsstand operator agrees that Parks’ Inspectors and/or Park Enforcement Officers may confiscate any and all material found to be outside of the permitted vending structure. If material is stored or displayed outside of the permitted area, all expenses associated with enforcement of that provision will be reimbursed by the operator to the City. 13. The operator of the newsstand may sell newspapers, magazines, candy, snacks, soft drinks, ice cream, lottery tickets, cigarettes, film, batteries, and related items. The operator of the newsstand may not sell coffee, tea, hot chocolate, other related beverages, or audio and videocassettes. Bidders should submit lists of all items they propose to sell, including an approximate price list, as well as their proposed hours of operation. All prices, fees, and increases for any and all proposed services offered at the concession must be approved by Parks & Recreation. 14. The concessionaire must comply with all City, state and federal rules and regulations, including those pertaining to the public display of adult material. 15. The advertisement of cigarettes, cigars, or any other tobacco products is strictly prohibited upon the exterior of the newsstand. It is the concessionaire's responsibility to adhere to and enforce this policy. 16. Pursuant to Parks’ policy citywide, the concessionaire will not be permitted to sell any beverages in glass bottles. All beverages sold should be in non-glass, shatter-proof containers. Also, the use of polystyrene packaging or food containers will be prohibited in the operation of the concession. 17. The concessionaire must comply with all City, State and Federal laws relating to access for people with disabilities. 18. The concessionaire must cooperate with Parks during special events or other unanticipated eventualities. 19. The concessionaire will be responsible for maintaining security within the licensed premises and the area immediately surrounding the licensed premises. 20. The concessionaire will submit monthly reports of gross receipts, in a format approved by Parks, broken down into categories of income.
