Despite the difficulties in 2008, the Chamber worked dili- gently to move forward our Policy Agenda by working with a whole host of Public Councils and Working Groups under the Cabinet of Ministers and the . Our Policy Team, our Chamber Committees, and a number of issue- specific Working Groups continued the earlier positive trend of growing in size and strength in 2008. We look forward to continuing this positive trend in 2009 and beyond for the benefit of Ukraine and our Membership. I would like to thank the many Members, who have taken an active role in our Committees and Working groups, so as to ensure that the information, opinions, and advice, which we provide to policy makers, are professional and relevant. Without our Members' active involvement, the Chamber's lobbying and advocacy initiatives would not be so successful. The Chamber has also aggressively expanded the value-added benefits that we provide to our Members, in addition to advocacy and lobbying, in the spheres of Networking and Information Dissemination through a wide variety of new Dear Chamber Members, targeted events and publications.

Dear Chamber Members,

The end of 2008 ushered in a global financial crisis that was coupled with ongoing political turmoil, which left the Chamber's Membership unsure of what the future holds. This uncertainty has raised the importance of the role that the American Chamber of Commerce in Ukraine plays as a "Key to your Success". As we look back on a successful year for both the Chamber and Ukraine, the unfortunate problems that arose at the end of 2008, whose implications are still unfolding as I pen this address, are yet to be fully under- stood.

Despite this uncertainty, we at the Chamber are focusing our efforts on ensur- ing that the organization remains relevant and value-added during these diffi- cult times by being nimble and adjusting to the needs of our Membership as the business, investment, and political landscape changes. We are proud of what we accomplished in 2008, and those accomplishments are presented in the subsequent pages of our Annual report. We will continue to focus on the future, doing what we can to help our Members to weather the storm, to identify new opportunities, to protect their interests through focused lobby- ing and advocacy efforts, to provide quality segmented Networking opportu- nities, as well as, to serve as strong information platform helping all of our Members to succeed. Throughout 2008, despite the ongoing political turmoil, the Chamber Policy Team in conjunction with the Board of Directors and interested Members were successful in advocating for many positive changes that impacts both the domestic and international business community for the benefit of the Chamber Membership and ultimately Ukraine making the country more competitive in the global arena. Ukraine's Accession to the World Trade Organization

In the past and throughout 2008 the Chamber Board of Directors, Policy Team in conjunction with many Committees, Working Groups and fellow Members worked diligently to advocate for Ukraine's accession to the World Trade Organization through the adoption of many impor- tant pieces of legislation and took an active role in assisting to our Member Companies in understanding the impact of WTO accession in regards to tariff policies and issues relat- ing to standardization requirements.

The Chamber, in conjunction with the Association of Pharmaceutical Research and Development, was pleased to invite Members of the IPR and Healthcare Committees to participate in the Roundtable discussion with Judges of the Judicial Division on Consideration of IPR Cases of the Supreme Economic Court. The discussion was dedicated to intellectual property rights protection in the pharmaceuti- cal industry and gathered representatives of international pharmaceutical companies. It was agreed that the Chamber Healthcare and IPR Committees would support the Supreme Economic Court in its request to bring the Cabinet's of Ministers Resolution # 376 and Ministry's of Healthcare Order # 426 into accordance with the Law "On Pharmaceuticals" by sending the relative letters to the Cabinet of Ministers. In addition, it was decided to work on

The Draft is seen as very controversial and the Committee Members are concerned with its development. It was decided to include the issue in the Agenda and to arrange a conversation with the developer of the Draft Order.

Chamber IT Committee was pleased to host a meeting with Mr. Olexiy Kozhenkin and Mr. Ihor Lisitsky, representatives of the Information Technologies of Ukraine Association and main concept developers of the Draft Order of the Cabinet of Ministers of Ukraine "On approval of the concept of development of national computer software industry of Ukraine until the 2017". The speakers were welcome to present their point of view on that issue, including:

 adequate financing of the project in terms, meaning inclusion of the needed amount of money into the State Budget 2009;

Mr. Kozhenkin explained the reasons and prehistory of the Concept and answered a number of questions raised by the Chamber Members. The Concept includes regulation of the problematic issues, faced by the Association members dur- ing their work and proposals on the involvement of the State in order to ensure Ukraine's competitiveness on the world markets. Chamber Members stated that the Concept may face some problems with the approval by government authorities because its bases are not judicially feasible and there are no specific steps taken towards further develop- ment of the software sphere.

Chamber Members expressed their readiness to support the Concept and to be involved in the activities of the Working Group. The Chamber will continue to cooperate with the representatives of the Information Technologies of Ukraine Association on the development of the Concept and agreed to prepare a letter with Concept amendments to be sent to the Association.

The winners of the Tournament were: 1st place: Winner Imports Ukraine 2nd place: Kyivstar GSM JSC The Chamber invited all interested Members, with their 3rd place: Microsoft Ukraine, LLC families and friends, to participate in the 2008 Chamber Paintball Tournament that was organized under the Primary Partnership of Burn Energy Drink in cooperation with Chamber Member Gepard Paintball Club. All participants and their supporters enjoyed a wonderful sunny day out- side playing paintball, using the climbing wall, cooling off with an exciting game of water soccer, enjoying tasty snacks and cold beverages with the excitement of a fast action paintball tournament. The teams all exhibited good sports- manship and were highly competitive having fun and build- ing strong bonds among their teams and interacting with their colleagues from other Chamber Member companies.

In spring the Chamber continued its series of Special Family Projects - "Unknown Ukraine" - with a fascinating trip to the first in Ukraine Museum of the Folk Architecture. It is situated in Pereyaslav-Khmelnytsky and has big exposition of village houses of different epochs, instruments, utensils, things from smithy, collection of mills of XVIII century and other unique exhibits. Independence Day Picnic

On July 5th the Chamber of Commerce in Ukraine organized another successful Annual Charitable American Indepen- dence Day Picnic this year at Spartak Stadium. Although the

morning sky did not look promising, the Picnic's theme of SUN & FUN did become a reality. The event was held to strengthen the values of democracy and freedom, as well as friendship and cooperation among nations. All proceeds from the event went to charity and were distributed to worthy projects in dif- ferent regions of Ukraine through the UCAN foundation.

The 2008 Picnic brought together thousands of people who enjoyed a real American Picnic right here in Ukraine. Guests experienced great live entertainment and a spectacular fire- works show as well as having an opportunity to participate in all kinds of games and contests, while enjoying a beautiful sunny day with friends and family.

On January 31st the Chamber hosted the first large gather- ing of Members in 2008 during the Members Appreciation Reception and Discount Card Presentation, a great Networking event that gathered hundreds of Chamber Member Company representatives as well as the diplomat- ic and donor community who Networked with fellow deci- sion makers and enjoyed the reception.

During the event the Chamber introduced the new 2008 Board of Directors, recognized the Chamber 2008 Official Service Providers, presented the highly sought after Black Captains of Industry (COI) and Silver Discount Cards and new 2008 Membership Directory, created in conjunction with Chamber Members Niche Media Group Ltd. and Miratech.
