BACKGROUND
Namaqua Nickel Mining (Pty) Ltd (NNM) submitted a Mining Right Application (MRA) (Ref No. NC 30/5/1/2/2/10032 MR) to the Department of Mineral Resources (DMR) in 2013 to mine Nickel (Ni), Copper (Cu), Cobalt (Co), Gold (Au) and Platinum Group Elements (PGE) mineralisations (underground) on various properties just south-west of Putsonderwater, and approximately 70 km east northeast of Kenhardt in the Northern Cape Province (Refer to Figure 1).

A number of studies have previously been undertaken related to the deposits which included one undertaken by Anglo American in 1980 and a further pre-feasibility study undertaken by Gencor in 1991. NNM has undertaken further drilling on the deposit and has conducted geological and geostatistical studies based on the additional data from the drilling programme.
PROJECT DESCRIPTION
The proposed Jacomynspan Mining Project is located within the Siyanda District Municipality (DC 8) and the majority of the project area falls under the !Kheis Local Municipality (NC 084) in the Northern Cape Province. The project area is located within the Lower Orange Water Management Area (WMA) (WMA No. 14) and also falls within the D53A, D53B, D72C and D73C quaternary catchments. The proposed project area is also traversed by the non-perennial rivers Rooiput se Leegte and Mottelsrivier (refer to Figure 2). The Orange River is approximately 35 km to the east of the MRA boundary.
The proposed project development footprint area was chosen after a High-Level Environmental Sensitivity Analysis of the greater Jacomynspan MRA. During the analysis various environmental factors were included, such as the analysis of surface water, groundwater, biodiversity, soils and historical significance of the area. The area has been located as close as possible to the mineral resource but also taking into account the sensitivity of the area and the non-perennial rivers.

The Jacomynspan Mining Project will be an underground mining operation with ancillary infrastructure on surface for the processing and transportation of Nickel (Ni), Copper (Cu), Cobalt (Co), Gold (Au) and Platinum Group Elements (PGE). Mining underground will involve longitudinal sub-level caving with delayed draw down of the ore.
Mineral processing will involve crushing, ball milling, flotation, thickening and filtration of the flotation concentrate, and thickening and pumping the tailings to the tailings dam. The metallurgical plant design has been based on similar plants treating nickel ores to produce a flotation concentrate. The flotation concentrate will be transported from site via rail or road.

The infrastructure required for the proposed Jacomynspan Mining Project includes but are not limited to: • Surface Infrastructure: o Process Plant; o Offices; o Workshops; o Clinic; o Stores and bulk fuel bay for diesel; o Change house and laundry facilities; o Cap lamp, self-rescuer and Proto equipment storage and control; o Sewage treatment and disposal; o Core yard; o Fire prevention systems; o Waste rock dump; o Tailings Storage Facility; • Water: o Bulk water supply from the Boegoeberg Dam (not finalised); o Surface storage and reticulation of raw and potable water; o Underground supply reticulation; o Dirty water pumping and settling; o Pollution control systems; • Electricity: o Bulk power supply from Eskom (12MVa); o Powerlines (11kV); o Surface electrical reticulation; o Underground electrical reticulation; o Stand by generators; • Civils: o Road upgrade for access to the property and internal roads and parking areas; o Storm water culverts and a catchment dam; • Underground infrastructure: o Potable and fire water distribution; o Compressed air distribution for emergencies; o Rescue chambers; o Main ventilation fans; o Underground workshops; o First aid facilities; and o Headgear, portals, declines and vent fans.
It should be noted that the project is still within its early planning phases and changes may result during the Environmental Scoping Phase. Should any deviations in information from what is presented in this BID take place, all registered I&APs will be informed in writing of such changes.
PROPOSED SPECIALIST INVESTIGATIONS
The specialist investigations listed in Table 2 are currently being undertaken for the proposed development (in terms of the MPRDA, NEMA, NEMWA and the NWA).

REGULATORY CONTEXT
The environmental authorisation processes are being run in parallel as far as practically possible to streamline the process in terms of the required stakeholder consultation associated with each authorization process. Accordingly, the following environmental authorisation processes and stakeholder engagement processes will be undertaken concurrently for the Jacomynspan Project: • Environmental Authorization in terms of the MPRDA; • Environmental Authorization in terms of the NEMA; • Waste License Application under NEMWA; and • Water Use License Application in terms of the NWA.
The regulatory context for the proposed project is summarized in Table 3.

THE NATIONAL ENVIRONMENTAL MANAGEMENT ACT (NEMA) Section 24(1) of NEMA requires that the potential consequences of, or impacts on, the environment of undertaking listed activities must be considered, investigated, assessed and reported on to the competent authority. Where environmental impact assessment has been identified as the instrument to be utilised in achieving the aforementioned, an application for environmental authorisation needs to be obtained. The identified activities are listed under Government Notice (GN) R544, R545, R546 and R547 of the NEMA Regulations respectively.
The listed activities (refer to Table 4) which are triggered by the proposed mining operation are contained in Listing Notice 1 (GN R544) and Listing Notice 2 (GN R545). Activities contained in Listing Notice 1 require a Basic Assessment (BA) process to be followed whilst activities in Listing Notice 2 require a Scoping and EIR (S&EIR) process to be followed. For the purposes of this application, all items listed under Listing Notice 1 will be addressed in the required EIA process applicable to proposed Listing Notice 2 activities. THE MINERAL AND PETROLEUM RESOURCES DEVELOPMENT ACT (MPRDA) The environmental authorisation process, required in terms of the MPRDA, considers the project as a whole including all activities related to the proposed Jacomynspan Project. The EIA/EMP developed in terms of the MPRDA will address all the environmental impacts and proposed management measures associated with the proposed mining operation, as well as provide background on the current environmental conditions on site.
In terms of Section 39(1) of the MPRDA, every person who has applied for a mining right in terms of Section 22 must conduct an EIA and submit an EMP within 180 days of the date on which he or she is notified by the Regional Manager to do so. There also rests an obligation on the applicant to notify and consult with interested and affected parties within 180 days from the date of the notice. NNM is required to conduct an environmental assessment for all new activities in terms of the Jacomynspan Project and submit a Scoping Report and EIA/EMP to the DMR in the Northern Cape for authorisation. THE NATIONAL WATER ACT (NWA) The NWA stipulates that activities which have the potential to impact on a water resource and which do not constitute Schedule I water uses (e.g. abstraction of groundwater for domestic use in a household); cannot be authorized in terms of the General Authorization notices; or which are not existing lawful water uses require authorization by means of a water use licence (WUL) issued by the Department of Water Affairs (DWA). In accordance with the requirements of the NWA, an Integrated Water Use License Application (IWULA) will be compiled for the Jacomynspan Project and submitted to the DWA to ensure the legality of the identified water uses associated with the proposed operation.
The water uses, in terms of Section 21 of the NWA, which may be applied for by in respect of the operation include the following: • Section 21(a) - Taking water from a water resource; • Section 21(b) - Storing water; • Section 21(c) - Impeding or diverting the flow of water in a watercourse; • Section 21(f) - Discharging waste or water containing waste into a water resource through a pipe, canal, sewer, sea outfall or other conduit; • Section 21(g) - Disposing of waste in a manner which may detrimentally impact on a water resource;

• Section 21(i) - Altering the bed, banks, course or characteristics of a watercourse; and • Section 21(j) - Removing, discharging or disposing of water found underground if it is necessary for the efficient continuation of an activity or for the safety of people. THE NATIONAL ENVIRONMENTAL MANAGEMENT: WASTE ACT (NEMWA) NEMWA refers to the application of a waste management licenses (WML) for all waste activities related to general and hazardous waste on site. The listed activities are divided into two categories (Category A and B) for different sizes of activities. The application process and listed activities refers to GN R718 Government Gazette 32368 of 3 July 2009.
The identified NEMA and NEMWA listed activities that will require environmental authorization are listed in Table 4.

PUBLIC PARTICIPATION PROCESS
Public involvement is an essential part of any environmental assessment process. You have been identified as an I&AP who may want to receive information regarding the above-mentioned project. You will be given the opportunity to provide your input into the environmental assessment process. All comments will be recorded and presented to the project team and regulatory authorities. You will receive feedback on how your comments have been taken into account and the outcome of the assessment.
I&APs include any person who will be directly or indirectly involved and/or affected by the project. To be recognized as an I&AP one must register with GCS to be added to the stakeholder database for the project. You may communicate via fax, email or telephone to obtain further information or comment on the proposed Jacomynspan Project. All registered I&APs will be kept informed of the decision taken by the DMR, DEANC and DWA.
Proposed steps in the process are as follows:
Step 1: • Notify I&APs of the project proposal; Notify I&APs and identify issues • Identify any issues/concerns of I&APs; • Provide I&APs with a BID on the project, including a locality map and a Registration and Comment Sheet; and • I&APS are required to register their interest in the project to receive further project information. Step 2: • Issues and concerns raised by I&APs are contained in a CRR for inclusion in the DSR ; I&AP review of Draft Scoping • The DSR is released for a 40 day commenting period; and Report • All registered I&APs on the project database are notified in writing of the opportunity to comment. To assist I&APs with their understanding of the project, a public meeting or consultation in a similar manner , to which all I&APs are invited or will be involved, will be held during the review period. Copies of the report will be made available on the request from GCS. Step 3: • Comments received from I&APs during the review process are considered in the Final Scoping Report compilation of the FSR; and • The FSR is released for a 21 day commenting period before it is submitted to DEANC. Step 4: • Compilation and release of a DEIR for a 40 day review period. Draft EIR and EMPr for I&AP review Step 5: • The FEIR, including the CCR and Draft EMPr will be compiled for submission to DE ANC Final EIR and Draft EMPr for decision making. • The FEIR is released for a 21 day commenting period before it is submitted to DEANC. Step 6: • All registered I&APs will be notified in writing of the decision by the DEANC regarding Environmental Authorisation and the environmental authorization, being positive or negative for the project. With the Appeal Period environmental authorisation all I&APs will also be notified of the appeal period, as well as the manner of appeal. Public Notification A major part of the PPP is to notify members of the public of the proposed activities, particularly those who may be directly or indirectly affected by the proposed project. This will be achieved via the following means: • The placement of an advertisement in a regional newspaper, i.e. the DFA; • Notices, in English and Afrikaans will be placed at the site; • Distribution of BIDs to landowners and occupiers of land adjacent to the proposed prospecting area and to I&APs on request; and • Local authorities will be notified in writing and automatically registered as I&APs. All registered I&APs will be notified of the availability and until what date comments may be forwarded to GCS. GCS (Pty) Ltd, as independent environmental consultants and environmental assessment practitioners (EAP), was appointed by Namaqua Nickel Mining (Pty) Ltd to facilitate the environmental authorisation processes for the proposed mining operations on various properties just south-west of Putsonderwater, and approximately 70 km east northeast of Kenhardt in the Northern Cape Province. Namaqua Nickel Mining (Pty) Ltd submitted a Mining Right Application (MRA) (Ref No. NC 30/5/1/2/2/10032 MR) to the Department of Mineral Resources (DMR) in June 2013 for the approval of mining activities on various portions of the farms Jacomynspan 176, Hartebeest Pan 175, Rok Optel 261 and Farm 387.
The proposed Jacomynspan Mining Project is located within the Siyanda District Municipality (DC 8) and the majority of the project area falls under the !Kheis Local Municipality (NC 084) in the Northern Cape Province. The project area is located within the Lower Orange Water Management Area (WMA) (WMA No. 14) and also falls within the D53A, D53B, D72C and D73C quaternary catchments. The proposed project area is also traversed by the non-perennial rivers Rooiput se Leegte and Mottelsrivier.
The Jacomynspan Mining Project will be an underground mining operation with ancillary infrastructure on surface for the processing and transportation of Nickel (Ni), Copper (Cu),

Cobalt (Co), Gold (Au) and Platinum Group Elements (PGE). Mining underground will involve longitudinal sub-level caving with delayed draw down of ore.
Environmental Authorisation Processes The proposed Jacomynspan Mining Project will entail the environmental authorisation process, required in terms of the Mineral and Petroleum Resource Development Act, 2002 (Act No. 28 of 2002) (MPRDA). The Environmental Impact Assessment (EIA) and the Environmental Management Programme (EMP) developed in terms of the MPRDA will address all the environmental impacts and proposed management measures associated with the proposed mining operation, as well as provide background on the current environmental conditions on site as required in Section 39(1).
The listed activities which are triggered by the proposed Jacomynspan Mining Project are listed under Regulations R 544, R 545 and R546 associated with the National Environmental Management Act, 1998 (Act. 107 of 1998) (NEMA), and as such require an application for an Environmental Authorisation in the form of an Environmental Impact Assessment (EIA) process. All activities under Notice 1 GN544 which requires a Basic Assessment (BA) will be included as part of the full EIA process. The NEMA listed activities that will be applied for are under Listing Notice 1 GN 544 are 9, 11, 12, 22 and 55A; Listing Notice 2 GN 545 are 3, 5, 8, 10, 15, 18 and 20; Listing Notice 3 GN 546 are 14 and 19.
According to National Water Act (Act No. 36 of 1998) (NWA), water may not be used without prior authorisation from the leading authority, in this case the Department of Water Affairs (DWA). Therefore an Integrated Water Use License Application (IWULA) will be compiled and submitted to the DWA to ensure the legality of the Jacomynspan Mining Project water uses. The IWULA will be conducted in parallel to the EIA and EMP process for any activity in terms of Section 21 of the NWA. Water uses that may be applied for include Section 21 a, b, c, f, g, i and j.
Environmental Scoping Report The Environmental Scoping Report (ESR) has been compiled in accordance with the Mineral and Petroleum Resources Development Act, 2002 (Act No. 28 of 2002) (MPRDA). The ESR can be downloaded from the GCS website ( www.gcs-sa.biz ) by registered I&APs. Before the report will be made available, the stakeholder must register with GCS (Pty) Ltd. A stakeholder can also request a CD form GCS (Pty) Ltd to receive a copy of the ESR. The report will be available at the above listed venues and on the website from 10 February 2014 until 10 March 2014.
