Description: The Commission will consider amending Commission Regulation 18-01 to modify the harvest limit for fish in that portion of the Upper Reese River and tributaries from the wilderness boundary south of the Yomba Shoshone Tribe Reservation to its headwaters, and Stewart Creek from its confluence with the Reese River to its headwaters, in Nye County, to remove harvest limits on trout species.

Summary:

The Commission will consider Amendment #1 of the Fishing Seasons and Regulations for the Two Year Period March 1, 2018 through February 29, 2020. The Department is proposing an amendment to modify the harvest limit for fish in that portion of the Upper Reese River and tributaries from the Arc Dome wilderness boundary south of the Yomba Shoshone Tribe Reservation to its headwaters, and Stewart Creek from its confluence with the Reese River to its headwaters, in Nye County, to remove harvest limits on trout species.

Removal of harvest limits for trout in Upper Reese River and Stewart Creek:

Lahontan cutthroat trout (LCT) is native to many areas of Nevada including the Reese River watershed in Nye and Lander Counties. It is listed as a Threatened species under the Federal Endangered Species Act. LCT populations in many areas of its historic range, including Reese River and its tributaries, are limited or absent in part because of the introduction and presence of nonnative trout species including brook, brown and rainbow trout which have been stocked into those waters since the early 1900s. A key strategy for the recovery and eventual de-listing of LCT for fluvial (stream) populations of the species is, where practical and appropriate, removal of nonnative trout species using a combination of physical removal and application of chemical piscicide. A critical need for recovery and conservation of LCT is the restoration of LCT populations within larger, networked stream basin systems such as the Upper Reese River which allows movement of fish among tributary streams to provide genetic exchange and better protection from future climate conditions. NDOW, in cooperation with the US Fish and Wildlife Service, US Forest Service and Yomba Shoshone Tribal Council will be conducting a treatment to remove nonnative trout species in the Upper Reese River upstream of the Arc Dome Wilderness boundary to its headwaters, including all tributaries, and from Stewart Creek from its confluence with the Reese River upstream to its headwaters including all tributaries, in late summer 2019.

The proposed fishing regulation allowing no harvest limit for trout in that portion of the Upper Reese River and tributaries from the Arc Dome wilderness boundary south of the Yomba Shoshone Tribe Reservation to the headwaters, and Stewart Creek from its confluence with the Reese River to its headwaters, in Nye County (Figure 1) is intended to maximize the opportunity for the public to harvest and remove nonnative trout species that would otherwise be lost from treatments to remove those species in late summer 2019. Currently only nonnative brown, brook or rainbow trout are present in the waters described in this proposed Amendment depending on specific location within those watersheds.

We anticipate that the treatment to remove nonnative trout in Upper Reese River and Stewart Creek will be completed by fall 2019. When success of the removal effort is verified these waters will be restocked with native LCT from other populations in the Reese River sub basin. Restoration of harvest limits for trout in these waters would be considered as part of the CR to be adopted for the 2020 and 2021 seasons.

Recommendation:

The Board of Wildlife Commissioners, under the authority of 501.181 of the Nevada Revised Statutes, does hereby adopt the following regulation for the management of the fisheries resource:

LIMITS

“Limit” means the maximum number of game fish that may be lawfully taken and reduced to possession by a person in one day. The limit includes fish caught in Nevada which have been processed or preserved and are stored at any location. Fish that are caught and immediately released back to the water alive are not considered to be reduced to possession or part of the limit.

A person shall not reduce game fish to possession if he already has the number of that fish in possession which equals or exceeds the limit of the water being fished.

General limits are listed by county as all waters, all lakes and reservoirs or all streams and rivers. Exceptions to general limits and special regulations are listed by individual water. Description and Rationale: Change the harvest limit regulation from 10 trout to no limit on trout in the Upper Reese River and tributaries from the Arc Dome wilderness boundary south of the Yomba Shoshone Tribe Reservation to its headwaters, and Stewart Creek from its confluence with the Reese River to its headwaters.

This Amendment to CR 18-01 will maximize the opportunity for the public to harvest and remove nonnative trout species that would otherwise be lost from treatments to remove those species that are scheduled to occur in late summer 2019. Currently only nonnative brown, brook or rainbow trout are present in the waters described in this proposed Amendment depending on specific location within those watersheds.
