MINUTES OF CITY COUNCIL MEETING APRIL 4, 2017

1. Call to order. Meeting was called to order at 6:00 P.M. by Mayor Bert Echterling.

2. Invocation. Jimmy Rogers provided the Invocation.

3. Roll Call. Councilmembers present: Jimmy Rogers, Jeremy Stivener, Vernon Leuschner, Bert Echterling, Jim Mastergeorge, and Steve Janics. Councilmember Steven Tindell was absent.

4. Approve Minutes from: March 7, 2017, and March 21, 2017: Councilmember Steve Janics motioned to approve the minutes from the March 7, 2017, and March 21, 2017 meetings as written. Mayor Pro Tem Jim Mastergeorge seconded this motion. Voting in favor; Rogers, Stivener, Leuschner, Mastergeorge, Janics, and Echterling. Motion carried unanimously.

5. Citizen Comments. None

6. Presentation from the Greater Robinson Chamber of Commerce introducing the current board members. Chamber President Linda Vaughn introduced the Greater Robinson Chamber of Commerce Board members. No action taken.

7. PUBLIC HEARING: Conduct a public hearing on, and consider and take possible action on Ordinance 2017-005 authorizing a Special Use Permit for property located at 3173 Greig Drive, Robinson, Texas. The Public Hearing was opened at 6:09 p.m. Interim Planning Director Barry Lightfoot provided an overview of the Special Use Permit as presented. Mr. Lightfoot stated the Planning and Zoning Commission met on March 21, 2017, and recommended approval by a vote of 3-0. Amanda Garrett, 491 Washington Lane, Waco, Texas 76708, on behalf of the applicant, was available for questions, and respectfully requested approval. After no additional comments, the Public Hearing was closed at 6:11 p.m. Councilmember Stivener asked if there was any opposition by the surrounding property owners. Mr. Lightfoot stated no opposition letters were received. Mayor Pro Tem Mastergeorge asked if any hazardous materials would be released on the property. Mr. Lightfoot stated no, and it would be similar to the existing towing business located in Robinson. Councilmember Leuschner asked if fencing would be required. Mr. Lightfoot said yes. Councilmember Rogers asked if the current business located in Waco would remain open. Mr. Lightfoot said no, the business is relocating to Robinson. Councilmember Jeremy Stivener motioned to approve the Special Use Permit as presented. Councilmember Jimmy Rogers seconded this motion. Voting in favor: Rogers, Stivener, Leuschner, Mastergeorge, Janics, and Echterling. Motion carried unanimously.

8. Presentation from the Robinson Police Department regarding drug enforcement. Chief of Police Rusty Smith introduced CID staff, and turned the presentation over to Narcotics Officer Ryan Collins. Officer Collins provided a presentation to Council City Council Meeting Minutes April 4, 2017 Page 1 of 3

regarding the drug enforcement program. Councilmember Rogers asked how many arrests have been made since this program began. Officer Collins estimated 100. Councilmember Leuschner asked how any seized cash was used. Chief Smith stated seizure funds could only be used for legitimate law enforcement purposes, and said the recent conversion of the CID Division was an example of what some of the funds were used for. Mayor Pro Tem Mastergeorge asked what the relationship was between the Robinson Police Department and Robinson ISD. Chief Smith stated Robinson ISD has their own Police Department, was a separate entity from the Robinson Police Department, and assisted on various cases when asked by RISD. Mayor Echterling asked how does the City become more involved with RISD. City Manager Craig Lemin said he would get in contact with the School Board for further discussion. No action taken.

9. Consider and possible action on Resolution 2017-003-R suspending the April 21, 2017, effective date of Oncor Electric Delivery Company’s requested rate change. City Manager Craig Lemin presented this item. Mr. Lemin stated Oncor Electric Delivery Company filed an application on or about March 17, 2017 with cities retaining original jurisdiction seeking to increase system-wide transmission and distribution rates by $317 million or approximately 7.5% over present revenues. The Company asks the City to approve an 11.8% increase in residential rates and a 0.5% increase in street lighting rates. If approved, a residential customer using 1000 kWh per month would see a bill increase of about $6.68 per month. Mr. Lemin stated the resolution suspends the April 21, 2017 effective date of the Company's rate increase for the maximum period permitted by law to allow the City, working in conjunction with the Steering Committee of Cities Served by Oncor, to evaluate the filing, determine whether the filing complies with law, and if lawful, to determine what further strategy, including settlement, to pursue. Councilmember Stivener asked if any penalties would occur for suspending the effective date. Mr. Lemin said no. Councilmember Jimmy Rogers motioned to approve Resolution 2017-003-R as presented. Councilmember Steve Janics seconded this motion. Voting in favor: Rogers, Stivener, Leuschner, Mastergeorge, Janics, and Echterling. Motion carried unanimously.

10. Discussion and direction regarding the street program. City Manager Craig Lemin opened this item, and turned the presentation over to Clark Gauer with Walker Partners. Mr. Gauer provided council with an overview of the Street Program to include a background summary, strategies, and methods to complete the work. Mr. Gauer said the Council’s next steps were to agree on the final 2017 prioritization of the streets identified, receive approval to proceed, prepare plans and specifications for 2017 water and wastewater replacement to also include the street program, and to move forward with prioritizing streets for subsequent years. Council requested a cost estimate regarding the County completing portions of the work vs. going out for bid, bring back testing results, and to identify final streets. No action taken.

WHEREAS, Public Service is among the most noble and demanding of professions; and excellence in the delivery of Public Service helps to keep Robinson strong and prosperous, and a wonderful place in which to live and work; and

WHEREAS, Robinson City Employees, through their commitment to excellence and diversity of skills, have made great contributions to the City of Robinson by preserving public safety and the health of our citizens; protecting our economic well-being by keeping a close eye on the financial resources of the City; maintaining our streets, parks, and other infrastructure; administering justice; providing excellent communication and education to our citizens, and handling a host of other essential duties the public entrusts to them; and

WHEREAS, The City of Robinson recognizes the contributions made by Public Employees at all levels of city government and finds it fitting to set aside a special time to honor and thank these dedicated individuals who perform such vital roles.

Proclamation §

WHEREAS, the Congress and President of the United States have designated May 15 as Peace Officers Memorial Day, and the week in which it falls as Police Week; and

WHEREAS, the members of the Robinson Police Department play an essential role in safeguarding the rights and freedoms of the citizens of Robinson; and

WHEREAS, we honor the heroism of all our law enforcement officers, especially those who have given their lives so that others might live, asking God’s blessing for the families and friends they left behind; and

WHEREAS, across the nation, Police Week is observed with ceremonies, including the hanging of a blue bow or ribbon to honor law enforcement officers who have sacrificed their lives in the line of duty and to honor those who still strive to keep us safe.

ITEM DESCRIPTION: Conduct a public hearing and consider and possible action on Ordinance 2017-006 amending Part V, Section 5.1 (a) (5) and Section 5.1 (b) (1) of the Subdivision Ordinance changing the minimum required water and sewer line from 8 inch to 6- inch diameter.

STAFF RECOMMENDATION: Staff Recommends approval.

ITEM SUMMARY: The current subdivision ordinance requires that installation of new water and sewer lines be a minimum diameter of 8 inches. This has been problematic in many areas around the city. Since most of the existing systems are 6-inch diameter, placing 8-inch diameter pipe in these areas is not always feasible. This amendment will reduce the requirements to 6-inch minimum. Developers would still be required to size the water and sewer lines adequately to serve their developments. This change would just reduce the minimum size they would be required to install.

ORDINANCE NO. 2017-006

ORDINANCE OF THE CITY OF ROBINSON, TEXAS AMENDING PART V (REQUIRED IMPROVEMENTS), SECTION 5.1 (UTILITY IMPROVEMENTS) SUBSECTIONS (a) (WATER FACILITIES) AND (b) (SEWERAGE FACILITIES) OF THE CITY’S SUBDIVISION ORDINANCE, EXHIBIT B TO THE CODE OF ORDINANCES OF THE CITY OF ROBINSON, TEXAS TO CHANGE REQUIRED LINE SIZE FROM EIGHT INCHES TO SIX INCHES, PROVIDING FOR AN EFFECTIVE DATE, PROVIDING A SEVERABILITY CLAUSE; AND FINDING THAT MEETING HELD IN COMPLIANCE WITH THE OPEN MEETINGS LAWS OF THE STATE OF TEXAS

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROBINSON, TEXAS THAT:

Section 1. Part V, Section 5.1 (a) (5) of the Subdivision Ordinance is amended to read as follows:

Water mains shall be of the pipe diameter required for the subdivision in accordance with city design criteria and as directed by the city engineer, but in any case a minimum of six (6”) inches. To the extent that the city requires the installation of a water main greater than the minimum and the pipe diameter required for the subdivision in accordance with city design criteria and as directed by the city engineer for public purposes of the city unrelated to service requirements for the subdivision, the city shall participate in the increased cost of the water main as designated in the master water plan.

This amendment changes the previous requirement of an eight inch line to a six inch line.

Section 2. Part V, Section 5.1 (b) (1) of the Subdivision Ordinance is amended to read as follows:

Except as provided in [subsection] (2) below, public sanitary sewer lines shall be installed by the developer to serve each lot in all subdivisions unless a written exception, approved by the Robinson City Council, is granted. The installation of the sanitary sewer lines shall be in conformance with the City of Robinson's Standard Details and Standard Specifications. Sanitary sewer mains shall be a minimum of six (6”) inches in accordance with city design criteria as directed by the city engineer. To the extent that the city requires the installation of a sanitary sewer main greater than eight inches for public purposes of the city unrelated to service requirements for the subdivision, the city shall participate in the increased cost of the sanitary sewer main as designated in the Master Waste Water Plan.

This amendment changes the previous requirement of an eight inch line to a six inch line.

Section 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section.

Section 4. This ordinance shall become effective upon passage.

Section 5. The City Secretary is hereby directed to publish the caption of this Ordinance at least one time in the official City newspaper.

Section 6. It is found and declared that the City Council meeting at which this Ordinance has been adopted was open to the public and was noticed and held in accordance with Chapter 551 of the government code.

STAFF RECOMMENDATION: Staff recommends Approval

ITEM SUMMARY: The City of Waco is requesting the City of Robinson support their application for a Municipal Setting Designation at 414 South University Parks Drive. The site has petrochemical contamination in the ground water 15 to 50 foot below the surface. Typically, a site cannot be redeveloped until such contamination is cleaned up. However, that may take years. State statute provides a mechanism for establishing a Municipal Setting Designation that allows redevelopment while the cleanup is underway, but ensures that nothing that would contribute to future contamination may be located at the site. The statute also requires support for the application from any entity with groundwater wells within 5 miles of the site. We do have a well approximately 3 miles away which is why Waco is requesting our resolution of support. Our well is at a depth that there is no risk of contamination from this site. A copy of a letter explaining the details of the Municipal Setting Designation is attached.

RESOLUTION NO. 2017-005-R City of Robinson Support for MSD

WHEREAS, Texas Health and Safety Code Chapter 361 (also know as the Solid Waste Disposal Act) in Subchapter W authorizes the Texas Commission on Environmental Quality (“TCEQ”) to certify Municipal Setting Designations (“MSD”) for properties upon receipt and approval of a properly submitted application to the TCEQ; and WHEREAS, Section 361.8065 requires that an applicant for a Municipal Settings Designation submit to TCEQ documentation that the application is supported by the city council of each municipality (a) in which the property for which the designation is sought is located, (b) with a boundary located not more than one-half mile from the property for which the designation is sought, or (c) that owns or operates a groundwater supply well located not more than five miles from the property for which the designation is sought; and WHEREAS, Section 361.8065 requires that an applicant for a Municipal Settings Designation submit to TCEQ documentation that the application is supported by the governing body of each retail public utility, as defined by Section 13.002, Water Code, that owns or operates a groundwater supply well located not more than five miles from the property for which the designation is sought; and WHEREAS, the City of Waco is in the process of applying to TCEQ for MSD status for a site generally located at 414 South University Parks Drive that includes 16 acres known as the Riverfront Property (the “Site”) in the City of Waco, Texas; WHEREAS, environmental site assessments at the Site have revealed levels of certain chemicals in groundwater above the Texas Risk Reduction Program Tier 1 protective concentration level in a shallow aquifer ranging from approximately 15 to 50 feet below the surface; and

WHEREAS, the Austin Chalk that lies under the shallow aquifer and that along with the Eagle Ford Shale comprise a regional aquitard that prevents the vertical migration of the chemicals of concern into deeper groundwater aquifers; and WHEREAS, representatives of the City of Waco and its consultant have met with representatives of the City of Robinson to provide detailed information and maps regarding the chemicals and groundwater that show that the City of Robinson has a groundwater well location that is approximately 3 miles from the proposed MSD site; and WHEREAS, the aquifer impacted by the chemicals does not affect the groundwater aquifer from which the City of Robinson draws groundwater,

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ROBINSON, TEXAS:

That recitals set forth above are true and correct.

That the City Council of the City of Robinson hereby expresses its support for the City of Waco’s application to TCEQ for certification of a Municipal Settings Designation for the Riverfront Property generally located at 414 South University Parks Drive as shown on Exhibit A (which is attached). That this resolution is effective immediately upon passage. That it is hereby officially found and determined that the meeting at which this resolution is passed is open to the public as required by law, and that public notice of the time, place and purpose of said meeting was given as required.

ITEM DESCRIPTION: Consider approval of the proposal from Walker Partners for engineering services for the Lyndale Lift Station Abandonment and Sanitary Sewer Extension

STAFF RECOMMENDATION: Staff recommends approval of the proposal.

ITEM SUMMARY: The proposal covers the surveying, design, bidding phase, construction administration and special services. Specifics are outlined in the attached proposal. This project is a priority one project within the City’ Wastewater System Master Plan. The project will delete the Lyndale lift station and divert flows by gravity line to the WMARSS interceptor in Flat Creek. The line will be sized so that additional flows can be rerouted to this line during future projects which in turn will reduce flows to the South Pond Lift station.

LYNDALE LIFT STATION ABANDONMENT AND SAN ITARY SEWER EXTENSION

Walker Partners, LLC (Engineer) appreciates this opportunity to submit this Proposal to provide professional surveying and civil engineering services to the City of Robinson (City) in connection with the Lyndale Lift Station Abandonment and Sanitary Sewer Extension (Project). Based upon our initial coordination, we understand that the City desires improvements necessary for the construction of approximately 3,100 linear feet of 18-inch wastewater line in order to allow the abandonment of the Lyndale Lift station and provide gravity sanitary sewer service to tie into the WMARSS Flat Creek Interceptor. The proposed wastewater line alignment will run through two tracts currently owned by Doye Baker and the Robinson Independent School District (RISD). It is envisioned that the entirety of the proposed wastewater line will be placed within City of Robinson sanitary sewer easements as generally shown in the attached exhibit. At this time the easement exhibit and field notes for the Baker property have been completed and provided to the City. The RISD easement exhibit and field notes will be completed as part of the services of this proposal. The Preliminary Opinion of Probable Construction Cost for proposed improvements is attached for review. It is understood that the City desires to extend the sewer line upstream in the future to the Cedar Ridge Subdivision which will accomodate rerouting the South Pond force main from the Moonlight Lift Station and to the WMARSS Flat Creek Interceptor. At the time the City chooses to move forward with those additional improvements, the scope of services and the estimated project cost will need to be examined accordingly. Walker Partners does not propose to engage a geotechnical engineering firm to conduct a soil investigation as part of the current project scope.

The scope of services, schedule, and associated fees that Walker Partners proposes to provide for this Project are outlined below:

1.00 SCOPE OF SERVICES 1.01 SURVEYING SERVICES A. Topographic and Boundary Survey (Phase 12) 1. Perform an on-the-ground field survey to obtain the topography (terrain data) and other visible and apparent surface features (manmade or natural) such as ditches, swales, channels, embankments, drainage structures, catch basins and inlets, manholes, above-grade utility appurtenances, pavements,

significant trees (hardwoods greater than 8 inches in diameter), fences, building structures, water’s edge, etc. For underground utilities, Walker Partners will coordinate with Texas 811. The approximate locations of underground utilities will be shown based upon utility locators’ markings. 2. Establish vertical control at the site and place benchmarks based upon North American Vertical Datum of 1988 (NAVD88), unless otherwise specified by client. 3. Prepare a topographic map from the topographic survey depicting the physical features as described above and with elevation contours at a 1-foot interval.

B. Construction Staking (Phase 65) Walker Partners shall provide line and grade staking for the wastewater improvements, one-time, sanitary sewer collection system.

1.02 ENGINEERING BASIC SERVICES A. Final Design Phase (Phase 40) 1. Attend conferences with the City, and other interested parties regarding the Project. 2. Prepare preliminary design documents on the Project in sufficient detail to indicate clearly the problems involved and the alternative solutions available to the City, including final design criteria, preliminary drawings, preliminary Engineer’s Opinion of Probable Costs, and setting forth clearly the Engineer’s recommendations. 3. Prepare final Drawings and Specifications indicating the scope, extent, and character of the Work to be performed and furnished by Contractor. The Drawings to be prepared with this Phase of the Work, in general, will include typical drawings required by the City which will include the following: a. Wastewater Plans and Profiles – prepare plans for wastewater improvements including the sewer pipes and appurtenances, manholes, clean-outs, trenching details, and other details necessary for the successful completion of the project. Walker Partners will coordinate with the respective public and franchise utility companies as well as coordinating with City of Robinson staff for the review and approval of the drawings prepared. 4. Provide technical criteria, written descriptions, and design data for City’s use in filing applications for permits from or approvals of WMARSS having jurisdiction to review or approve the final design of the Project; assist City in consultations with such authorities; and revise the Drawings and Specifications in response to directives from such authorities. 5. Advise City of any adjustments to the opinion of probable Construction Cost known to Engineer. 6. Prepare and furnish Bidding Documents for review by City, its legal counsel, and other advisors, and assist City in the preparation of other related documents. 7. Revise the Bidding Documents in accordance with comments and instructions from the City, as appropriate, and submit final copies of the Bidding Documents, a revised opinion of probable Construction Cost, and any other deliverables.

B. Bidding or Negotiating Phase (Phase 50) 1. Assist in advertising for and obtaining bids or proposals for the Work and, where applicable, maintain a record of prospective bidders to whom Bidding Documents have been issued, attend pre-Bid conferences, if any, and receive and process contractor deposits or charges for the Bidding Documents. 2. Issue Addenda as appropriate to clarify, correct, or change the Bidding Documents. 3. Provide information or assistance needed by City in the course of any negotiations with prospective contractors. 4. Consult with City as to the acceptability of subcontractors, suppliers, and other individuals and entities proposed by prospective contractors for those portions of the Work as to which such acceptability is required by the Bidding Documents. 5. Attend the Bid opening, prepare Bid tabulation sheets, and assist City in evaluating Bids or proposals and in assembling and awarding contracts for the Work.

C. Construction Administration Phase (Phase 60) 1. Assist in the preparation of formal Contract Documents. 2. Pre-Construction Conference. Participate in a Pre-Construction Conference prior to commencement of Work at the Site. 3. Schedules. Receive, review, and determine the acceptability of any and all schedules that Contractor is required to submit to Engineer, including the Progress Schedule, Schedule of Submittals, and Schedule of Values. 4. Make periodic visits to the site (as distinguished from the continuous services of a resident Project Representative) to observe the progress and quality of the executed work and to determine in general if the work is proceeding in accordance with the Contract Documents. In performing these services, the Engineer will endeavor to protect the City against defects and deficiencies in the work of the contractor, but he cannot guarantee the performance of the contractor, nor be responsible for the actual supervision of construction operations or for the safety measures that the contractor takes or should take. 5. Consult and advise with the City; issue all instructions to the contractor requested by the City; and prepare and issue routine change orders with City’s approval. 6. Review schedules, shop drawings, laboratory tests of materials and other data which the contractor submits. This review is for the benefit of the City and covers only general conformance with the information given by the Contract Documents. The contractor is to review and stamp his approval on submittals prior to submitting to Engineer, and review by the Engineer does not relieve the contractor of any responsibility such as dimensions to be confirmed and correlated at the job site, appropriate safety measures to protect workers and the public, or the necessity to construct a complete and workable facility in accordance with Contract Documents. 7. Obtain and review monthly and final estimates for payments to contractors, and furnish to the City any recommended payments to contractors and suppliers; assemble written guarantees which are required by the Contract Documents. 8. Conduct, in company with the City, a final inspection of the Project for compliance with the Contract Documents, and submit recommendations

concerning project status, as it may affect City’s final payment to the contractors.

1.03 SPECIAL SERVICES A. Resident Project Representative Services (Phase 70) 1. Perform part-time inspection services during construction of the improvements designed under this authorization. Construction is anticipated to last 6 weeks. Services will be provided at an average of 16 man-hours / week at a rate of $85.00 per hour. The RPR will work with the Engineer and City to provide effective communication to all parties throughout the construction phase, foresee potential construction problems or conflicts before they occur, provide progress reports of the construction phase, and coordinate / communicate with the City of Robinson, dry utilities and other entities affected by the construction.

It is currently estimated that one additional easement will be required for the Project. If additional easements are deemed necessary during the course of the Project, they will be billed for according to the fees provided below. B. Draft and Field Stake Easement (Phase 16) 1. Walker Partners will prepare metes and bounds descriptions along with accompanying drawings of the permanent and temporary construction easement to be used as an attachment to the easement document (as prepared by City of Robinson legal counsel for their use in preparing and filing for record. Walker Partners will set iron rods at the easement corners. ($2,850.00 / easement) C. Title Search / Title Run (Phase 100) 1. Walker Partners will engage a Title Company to perform a title search on the deed of the current property owner and make a “run sheet” of the documents / instruments found. The Title Run will describe the instruments and summarize the findings of the Title Search. Note: no title opinion will be given. ($400.00 / title run) D. Easement Acquisition Assistance (Phase 15) 1. It is anticipated that all work will be completed by City staff with Walker Partners assistance. Walker Partners will provide coordination duties related to the preparation and acquisition of the easement as requested by City staff. ($1,000.00 / easement)

2.00 SCHEDULE FOR SERVICES Walker Partners acknowledges the importance to the City of the project schedule and agrees to put forth its best professional efforts to perform its services under this proposal in a manner consistent with that schedule. The City understands, however, that Walker Partners’ performance must be governed by sound professional practices.

3.00 FEES For the ENGINEERING SERVICES, SURVEYING SERVICES AND SPECIAL SERVICES, outlined above, the City agrees to pay Walker Partners a lump sum fee of Sixty-three thousand, and five dollars ($63,005.00) to be invoiced monthly at a percentage of the work completed. ITEM SUMMARY: As previously discussed, WMARSS is currently undertaking a project to replace an existing lift station on LaSalle and construct a new 54” force main to the WMARSS plant. The plan is for the force main to be located along the western side of property belonging to the City of Robinson. This property serves as the location for our water intake structure on the Brazos River. The new line will not interfere with our intake current operations or any future plans.

WMARSS is owned by 7 member cities which includes Robinson. The easement is to the City of Waco as the member cities have selected Waco to operate the WMARSS system. As it is exists today, WMARSS is not a legal entity and cannot hold property under the WMARSS name.

At the previous meeting, Council directed that they expected to receive fair market value for the easement. This information was communicated to them and they have offered $7,547.26 total for the easements. A total of $5,196.27 has been offered for the permanent easement and $2,360.99 has been offered for the temporary easement. This amount was calculated taking 125% of the current MCAD value per acre, and then factoring in the easement proportional values. A copy of the calculation work sheet is attached.

Grantor shall not construct or install permanent improvements or plant trees or other foliage with deeps root systems on the Perpetual Easement tract, except that fences, roads, driveways, parking areas and utility service crossings, that do not interfere with the pipeline, may be installed or constructed thereon, subject to the rights granted herein to Grantee. Further, Grantor shall not excavate or make substantial changes to the grade, elevation or contour of the Perpetual Easement tract, without obtaining prior written consent of the Grantee. Should Grantee, in the exercise of its rights hereunder, materially damage or destroy any existing fence,

Temporary Construction Easements: Grantor further grants to Grantee Temporary Construction Easements of 0.722 acre and 0.470 acre on, over, under, along, through, and across all of Grantor’s right, title, and interest in the property described in Exhibit “B” attached hereto and incorporated herein by this reference, for all of the purposes described in the above Perpetual Easement during and throughout the period of construction of the initial sewage line(s) known as the Transfer Lift Station Project. These Temporary Construction Easements shall automatically terminate upon the earlier of the completion of construction of the Transfer Lift Station Project or December 31, 2020, without the necessity of the filing of a separate termination document. The termination of these Temporary Construction Easements shall not, in any way, cancel, terminate, reduce, or diminish the Perpetual Easement granted above.

Grantor warrants to the CITY OF WACO, TEXAS, a Municipal corporation, f/b/o Waco Metropolitan Area Regional Sewerage System (“WMARSS”), its successors and assigns that Grantor has fee simple title to the above-described property and the unlimited right, power, and authority to grant the Easement(s) described herein and to render the above-described property subject thereto. ITEM DESCRIPTION: Consider authorizing the City Manager to negotiate and execute a right of way dedication with McLennan County to transfer 0.069 acres from city property described as Carlos O’Campo Survey Abstract 32 15.08 acres Volume 1223 Page 212.

ITEM SUMMARY: I was contacted by Luke Lammert, Asst. Engineer with McLennan County regarding the project to replace the 12th St. bridge over Cottonwood Creek. The County is working with TxDOT to replace the bridge. Mr. Lammert advised that in order to proceed with the project they would need to acquire additional right of way to accommodate the new bridge. A small portion of the needed additional right of way is owned by the City. The county is requesting the City dedicate the right of way as soon as possible to ensure the project progresses quickly. This bridge was used by many Robinson residents and we get inquiries weekly regarding when it will be replaced. Copies of the survey and property overview are attached. If the council approves this item, the County will prepare the necessary documents.

ITEM DESCRIPTION: Discussion and direction regarding street program.

STAFF RECOMMENDATION:

ITEM SUMMARY: Staff and our engineers have been continuing work on a comprehensive street program that addresses not only those streets that are most in need of upgrading, but also maintaining those streets that are in fair to good condition to keep them from deteriorating to a point where reclamation or reconstruction are necessary in the near future. After the recent tour of streets, staff and our engineers are ready to present recommendations for streets to move forward with this year as well as recommended streets for the following two years.

The streets being recommended for the current year are:

McLendon Dr. Hillview Dr. Hoffmeyer Ln. Downsville Rd. Lou St.

The remaining streets on the initial list all require utility line replacement and in some cases extensive drainage work. We will work on prioritizing the remaining streets and project being ready to go out for bid later this year so that utility work could begin at the end of this year or early next year with drainage and street work to immediately follow.
