Capital punishment and mathematics in Lebanon

In 2004, the European Union and several other organizations opposed the death penalty carried out by the Lebanese government against three persons convicted of murder. Since that date, Lebanon has frozen the implementation of its capital punishment law. Yet, following several murders recently, calls for the reactivation of this penalty have emerged. This article was first written and published in July 2004 (The Monthly, issue number 20) and we are re-publishing it as it shows the absurdity of Leba- nese sectarian system.

The capital punishment law in Lebanon will be discontinued, and very soon. This eventuality will not occur, however, as a result of the current debate between the law’s supporters and opponents. It will not stem from any philosophical, religious or other awakening by the country’s legislators, nor will it be a conse- quence of pressure from the European Union or human rights activists. Rather, the death penalty will be removed because it will threaten the survival of Lebanon’s sectarian system.

It is both interesting–yet sickening–that the first question asked by many is not the usual why, what, when, where and how, but what sect does the condemned belong to? In order for the death penalty to continue, murder in Lebanon will have to be committed proportionately by people belonging to all its sects and the sentences passed must be equally meted out ‘at par’ with the number of people belonging to each sect. With a total of 18 sects in Lebanon (six of them ‘main sects’), mathematics and the laws of probability render the continuous implementation of the death penalty impossible.

Once again, as in other fundamental matters–such as the causes of the civil war, the electoral law, the Lebanese University or corruption–the Lebanese will be spared the agonizing soul-searching debate about the death penalty and its legitimacy. The sects of Lebanon will take care of that job. So, the Lebanese are left with two choices: either change the sectarian system or the laws of mathematics. “And that’s the way it is folks.”

Companies, Lebanese individuals, countries, and international organizations grant the Lebanese government donations of around LBP 75 billion. The majority of these dona- tions are directed to the military forces, namely the Internal Security Forces and Leba- nese Army. In 2016, 315 grants and donations were provided to the Lebanese govern- ment. They were distributed to government entities as provided for in Table No.1. Table No.2 shows the grants and donations to the Lebanese government in 2016 by do- nors and recipients. 6 Leader Donations to the Lebanese government in 2016

Legal Acceptance of Donations Article 52 of Public Accounting Law stipulates: “The funds offered to the state by natural and judicial persons are accepted by virtue of a decree taken by the Council of Ministers and recorded in the revenues section of the budget. If these funds have a specific way of use, correspondent credits of the same amount are opened in the expenditures section.”

In its first article, legislative decree No.64/77 stipulates that: “The donations granted as assistance to the public adminis- trations, public institutions and municipalities are exempted from all duties, namely customs and financial, municipal, and port duties.”

According to the Value Added Tax Law, such donations are exempted from the value added tax (VAT), and according to the Customs Law, they are exempted from customs duties.

The largest donation received by the Lebanese Army was worth LBP 24 billion, intended to revamp and equip the 1st and the 2nd land border regiments in order to help them monitor the border with Syria. It was granted by the United States government. The General Directorate of Internal Security Forces Southern Regional Command received 26 donations amounting to LBP 556 million, including 19 cars and 17 motorcycles. Walid Francis granted 15 donations to the Lebanese Army valued at LBP 2 billion, including 90 cars and jeeps of different types and models. Eighty-six donations came from international donors, while 228 were from Lebanese.

GRADE 1 POSTS IN LEBANON 157 POSTS MONOPOLIZED BY THE ZUA’AMA OF SECTS

By definition, public service jobs serve society and improve the various services provided to citizens by the state. In Lebanon, however, they are monopolized by the Zua’ama of the 18 Lebanese sects. The politicians distribute public service jobs among their unqualified supporters, turning them into polit- ical and sectarian protectorates that cannot be prejudiced or held accountable. The Taëf Agreement stipulates that the principle of sectarian representation in public service jobs is to be cancelled with the exception of Grade 1 posts, which are to be distributed equally between Muslims and Christians without reserving any particular job for any sect.

The equality was respected, but the Zua’ama of sects continue to hold sway over these posts. In point of fact, Maronite posts are divided between the President of the Republic, the Free Patriotic Move- ment, , and Marada Movement. The Sunni share goes for Prime Minister Saad Hariri, the Shia’a share for Amal Movement, Speaker and , and the Druze share for MP Walid Jumblatt. 21

95 ASSOCIATIONS HAVE A "SOCIAL WELFARE" STATUS:

SECTARIAN AND POLITICAL QUOTAS

Lebanese NGOs, which number more than 7,000, are classified into various types and levels. Some of them lack the minimal potential required and their existence is only limited to the factual certificate, while others are very active and receive huge funding (part of which are state funds). Indeed, the most important, powerful and effective of all are the 95 NGOs that have gained a special decree granting them the so-called "social welfare" status.

"Social Welfare" Status An association is licensed by a factual certificate issued by the minister of interior and municipalities, while the sta- tus of "social welfare" is granted to an association through a decree issued by the government in line with a request submitted by the association to the Ministry of Social Affairs.

Legislative Decree No. 87 dated June 30, 1977 (and its amendments) stipulates that a "social welfare" association is any association or institution that seeks to fulfill any of society’s needs.

Based on the decree, the status can be granted as long as an association meets the following conditions: It should be a non-profit association with goals targeted toward social and public-service sectors. It should offer comprehensive and sustainable services. It has been operating for more than three years. It dedicates its full resources to achieve its goals. It comprises skilled and specialized members. It shelters or takes care of orphans facing difficult conditions. It offers health care and hospitalization in charitable dispensaries.

Characteristics and Benefits "Social welfare" associations benefit from aid and exemptions stipulated in the legislative decree, such as: Aid and assistance granted by the government, municipalities and public institutions. Exemption from taxes and fees. Exemption from transportation fees or any other fees and taxes imposed on grants received by the association, including municipal taxes.

Supervision over "Social Welfare" Associations According to the decree, "social welfare" associations are subject to supervision by the Court of Audit. The decree also stipulates the creation of a supervisory committee, which looks into annual reports submitted by the associ- ation and which includes the latter's activities, achievements and budget. The committee’s term is three years. It is headed by a president (which must be a current or former judge), two members representing the Ministry of Finance and the Ministry of Social Affairs, an expert in social affairs, and a representative of "social welfare" asso- ciations.

The president receives LBP120,000 and committee members LBP100,000 for each session held outside official work- ing hours. (The decree stipulating this allowance also states that the number of sessions outside official working hours should not exceed five per month.)

Numbers of "Social Welfare" Associations The number of licensed NGOs in Lebanon in 2017 amounted to around 7,000, of which only 95 are "social welfare" associations. However, legislative decree no.87/77 stipulates that associations which already received the "social welfare" status before the issuance of the decree should renew their applications. Since not all associations have submitted applications, only 95 have been granted this status, as shown in the following table. As we can see, most of these associations follow political or sectarian authorities and are not independent civil associations. This political and sectarian affiliation provides them with the needed coverage to perform their actions and meet the goals of the authorities set by the authorities they are working with, whilst taking benefit from donations, exemptions and privileges granted to them by the Lebanese government. 35

CDR AFTER 40 YEARS USD 11 BILLION OF PROJECTS

In 1977, after the election of Elias Sarkis as president and the formation of a new government under the leadership of Dr. Salim Hoss, officials wrongly believed that the Lebanese war was over. They decided to establish the Council for Development and Reconstruction (CDR) to rebuild what had been destroyed and to economically and socially jump-start Lebanon. 41

What is the CDR? What are its role and tasks? What achievements and projects did it make? How much money did it spend? Did it fulfill its goal?

Creation of CDR The CDR was created by virtue of legislative decree No.5, dated Jan. 31, 1977, which describes it as “a public institution with financial and administrative autonomy and which is directly accountable to the Council of Ministers.” The decree also stipulates the abolishment of the Ministry of Public Planning.

Tasks According to the decree, the council has many important and diverse tasks, including the following: Draft a general plan, subsequent plans and reconstruction and development programs, and propose economic, financial and social policies in tune with the general plan in the framework of specific development goals that must be approved by the Council of Ministers. Outline a draft budget to implement the general plan. Propose reconstruction and development bills. Outline a general guidance framework for civil regulation and get the approval of the Council of Ministers. Advise the Council of Ministers on economic and financial relations with states and bodies. Prepare and promulgate statistics related to all aspects of economic and social activity. Request that all ministries, public institutions and municipalities prepare projects that conform to the general goals of reconstruction and development. Provide suggestions for the formation, development and guidance of financial institutions and private/public companies involved with development. CDR has the right to sign deals for domestic and external loans, which can also be in the form of bonds. The government can sponsor CDR’s loans. CDR has the right to lend money to public institutions and municipalities. In 1983, the CDR was given the right to con- struct in every area affected by hostilities or natural disasters. Amendments The CDR’s founding law underwent many amendments, of which two are essential:

Amendment by virtue of Law No. 117 dated Dec. 7, 1991, which authorized the establishment of real estate compa- nies (with the intention of establishing Solidere Company). Amendment by virtue of Law No. 247 dated Aug. 7, 2000 and amended by Law No. 295 dated April 3, 2001. The latter law stipulates expanding CDR’s role and merging it with Council for Development Projects and the Council of Greater Beirut Projects. However, this integration was only partially implemented as the CDR’s board of directors refused to incorporate the employees of both councils into the CDR.

Supervision over the CDR Article 12 stipulates that the CDR is subject to the Audit Bureau’s supervision.

The members are appointed by a decree issued by the Council of Ministers. They include a president, two vice presidents and a secretary-general, who together man- age the CDR’s office. These members are full-time employees appointed for a five-year term. As for the part-time members, they are appointed for a three-year term. The council also has a government commission that follows up on its work.

As customary, the president of CDR is a Sunni Muslim and its members are distributed among the other sects. Table No.1 below shows that the CDR has had eight boards of directors since its establishment.

This budget soared from LBP 6 billion in 2000 to LBP 38 billion in 2017. Table No.2 below shows the evolution of CDR’s administrative budget (2000-2017).

According to the previous issue of the magazine (issue 167) that tackled “Lebanon’s Public Works Projects 2007-2017” sub- ject, the highest number of projects (115 projects) amounting to USD 1.9 billion was implemented by the CDR. In the same vein, the total value of projects implemented or under implementation during the period of 1992-2016 is USD 10.9 billion including: USD 7.5 billion for implemented projects USD 3.37 billion for projects under implementation

They were distributed among 13 ser- vice sectors and the largest share was for the transport sector (road construction, highway construction, etc), representing about 30% of the total value of projects. Table No.5 below shows how the projects were distributed by sectors.

A Sample of CDR’s Projects In order to implement its high-cost projects that should be of high quality as they are well studied and controlled, the CDR adopts a multi-stage mechanism. However, the opposite is sometimes the case. The only difference between these projects and those implemented by the ministries is their high cost.

The following is a sample of some CDR’s projects:

Construction of a parking lot in Tripoli: This project was cancelled before implementation. Its total cost is USD 19 million. Preparation of the study: USD 478,500. The cost of technical supervision of the study audit is USD 30,000. Project works: USD 17,431,609 Project supervision: USD 610,106 Technical supervision: USD 52,294

The CDR has replaced many ministries and been granted great powers. Yet, its achieve- ments and aspirations have been disappointing and made most of the Lebanese pay tribute to the work of ministries. 49 Distribution of Projects The value of projects implemented during the period 1992-2008 amounted to USD 9,310 million, of which USD 7,529 (81 percent) were acquired by the CDR. The remaining projects were distributed to the following:

Council for South: USD 683 million (7.3 percent) Ministry of Public Works and Transport: USD 371 million (4 percent) Ministry of Energy and Water: USD 366 million (3.9 percent) The Central Fund for the Displaced: USD 267 million (2.8 percent) Électricité du Liban: USD 76 million (0.8 percent) Beirut and Mount Lebanon Water Establishment and South Lebanon Water Establishment: USD 18 million (0.2 percent).

Correction- Dar Al-Handasah-Shaer acquired three projects from CDR In the last issue of “The Monthly” magazine (issue number 167, April 2017, page 21), the three project s of consul- tant Dar Al-Handasah Shaer and partners were counted with the projects of Dar Al-Handasah Nazih Taleb. Accord- ingly, the total number of projects of Dar Al-Handasah Nazih Taleb should be 21 instead of 24. Thus, what we have mentioned in the table, i.e. the consultant Dar Al-Handasah-Shaer acquired three projects from CDR, is the correct information. We do apologize for this mistake.

DEIR SERIAN: NO MONASTERY, NO SYRIAC, BUT SHIA’A

Deir Serian is a village in the Qada’a of Marjeyoun. Its name suggests that it is a Christian village, yet, in fact, it is Shiite.

Etymology Many centuries ago, the inhabitants of Deir Serian belonged to the Christian Syriac sect. They build a great monastery there, Road Tripoli lending the village the name “Deir Serian” (Syriac Monastery).
