1.‘ The applications for Road Transportation Service Permits mentioned in the schedule to this notice have been received by the Road Transportation Board.

2. Interested persons may examine the applications in the Office of the Secretary to the Road Transportation Board at the Ministry of Works and Communications, Mbaba- ne.

3. Any persons objecting to an application shall within 14 days after the date of publication of this notice:-

Short title and commencement.

1. This Act maybe cited as the National Agricultural Marketing Board Act, 1985 and shall come into operation on such date as the Minister may, by notice in the Gazette appoint.

Interpretation, 2. In this Act, unless the context otherwise requires — “Board” means the National Agricultural Marketing Board established under section 3; “Minister” means the Minister responsible for Agriculture and Co-operatives; “scheduled products” means products designated as such under section 15. S2

Establishment of Board. 3. There is hereby established the National Agricultural Marketing Board which shall be a body corporate with perpetual succession and a seal, capable of suing and of being sued in its corporate name, capable of acquiring and alienating movable and immovable property and of perfoming such other acts as a body corporate may lawfully perform.

Membership of the Board. 4. (1) (a) The Board shall consist of the following members all of whom shall be appointed by the Minister— (i) a Chairman; (ii) a representative of the Ministry responsible for agriculture; (iii) a representative of the Ministry responsible for commerce; (iv) a representative of the Central Co-Operative Union; (v) one person representing retailers of fruits and vegetables; (vi) three persons whoshall represent farmers; and (vii) two persons with such qualifications and whoshall represent such organizations as the Minister may determine. (b) The Minister may designate a public officer to be the Executive Officer and Secretary to the Board. (2) A memberof the Board whois not a public officer shall hold office for such period not exceeding three years and on such other terms and conditions as the Minister may determine and shall be eligible for re-appointment.

Functions of the Board. 5. In the exercise of its powers under section 5 and subject toany directions of a general nature which maybe given to it by the Minister under section 7, the Board may — (a) register wholesale distributors, importers and exporters of scheduled products; (b) facilitate in such manner as it may consider appropriate, the production, processing, storage, transportation, distribution and sale of scheduled products; (c) where required to do so, advise the Governmentin all matters related to the availability of and demand for scheduled products; (d) perform such other functions as may from time to time be determined by the Minister,

Powers of the Board. 6. In the exercise of its functions under section 5, the Board may — (a) require any person wishing to engage or whois engaged in importing and expor- ting scheduled products to register with and obtain a permit from the Board; (b) nominate and empower any person or body to import or export scheduled products; (c) determine the quantity, quality, grade or class of scheduled products that shall be subject to control and designate the place and mannerofdistribution of scheduled products; , (d) require from any person information relating to the source, type, grade, quantity and prrice of scheduled products; 83

Power of the Minister. 7. The Minister may give directions of a general nature to the Board relating to the performanceofits duties and the Board shall comply therewith.

Appeal to the Minister. 8. A person aggrieved by any decision of the Board not to grant a permit to import or export scheduled products may, within thirty days of his being informed of such decision, appeal to the Minister in writing whose decision thereon shall be final.

Procedure of the Board. 9. (1) The proceedings of the Board and other matters relating thereto shall be gover- ned by the provisions set out in the Schedule hereto. (2) The Minister may, by Notice in the Gazette amend the Schedule.

Funds and assets of the Board. 10. The funds andassets of the Board shall consist of — (a) allmoneys or property that may from time to time be donated, lent or granted to the Board; (b) all property and investments acquired by or vested in the Board and all money earned arising therefrom; (c) all moneys raised or borrowed by the Board; (d) all other moneys or property that may in any manner become payable to or vested in the Board in respect of any matter incidental to its powers and functions.

Borrowing powers of the Board.

11. The Board may, with the approval of the Minister, borrow such sums as it may require for meeting its obligations or exercising or performing its functions.

Financial year.

12. The Financial year of the Board shall run from the ist January, to the 31st December in one year:

Provided that the first financial year may be shorter or longer than twelve monthsif the Board so determines.

Accounts and audit.

13. (1) The Board shall cause to be kept books of account in proper form as well asall necessary records in connection therewith. (2) The accounts of the Board shall be subject to an annual audit by an auditor appointed by it and approved by the Minister. (3) The Board shail within six months after the end of each financial year — (a) report to the Minister in such form as the Minister may direct on the perfor- mance byit of its functions; S4

(b) deliver to the Minister a copy of its accounts audited in accordance with sub- section (2).

(4) The Minister shall lay before Parliament copies of all audited accounts as soon as practicable after he has received them.

Offences and penalties. 14. A person whofails to comply with instructions issued under section 6(a) and (d) or whofails to pay a fee or levy imposed undersection 6(c), shall be guilty of an offence and liable on conviction to a fine not exceeding five hundred Emalangeni or imprisonment for three months.

Regulations. 15. The Minister may make Regulations prescribing scheduled products and generally giving effect to the provisions of this Act.

SCHEDULE (Section 9)

RULES OF PROCEDURE OF THE BOARD

1. The Board shall meet at least once every three months. 2. The Chairman of the Board shall convene andpresideat all meetings of the Board. 3. In the absence of the Chairman, but subject to the quorum, the Board shall appoint an Acting Chairman from among the memberspresent to preside at a meeting of the Board. 4, The quorum for a meeting of the Board shail be five members. 5. All decisions of the Board shall be made by a majority of the votes of the members present and in the event of an equality of votes, the Chairman or Acting Chairman as the case maybe, shall have a casting vote in addition to his deliberative vote. 6. Citation and commencement.

1. These Regulations maybe cited as the Telegraph (Amendment) (No. 2) Regulations, 1985, shall be read as one with the Telegraph Regulations, 1962 and shall comeinto force on the Ist December, 1985.

Amendment of Part LI.

2. Part III of the Telegraph Regulations, 1962 is amended by replacing the charges . for private telegraph services with the following charges —

THE SWAZILAND TELEVISION AUTHORITY ACT, 1983

THE TELEVISION VIEWERS (CERTIFICATES AND LICENCES) (AMENDMENT) REGULATIONS,1985

(Under section 26)

In exercise of the powers conferred by section 26 of the Television Authority Act, 1983 the Minister for Interior and Immigration, after consultation with the Board of Di- rectors, hereby makes the following Regulations —

Citation,

1. These Regulations may be cited as the Television Viewers (Certificates and Licences) (Amendment) Regulations, 1985 and shall be read as one with the Television Viewers (Cer- tificates and Licences) Regulations, 1983, (hereinafter referred to as ‘‘the principal Regula- tions). ‘

Addition of regulation I bis.

2. The principal Regulations are amended by adding the following regulation after regulation 1 —

“Interpretation,

1. bis. In these Regulations, unless the context otherwise requires —

“owner” includes a person, other than the Swaziland Television Authority or the Swaziland Television Authority Rentals, who is in possession ofa television receiver or a video cassette recorder.”

Amendment of regulation 2. 3. Regulation 2 of the principal Regulations is amended by replacing paragraph (2) with the following —

(2) An owner referred to under paragraph (1) shall in addition to the payment prescribed thereunder pay in advance for a television viewers certificate — (a) a monthly fee of twenty-five Emalangeni for a colour television receiver on or before the 1st of each month; (b) an annualfee of five Emalangeni for a 31cm or less portable monochrome television receiver at such time as may be prescribed.”

Addition of regulation 6 bis.

4. The principal Regulations are amended by adding the following regulation after regulation 6 — $7 “Right to enter premises. 6. bis. (4) An inspector referred to in regulation 6 may at any reasonable time enter any premises in which he has reasonable grounds to suspect that there is a television receiver or video cassette recorder in respect of which no current television viewers certificate or licence is held by the owner to be shown on demandsuch certificate or licence or where a disconnecting, interrupting or disrupting device has been attached to a television receiver or video cassette recorder under regulation 7 bis, in order to inspect whether such device has been damaged or interferred with.

(2) The right to enter premises under regulation (1) shall not be exercise except — (a) with the consent given by or on behalf of the occupier of the premises; or (b) under the authority of a warrant issued under paragraph (3). (3) Where the Authority satisfies a magistrate by affidavit or oral evidence on oath that it is seeking to exercise a right to enter premises which, but for the provisions of this regulation it would not be entitled to exercise and that —

(a) the occupier thereof has refused to give his consent to the entry after being given not less than twenty-four hours notice by the inspector; (b) a request to the occupier for consent under paragraph (a) would de- feat the object of the entry; or (c) the premises are unoccupied,

the magistrate may, by warrant under his hand authorise the entry into the premises if need be by force.

(4) A warrant issued under this regulation shall continue in force until the purpose for which the entry authorised by the warrant has been acco- mplished.”

Addition of regulation 7 bis. 5. The principal regulations are amended by adding the following regulation after regulation 7 —

“Disconnection etc. of television receivers.

7. bis (1) The Authority or any person appointed as its agent may disconnect a television receiver or video cassette recorder owned by any person or mayinterrupt or disrupt the signal thereto if such person has failed — (a) to comply with regulation 7: Provided that where such person has paid the deposit prescribed under regulation 2, the Authority shall not disconnect the television receiver or video cassette recorder or interrupt or disrupt the signal thereto unless the amount due in respect of the television viewers certificate exceeds the amount of the deposit paid and a demand for the amount due has been made and a period of twenty-one days or more has elapsed from the date of the making of such demand, 88

(b) to pay any amount, not being an amountdue in respect of a television viewers certificate, or an amount subject to a bona fide dispute, due by him to the Authority under the Act or these Regulations; (c) to show to an inspector under regulation 6 a current television viewers certificate.

(2) Where the Authority exercises any power conferred under sub-regu- Jation (1), it may disconnect a television receiver or video cassette recorder by attaching any device thereto or to the television aerial or may interrupt or disrupt the signal to a television receiver or video cassette recorder in such other manner as may be effective until —

(a) the cause of complaint has been removed to the satisfaction of the Authority ; (b) such amount as may be prescribed has been paid to the Authority in respect of any expenses incurred in disconnection, interruption or disruption; (c) such amount as may be prescribed has been paid to the Authority in respect of any expences to be incurred in reconnecting the television receiver or video cassette recorder or otherwise restoring the signal thereto.”

Addition of regulation 7 ter.

6. The principal Regulations are amended by adding the following regulation after regulation 7 bis —

“Tampering with property of Authority.

7. ter. (1) A person who unlawfully damages, interferes with or does anything which is calculated to damage orinterfere with a disconnecting, interrupting or disrupting device installed by the Authority under regulation 7 bis shall be guilty of an offence.

(2) A person who unlawfully breaks or detaches any seal or locking device attached by the Authority under these Regulations to any disco- mnecting, interrupting or disrupting device shall be guilty or an offence.”

Replacement of regulation 10.

7. Regulation 10 of the principal Regulations is replaced with the following regulation —

“Offen s and penalties.

10. A ‘person who contravenes regulation 7, 7 ter or refuses entry, obstructs or otherwise interferes with a person acting under a warrant issued under regulation 6 bis (3) shall be guilty of an offence and liable on conviction to a fine not exceeding one hundred Emalangeni or imprisonment for three months or both.”
