Please provide in the form of a single PDF document all internal and external correspondence received by and sent from (all of) the Council's Housing Officer(s) in the last 24 months in relation to all planning applications in the Parish of Bury. For the avoidance of any doubt, and to assist the search, the developments of particular interest include Land South of Buryfield Bury, Land West of Garden Court and 1 to 16 Upwood Road, Bury Clinic, RAF Upwood, Upwood Road, Bury.

Please find attached the information that you’ve requested. The information is a set of emails from our Housing Officer Frank Mastrandrea, mostly to the planning officers and with the developers. A few notes on the disclosure: • We are obliged to protect the personal data of our employees and third parties so have redacted this where necessary as per Section 40 of the Freedom of Information Act. Some names have remained in the disclosure where the person is the nominated planning officer and we’re legally required to advertise their identity, this is the case for Peter Baish and Will Tysterman. Frank Mastrandrea is happy for his name to be published so has consented to disclosure. Otherwise, names of the developer’s representatives, admin officers and other personal data has been redacted. • Some information, predominantly on pages 50-58 comprises legal advice from the Council’s internal legal team where they are commenting on a draft legal agreement. Section 42 of the Act provides a strong protection for legal professional privilege material, due to the strong public interest in public authorities being able to seek legal advice on their affairs. Comments from the Council’s legal team have been redacted, and the draft agreement under discussion has been withheld in full. • There are two further attachments to the emails in the scope of your request. Unfortunately these have to be exported and processed separately so they are attached at the end of the disclosure rather than being in-line with the emails themselves. • There are four tables showing breakdowns of affordable housing contained in the emails which don’t export to PDF correctly, and so half of the information stretches off-screen. I’ve reproduced these tables in the excel spreadsheet attached. Note that one table is reproduced on pages 2, 4 and 10, and a separate table of the same style is on page 19. All the 2 bedroom bungalows should be to full wheelchair standard. Our Special Housing Needs Officer may from time to time ask for some of the rented homes to be adapted to meet the needs of applicant families. She will liase with the RP and yourselves to confirm necessary details.

Our preferred mix is below. You’ll see that we have introduced some 1 beds which could be houses but perhaps better would be flats in a two storey building with external front doors (so no communals).

We’ve also asked for a couple of wheelchair standard bungalows, if based on evidence that’s difficult to achieve we would at least like to have those to visibility standard which would be providing level access to the building with flush threshold and door widths to allow access for a wheelchair visitor (and of course, toilet on the entrance level).

Also, we should like some of the 3 bedroom houses to be 6 person for rent and this may be achievable by removing the en suite for type 2329. Please can they consider?

I think you can confirm that it was agreed that the Council’s position is as set out in my email below which I think forwarded to them.

In terms of the number I requested, you can confirm as per my earlier email to you that my email suggesting 35 is dated 16th October but my note of the meeting with the applicants on 15th October indicate that revised proposals were showing 87 homes hence I sought 40% of that number. The requirement therefore remains to provide 40% Affordable Homes of which 70% should be Affordable Rented and 30% Shared Ownership.

The recent NPPF does not change our view on preferred tenure.

Firstly 70% of the affordable homes should be for rent as specified in policy. The remainder should in our view be shared ownership.

The Council has carried out a Local Plan Viability Assessment to analyse the economic capability of development proposals to provide affordable housing. This concludes that an affordable provision of 40% is viable and deliverable on the majority of types and locations of sites based on testing with 70% affordable rent and 30% shared ownership.

1 We take the view that Shared Ownership is a more affordable Low Cost Home Ownership product since it can accommodate a range of income groups being those able to acquire a share of between 25 and 75%. People on lower incomes can therefore be accommodated whereas Discounted Open Market Value at 80% of market levels would only be affordable for higher income groups.

Our preferred tenure mix is of course, fully compliant with NPPF.

Hi Peter,

Re the comments from Frank below, we have as you will have seen updated the masterplan accordingly.

However, just on the tenure mix, we do believe that the mix/tenure position should be NPPF compliant in terms of allowing for 10% Discounted Open Market Value on site (out of the overall provision requested below). The table at present simply shows affordable rented and shared ownership.

Please can you let me have your views on this?

Thank you for the phone call yesterday.

We are pleased to confirm that we would be able to bring this site forward as 100% Affordable.

We have two firm offers from HAs, so the scheme is deliverable. We could start on site this year, which we would hope is a benefit as well as securing your numbers.

(As you may know, we have already delivered 20nr units in Offord D’Arcy, and are on site with 36nr (plus) units in St Neots as 100% Affordable, and started quickly after getting Planning.)

We confirm that we can use (demolish) two houses to form our entrance, with measures to further reduce the impact on neighbours such as acoustic fencing and landscaping: this should help overcome Members’ entrance concerns.

As I said in my email, we have a number of developments which have progressed via this policy.

Provided the site is well related to the settlement and there is priority for local people to access the affordable housing in the way I described (and there is evidence of need) then the council could consider such sites. As you may know, a previous planning application was refused. Subsequent to that, the developers NFC Homes approached the Council with the intention of taking this forward as a Rural Exceptions Housing development. In connection with this, the Parish Council is embarked on establishing a Neighbourhood Plan. As part of that work a Housing Needs Survey was conducted which is attached; this concluded there was need for 29 affordable homes for people with a Bury connection.

The District Council’s adopted Local Plan includes a policy for Rural Exceptions Housing (LP28). Essentially, the Council is obliged to allocate affordable housing in priority need order regardless of local connection. This means that affordable housing can be difficult to access for people having need and also having connection to a location. This is because need is high and affordable housing would not be offered to local people if others who are not local have a higher housing need. To overcome this, Rural Exception development can be considered on sites that might not otherwise be acceptable provided the site is well located to a settlement and it prioritises local people (for the affordable housing) before others without a connection. Another requirement is that not less than 60% of the developable area should comprise affordable housing; the remainder can be market housing

In this instance NFC propose 54 homes with 10 being market homes and 44 would be affordable housing. Although the number of affordable homes exceeds the number the Survey indicates for Bury, the policy does allow the council to consider proposals which provide affordable housing for those in need in adjoining settlements.

The proposal would therefore deliver more affordable homes than normally expected under the policy (the developable area given over to affordable housing is circa 84%, so well in excess of the minimum 60%) . The District Council has developed a number of Rural Exceptions sites and some are soon to commence and there are processes in place to ensure the homes are prioritised to locals. We work closely with ACRE who have been working with the Parish Council on the Neighbourhood Plan and carried out the Needs Survey. Further information on similar schemes and a useful FAQ sheet is provided in the ACRE link below.

There is a Parish Council meeting scheduled for 2nd October where NFC will present their proposals but if you would like any further information in the meantime please do not hesitate to contact me.

We’re promoting this site and intend to submit an Outline Application in Q3 of 2019. It’s allocation RA7 within the draft Local Plan.

We met will Will (cc’d) and recently to discuss the attached draft layout plan.

Following feedback we are due to evolve the layout further and discuss this with Will and in June/July. The Outline Application will be relatively detailed in order to demonstrate the amount of residential units proposed – the draft allocation is for c.90. As part of this we’d like to include the affordable housing mix so that we know the space that is required for the 40% of the units.

Are you therefore able to provide an indicative mix for a 90 and 100 unit scheme at this stage so that we can include this on the next layout iteration?

If that’s a calculation of the market plots compared to the whole site, I don’t think that’s how we would assess.

I think it needs to be percentage by plots not including the open space and road so the area of the affordable as you have calculated the market divided by the total plots.

I understand from Will that there will be more meetings before any plannig application. Added to that, a meeting with the PC willl need to take place. For that, we will need reasonaly detailed information on the proposals (scale, mix, house types, tenure etc.). For the Planning Satement a more important element will be the houisng needs survey and perhaps to report that we met PC and outline their response. We can discuss these issues when we meet.

For this application there a some issues to discuss with the applicant for the affordable housing.

The bungalows should ideally be to wheelchair standards so we shall need confirmation of this together with details of wheelchair turning circles and for example confirmation there is level access to the doorways. The 2 bedroom bungalows is accessed via living room and this is not ideal for a wheelchair user. There is also no path shown to the 2 bedroom bungalow.

In terms of tenure plots 26 to 28 are preferred for shared ownership with remainder being for rent. For the rented 3 bedroom houses we would like if possible for these to be 6 person and this may be achievable by removing the en‐ suite.

By way of update I have spoken to this morning. has explained to me that there have been severe IT issues at the council and 3C Shared Services which means he has not been able to have IT access. Nonetheless he is looking at emails on his telephone but this does restrict what he can achieve by way of drafting documents. I believe this means that my team at Perrins will produce a first draft of the deed of variation to the existing s106 agreement to take account of the new scheme plans. However before we do this has asked for clarification as to whether there are any other changes which need to be made. He referred to communication with Frank regarding a change to the tenure mix.

I have reviewed the existing s106 agreement dated 21.12.2015 as varied by supplemental agreement on 24.04.2017. The following should be noted:

1. The definition of the affordable housing scheme in the original s106 agreement was varied so that it referred to “a scheme for securing the provision of 5 Affordable Housing Units each being 2 bedroom 840 sq ft (78 sq m) units comprising 3 Affordable Housing units and 2 shared ownership units.”

2. I have received notification from at Longhurst Group confirming that the number of units dedicated for affordable housing and which are to be made subject to the terms of the s106 agreement remains 5 in number and the split between rent and s/o units remains the same. The allocated units for rent are plots 7, 8 and 13. The allocated units for s/o are plots 1 and 2.

has requested that Frank/Peter confirms therefore that aside from referring to the change in the consented plans there should be no other changes to the affordable housing scheme that needs to be referred to in the deed of variation to the s106 agreement.

In terms of practicalities, once Frank confirms the position regarding the above, I will arrange for a draft deed of variation to the s106 agreement to be circulated today with the aim that and I try to get this agreed by tomorrow lunchtime. Thereafter, I will circulate an engrossment copy by emailing it to the Longhurst Group so that this can be signed on behalf of Keystone Developments (LG) Limited as land owner. The executed deed will then need to be couriered to the council/ office so that it can arrange for the agreement to be sealed and the planning permission issued on Friday.

By way of update I have spoken to this morning. has explained to me that there have been severe IT issues at the council and 3C Shared Services which means he has not been able to have IT access. Nonetheless he is looking at emails on his telephone but this does restrict what he can achieve by way of drafting documents. I believe this means that my team at Perrins will produce a first draft of the deed of variation to the existing s106 agreement to take account of the new scheme plans. However before we do this has asked for clarification as to whether there are any other changes which need to be made. He referred to communication with Frank regarding a change to the tenure mix.

I have reviewed the existing s106 agreement dated 21.12.2015 as varied by supplemental agreement on 24.04.2017. The following should be noted:

1. The definition of the affordable housing scheme in the original s106 agreement was varied so that it referred to “a scheme for securing the provision of 5 Affordable Housing Units each being 2 bedroom 840 sq ft (78 sq m) units comprising 3 Affordable Housing units and 2 shared ownership units.”

2. I have received notification from at Longhurst Group confirming that the number of units dedicated for affordable housing and which are to be made subject to the terms of the s106 agreement remains 5 in number and the split between rent and s/o units remains the same. The allocated units for rent are plots 7, 8 and 13. The allocated units for s/o are plots 1 and 2.

has requested that Frank/Peter confirms therefore that aside from referring to the change in the consented plans there should be no other changes to the affordable housing scheme that needs to be referred to in the deed of variation to the s106 agreement.

In terms of practicalities, once Frank confirms the position regarding the above, I will arrange for a draft deed of variation to the s106 agreement to be circulated today with the aim that and I try to get this agreed by tomorrow lunchtime. Thereafter, I will circulate an engrossment copy by emailing it to the Longhurst Group so that this can be signed on behalf of Keystone Developments (LG) Limited as land owner. The executed deed will then need to be couriered to the council/ office so that it can arrange for the agreement to be sealed and the planning permission issued on Friday.

Please find attached a slightly amended draft of the s.106 reflecting some further comments from the landowner’s solicitor.

Of these, I think it is worth adding a short explanation for the following amendments:

Commencement of Development – we understand that some environmental and site survey works will be required in order to discharge pre-commencement conditions. As such, it is inconsistent (and potentially unfair) for those works to be required prior to implementation of the planning permission yet to also trigger the obligations in the s.106. I would therefore hope that these can be agreed.

Clause 13 – the land is currently tenanted farmland. As such, the amendments regarding notification are intended to reflect this, and again I trust are not controversial.

Clause 27 – is there any reason why we can’t limit the jurisdiction so that it solely relates to the Courts of England?

Lastly, I intend to add reference to an Annex to append the Specification (which again I trust is not controversial)

As discussed previously on the phone, the cleanest and best route would be to discharge the pre commencement conditions on the 15/00029/FUL application and commence development so that you have an extant planning permission. Then at your leisure you could submit an application to purely amend the layout of scheme with no time constraints as you would have a live extant planning permission in place.

As discussed previously on the phone, the cleanest and best route would be to discharge the pre commencement conditions on the 15/00029/FUL application and commence development so that you have an extant planning permission. Then at your leisure you could submit an application to purely amend the layout of scheme with no time constraints as you would have a live extant planning permission in place.

It would help if you and Peter could provide instructions to to provide a draft s106 agreement to vary the original s106 and to also deal with binding the new s73 consent.

As you are no doubt aware the existing planning permission expires on 23rd December 2018 if we haven’t implemented by then. We cannot implement without the new s106 being completed and the s73 released.

I would be grateful if you could prioritize this matter as far as possible over the next few days in order that our mutual objectives can be met. As you know it is our intention to deliver an additional 19 affordable dwellings but outside of the s106 so as to enable us to utilise grant funding.

Sorry for the delay in getting back to you. This is because we have been waiting for a decision to be made concerning the acquisition of the site by Evera Homes from Keystone.

This decision has been made and Evera will indeed be purchasing the site.

Evera have purchased the site on the basis of increasing affordable housing from 5 dwellings up to 24 dwellings in line with policy. We propose that 5 units remain in the s106 and the additional 19 units are classed as over delivery and will attract grant funding.

The s106 will need some slight amendments including a change in plot numbers on the 5 units.

My colleagues or will be able to issue a new site layout showing the detailed breakdown of affordable units. In order to make this viable we are proposing a mix of 16 no shared ownership and 8 no affordable rented units.

The recent NPPF does not change our view on preferred tenure.

Firstly 70% of the affordable homes should be for rent as specified in policy. The remainder should in our view be shared ownership.

The Council has carried out a Local Plan Viability Assessment to analyse the economic capability of development proposals to provide affordable housing. This concludes that an affordable provision of 40% is viable and deliverable on the majority of types and locations of sites based on testing with 70% affordable rent and 30% shared ownership.

We take the view that Shared Ownership is a more affordable Low Cost Home Ownership product since it can accommodate a range of income groups being those able to acquire a share of between 25 and 75%. People on lower incomes can therefore be accommodated whereas Discounted Open Market Value at 80% of market levels would only be affordable for higher income groups.

Our preferred tenure mix is of course, fully compliant with NPPF.

However, just on the tenure mix, we do believe that the mix/tenure position should be NPPF compliant in terms of allowing for 10% Discounted Open Market Value on site (out of the overall provision requested below). The table at present simply shows affordable rented and shared ownership.

Our preferred mix is below. You’ll see that we have introduced some 1 beds which could be houses but perhaps better would be flats in a two storey building with external front doors (so no communals).

We’ve also asked for a couple of wheelchair standard bungalows, if based on evidence that’s difficult to achieve we would at least like to have those to visibility standard which would be providing level access to the building with flush threshold and door widths to allow access for a wheelchair visitor.
