10/06/2017 Update to Fatal Crash in Killington

During the investigation of the fatal crash that occurred in Killington on October 4th, 2017, the following facts have been determined thus far; Joseph Mailhiot was driving Vehicle #1 north on . Mailhiot was driving north on Vermont Route 100 at an unconfirmed speed, but estimated to be approximately 45 and 50 MPH based on traffic (the posted speed limit is 50 MPH). While driving north, the vehicle left the east side of the roadway for an unknown reason and struck five (5) trees with the passenger side of the vehicle and one (1) tree with the drivers side. These trees caused tremendous damage to the front passenger side as well as moderate damage throughout the remainder of the vehicle. The driver (Mailhiot) was able to exit the vehicle on his own and suffered only minor injuries . The passenger (Coltey Mailhiot) suffered injuries to her head and chest and died a short time after the crash .

The Vermont State Police Crash Reconstruction Team responded to the scene to take measurements and it was determined Vehicle #1 traveled approximately 152 feet from the time it first left the roadway to the time it came to a position of uncontrolled rest. No evidence of braking or a sharp turn or swerve in the form of skid marks or scuff marks have been located on the roadway . At the time of the crash, the weather was clear and sunny and the road was dry and free of debris and traffic to the south appeared to be driving smoothly. The while and yellow painted lane markings on the road are relatively fresh and easily visible.

While interviewing Mailhiot, Officers observed signs of impairment and extreme drowsiness. Alcohol was ruled out as a contributing factor and a nationally certified Drug Recognition Expert was contacted to perform an evaluation. This evaluation led officers to believe Mailhiot was under the influence of drugs and a blood test was requested. The results of the blood test are pending.

The initial conclusion of the crash is that Mailhiot is at fault for failing to maintain his lane which is a violation of Title 23, Vermont Statutes Annotated, Section 1038 and failing to drive at a speed to avoid colliding with a person, vehicle or other object on or adjacent to the highway, a violation of Title 23, Vermont Statutes Annotated, Section 1081(a). It is also believed that Mailhiot’s extreme drowsiness and drug use were significant contributing factors of the crash.

Based on the facts up to this point in the investigation there was enough evidence to charge Joseph L. Mailhiot, DOB: 03/03/1977 with Gross Negligent Operation with Death Resulting and Driving Under the Influence. He is scheduled to be arraigned on these charges on October 6th, 2017 at 1230 hours at the Rutland District Court. 10/3/17 17:20 17KP000736 Traffic Stop East Mountain Rd / Killington Rd
