Subject: Closure of Complaint against PT Andalan Sukses Makmur (Bumitama Agri Ltd)

Dear Ms. Lim, with reference to the complaint submitted by Friends of (FoB), Friends of National Parks Foundation Indonesia and Siesfund Australia on 21 September 2013, the RSPO Complaints Panel have reviewed and deliberated the following points:

1. The ‘stop work order’ that was applied to PT ASMR had been lifted on 10 April 2014. 2. PT ASMR has completed all recommendations requested 10 April 2014 by the RSPO Complaints Panel, as follows: a. Implemented actions listed in the joint proposal submitted by FoB and SiesFund on 17 February 2014. We note that cooperation with FoB is ongoing also the seedlings and replanting activities. b. Implemented High Conservation Value (HCV) Management Plan, Action Plan and Monitoring Plan as well as carried out voluntary High Carbon Stock (HCS) assessment and habitat improvement in Tanjung Harapan. PT ASMR has also worked together with Borneo Orangutan Survival Foundation (BOSF) on the conflict mitigation between human, orangutan and other wildlife. FoB confirmed that PT ASMR is committed not to develop the deep peat areas that were identified in the voluntary HCS survey. c. Continued with collaborative management of wildlife species (Orangutan) with the National Park (TPNP) and Board of Natural Resources Conservation (BKSDA). PT ASMR has signed an MoU with TPNP on 28 November 2013 on Development of Buffer Zone and another MoU with BKSDA on July 2014 on conservation program. d. Completed to execute all measures to conform to the New Planting Procedures (NPP) including notification of new planting for public consultation.

e. Completed a joint survey with the complainants and the local authority within the concession for the presence of Orangutans. These surveys focused on the areas that have not been cleared within the license area of PT ASMR, especially near the Sekonyer River. The joint survey was completed by the end of December 2013. PT ASMR is continuing to monitor and patrol the existence of Orangutan habitats. f. Taken necessary actions as described in SOP-ASMR-MOU-WSB-001 “Penanganan Orangutan” (2013) to address any potential Human-Orangutan conflicts. These actions have been completed. PT ASMR built 3 watchtowers in Kumai Hilir, Sekonyer and Teluk Pulai in May-June 2014; formed a taskforce to monitor and patrol Orangutan; conducted training on mitigation of conflict between Human-Orangutan; implemented Orangutan surveys with Borneo Orangutan Survival Foundation (BOSF). g. Completed the water management plan in Teluk Pulai and taking into account the presence of peat land located in the Tanjung Putting National Park territory. PT ASMR conducted peat survey and has finalized its water management plan. h. Completed the profile of peat distribution and depth in the Sekonyer area and its surroundings to implement Best Management Practice (BMP) for the peat area management. i. A compensation panel has been assigned for BGA on 15 April 2014 (24th BHCV Working Group Meeting). During the staged implementation period of the Remediation and Compensation Procedure (RaCP) BAL has submitted the disclosure of liability template for all its management units on the 14th July 2014. From the liability disclosure, it was revealed that PT ASMR has zero liability. Therefore, BAL is not required to submit the LUC Analysis. j. RSPO secretariat received the progress reports on the implementation of items a – i (above), on these following dates :31 May 2014, 4 June 2014, 22 August 2014, 16 September 2014, 10 October 2014, 24 January 2015, 24 April 2015 and 9 July 2015.

Based on above considerations, the RSPO Complaints Panel is satisfied that PT ASMR has undertaken positive actions to resolve the complaint and is recommending that the complaint is closed.
