Executive Summary

The purpose of the Semi-Annual Environmental Monitoring Report is to provide a summary of the environmental management and monitoring of the project for the past six (6) months. The report includes updates on project progress, status of EMP implementation, environmental management measures, environmental monitoring results, and non-compliance and corrective actions and Grievance Redress Mechanism (GRM) implementation and monitoring. The Semi-Annual Environmental Monitoring Report is a summary report. The details of the information contained herein are contained in the monthly reports as well as the other environmental requirement submissions of the Contractors.

Construction Supervision Consultant and the UPMO on the compliance of the contractor. The SEMR summarizes the monitoring and its compliance and highlights issues and corrective measures when necessary undertaken during the reporting period.

The monitoring was conducted on the prepared environmental monitoring plan. SEMR summarized all the activities of the contractors based on the EMPs that has been monitored within the reporting period of PR 06, 07 and 09. To keep track of the activities of the contractors based on the cleared EMPs, this was monitored and documented monthly to determine and assessed their compliances. CEMPs for the three subprojects have not been cleared yet during the reporting period. The roles and responsibilities on the monitoring was based on the existing IEEs for each core sub-projects The monitoring report has determined the performance of relevant parameter for the given month assessed against requirements of the monitoring matrix. The report presents the management of generated waste and emission and resolving issues and complaints. In accordance with the requirements of this Semi-Annual Report (SEMR) of the Contractor, will create and maintain a database and safe keep all records for the inspections. Such records include as listed below: a.) Regulatory documents (e.g. permits and licenses, landowner agreements, compensation payment records, etc.); b.) Environmental management plans, induction, toolkit meeting and training records, baseline environmental data, monitoring data, checklists, etc.; and c.) Record of Daily Camp Logbook (EO/HSO/PRO), Consultation records, including meeting notes, attendance sheets and consultation photos. d.) All activities to be properly documented such as Minutes of Meeting, Attendance Sheets and photos that will be imbedded with dates.

Checking and Corrective Actions:

An environmental baseline has been conducted in order to determine the current conditions of the area in terms of air quality, noise level and stream water quality and how the project needs to be implemented. Second, it helps assess and predict the possible environmental changes once the project is ongoing.

Regular monitoring will be undertaken and project’s environmental performance and its associated activities including quarry operations will also be monitored. Environmental monitoring results will be documented and reported in the monthly report. In addition to the environmental monitoring, the following inspections and audits will be undertaken: Daily and weekly inspections on the construction sites and any installed pollution control devices (such as sediment traps, muffler, etc.). Weekly audits

In the event of spills and/or any untoward environmental degradation/negative impact, corrective measures will immediately be implemented. Furthermore, air, noise and/or water tests will be conducted in case of complaints with respect to adverse impact to the community. Comparative results will be equated to the baseline. Regular monitoring will be undertaken and project’s environmental performance and its associated activities including quarry operations will be monitored, against the baseline. Environmental monitoring results will be documented, and data collected will be checked by relevant environmental representatives of DPWH and ADB against relevant criteria. In addition to the environmental monitoring, the following inspections and audits were undertaken: 1. Daily inspections of construction sites as per the EMP/CEMP variables by the Environment Officer; 2. Weekly inspections of the site and installed management devices (such as sediment traps, mufflers, etc.); 3. Weekly audits of hazardous waste generated; and 4. Routine monitoring of waste management practices and facilities to ensure compliance with the requirements of the EMP/CEMP.

The issues, recommendation and action plan are shown below for the covering reporting period.

The project has been financed under the Asian Development Bank Loan No. 3631-PHI, to improve national primary, secondary and tertiary roads and bridges in Mindanao, Philippines. The project is intended to strengthen economic and physical linkages in Mindanao and support regional co-operation and integration.

A. Purpose and Scope

A.1. Project Objectives

(i) Increased economic growth in Mindanao, by opening and improving its infrastructure logistics road and bridges; (ii) Support the country’s priorities to improve the overall national Government’s agenda for Mindanao as set out in the “Ambisyon Natin 2040”; (iii) Achieve high, inclusive, and sustainable growth (iv) Improve the delivery of infrastructure services as well as investing in physical assets; (v) Support regional cooperation and integration by contributing to the implementation of the ASEAN Highway and Brunei Indonesia Malaysia and the Philippines – East ASEAN Growth Area (BIMP-EAGA) Priority Infrastructure Projects; (vi) Support sustainable transport initiative by addressing climate change and road safety; (vii) Contribute to ensuring resilience in the road infrastructure development in Mindanao; and, (viii) Improve the Department of Public Works and Highways’ (DPWH) capacity in procurement, construction supervision and implementation of social and environmental safeguards.

B.2. Scope of the Project

The project will improve an estimated 169 km total gross length of national primary, secondary, and tertiary roads and bridges in Mindanao. The improvements will include paving earth roads, replacing damaged road sections, widening existing roads, adding surface overlays, and replacing and strengthening of existing bridges. The project roads will be designed with features to strengthen resilience to climate change. Among the structural and non-structural features included are elevated pavement levels, enhanced slope protection, and improved maintenance of drainage structures. Road safety on these roads will be improved through road safety community awareness campaigns. Three core roads located in the in western Mindanao (Region IX), with a total gross length of 80 km, have been appraised for inclusion in the project. Consultants for the ongoing ADB-funded project prepared the detailed design for the core roads and will prepare the detailed design for the non-core roads. The government will propose additional roads, which will have to meet the following criteria to be included in the project: location in Mindanao, and thresholds of the government and ADB on economic viability and environmental and social safeguards.

C.Purpose and Objectives of the Semi-Annual Monitoring

The purpose of the Semi-Annual Environmental Monitoring Report is to provide a summary of the environmental management and monitoring of the project for the past six (6) months. The report includes updates on project progress, status of EMP implementation, environmental management measures, environmental monitoring results, and non-compliance and corrective actions and Grievance Redress Mechanism (GRM) implementation and monitoring. Consolidate the results of the monthly monitoring into semi-annual environmental monitoring reports for submission to ADB.

C.1. The objectives of the Semi-Annual Environmental Monitoring Report include the following but not limited to the following: a. Inspect and evaluate all Contractor’s work schedule or revision and any such as housing, workshops, warehouses, and other accommodations to ensure compliance with the terms and conditions of the contract documents. b. Ensure compliance with core labor standards, including equal pay for work of equal value and non-use of child labor. c. Inspect the safety and environmental aspects of construction works methods to ensure that all reasonable measures have been taken to protect life, environment, and property. d. Supervise the preparation of efficient traffic management and safety schemes by the Contractors for approval of concerned government agency(ies) during the construction period. The Consultant shall review the traffic management plan prepared during the detailed engineering design stage. In coordination with the Contractors, the Consultant shall see to it that an efficient traffic management and safety plan for the project prepared, approved by concerned agency(ies) observed and implemented accordingly during construction period. e. The Consultant shall facilitate monthly (or as needed) public meetings in conjunction with DPWH and the relevant local government units to address public concerns. f. Inspects quarries and borrow pits and crushing plants to ensure adherence to specifications. g. Monitor the compliance of the project with conditions stated in the Environmental Compliance Certificate (ECC/Certificate of Non-Coverage (CNC) and make recommendation/s on environmental mitigation measures to the DPWH and Contractor of the Project. h. Ensure that the Environmental Plan (EMP) are implemented by the proponent office. i. Ensure contractors maintain record and report on employment in civil works and on core labor standard compliance with employee data disaggregated by sex, age, minority status, and residency. j. Undertake monthly monitoring of the contractor’s environmental performance and implementation of the EMP included in the IEE prepared based on ADB SPS 2009. k. Ensure the awareness of the raising program on sexual harassment, STDs, HIV-AIDS, Malaria and other contagious diseases.

• Notice to Proceed for consultant: The consultant received the Notice to Proceed from undersecretary for UPMO operations and technical services of DPWH on May 6, 2019. • Notice to commence for contractors: The notice to commence details for each individual works contract package are set out in the following Table.

• There is a gap of the time between the NTP of the Contractors and the NTP of the Construction Supervision (CS) Consultant. The NTP of the contractor was issued on March 28, 2019 while the CS Consultant was on May 6, 2019, a difference of 39 days (April-June 2019). • While the CS Consultant has not mobilized yet, Project Director Hasim gives directive to the Project Engineers (PE) to supervise the project from March 28, 2019 until the CS consultants was mobilized. During the 39 days prior to the mobilization of the CS Consultant, the PEs is in-charge in assisting the mobilization activities of the contractor including the selection of the sites of the contractor’s camp, quarry sites, crusher sites were among others with the permission of the concerned Local Government Units (LGUs). • The CS Consultant Environmental Specialist was mobilized in June, 2019 and then made an audit of the activities on the status of the EMP compliance. One of the result of the said audit is the location of the Crusher Plant of PR 06. Ms. Gay Denaya, the CS Environmental Specialist recommended the closure of the said Crusher Plant because it was located near the ricefields and the environmental damage of the crops nearby is inevitable.

2 Project Implementation Progress

2.1 Activities During the Reporting Period

Table below were the specific activities during the period of the core projects. Other preliminary activities of the Contractor were exploring sites for quarry, disposal areas for construction waste and cut trees, crusher, and batching plants although they were preselected by the contractors prior to mobilization of the CSC. Activities of CSC upon mobilization on-site was to conduct inspection on the crusher and batching plants, campsites, construction waste disposal areas and bridges. Permits and clearances, ECCs for all facilities to include quarries (river and/or mountain) were also checked. Dir. Hasim gives directive to the Project Engineers (PE) to supervise the project from March 28, 2019 until the CS consultants will be mobilized. Some of the facilities of the contractor was already installed upon the mobilization of the PEs because there was also a delay in the issuance of the Notice to Proceed (NTP) to the contractor because of the procedural requirements in the Department, i.e. ECC of PR 06. The CSC environmental specialist conducted an assessment on the location of the contractor’s camp. UPMO conducted orientation on the Safeguards requirements on the date of the issuance of NTP. The contactor submitted all the CEMPs earlier however because of the required permits and ECCs of the batching plants and crusher plants it was returned to the contractor with comments. There was an orientation conducted to the contractor and the consultant on the Safeguards requirements, i.e. CEMP, GAD Plan, HIV/AIDs awareness, Traffic Management Plan, etc. The orientation training focused on the mitigation measures, safety health and environmental protection. The activity also discussed topics on the proper storage and disposal of garbage, waste tires and other spare parts, maintain good housekeeping and dust control. 3.1 Environmental Monitoring Procedures: DPWH is the Executing Agency (EA), while the Roads Management Cluster II (also based in DPWH) will be the implementing agency (IA). The existing Environmental and Social Safeguards Division (ESSD) of DPWH will have overall responsibility in ensuring Project compliance to Government environment requirements and ADB SPS 2009. Such task will be carried out by ESSD in close coordination with the environmental safeguard staff at the DPWH Regional Offices and Office of the District Engineer throughout project implementation. During construction phase, the ESSD will be supported by the construction supervision consultant (CSC) in conducting environmental monitoring and preparation of corresponding reports. Environmental monitoring in the field is among the scope of work of the Engineers, and the tasks of actual monitoring is undertaken by an Environmental Specialist (International and National) and Resettlement Specialist. The international environmental specialist is mobilized on an intermittent basis to undertake field monitoring and write-up the necessary periodic environmental report to the Employer DPWH and ADB. Spot surveys and assessments of environmental situations and conditions of the project site are being conducted to ascertain compliance of the Contractor to the Contractor’s Environment Management Plan (CEMP). Variances from the established baseline environmental parameters were noted and brought to the attention of the Contractor for corrective measures. Whenever necessary, certain modifications on the work program were recommended to assure compliance on the part of the Contractor.

The contractor’s environmental, health and safety Officer will be responsible for the compliances based on the project CEMP, ECC conditions and OHS Plan. Environmental issues arising from the construction activities should immediately be brought to the attention of the construction supervision team to coordinate efforts in order to immediately mitigate impacts, protect the environment, and safeguard the health and welfare of the local communities. All these are to be conducted within the framework of the overall construction management and supervision. Aspects in the environmental monitoring are reported in a monthly, quarterly and semi-annual basis to the DPWH and ADB.

3.2 Environmental Organization and Management A monthly monitoring and construction progress report will be prepared by the Contractor’s Environmental Team and transmitted to DPWH-UPMO thru the CSC. The monitoring report presents the performance of relevant parameter for a given month assessed against requirements of the monitoring matrix. Document management including storage of all records for all important environmental aspect particularly in terms of resolving issues and continuous monitoring. In accordance with the requirements, the Contractor will create and maintain a database and safe keep all records for inspections.

Equipment and vehicle will be available for the EO to use in the field during site inspection. These are some of the things that will be readily available for the Environment Officer (EO) to use and perform the delegated duties at the project site. All other essential for the EO to effectively execute the tasks assigned will be made available for the success of the project. A copy of the environmental inspection and audit shall be retained as file by the Environment Officer and a copy provided to the DPWH. Electronic records of inspections and audits will be kept. 4 GRIEVANCE MECHANISM

A subproject-specific grievance redress mechanism (GRM) will be established at the DPWH District Engineering Office (DEO) before the start of construction, to receive, evaluate and facilitate resolution of the complaints/grievances of affected persons on the sub-project’s environmental performance. This mechanism will be disclosed to the host communities prior to commencement of site works. Contact information on how to access the GRM will be included in project information billboards.

The District Engineer will appoint an Environment Officer and will establish the Grievance Redress Committee (GRC) to be chaired by the DPWH District Engineer. Members will include the following: (i) the contractor’s highest official at the site such as the Construction Manager or the Construction Superintendent; (ii) Barangay Chairperson; and (iii) Environment Specialist of the Construction Supervision Consultant. For the quick filing of complaints, the DGRC will use the grievance intake form appended in the IEE. The DEO’s Environment Officer will be responsible for the registration of grievances and communication with the aggrieved party. To facilitate addressing complaints, the contractor will be required to provide contact details of its representative(s) on site in its campsite offices and in project billboards that will be erected at the starting point of the project. The billboard shall likewise include the contact details of DPWH representatives in the event complaints are not readily addressed by the contractor on-site.

The steps to be followed in filing complaints and the procedures for redress are the following: a. complainant will provide the background and file the complaint directly either verbally or in writing to the on-site contractor representative(s), and Barangay through its officials for immediate corrective action; b. the contractor(s) representative is then required to act immediately on valid complaints and record such complaints in a complaints registry that must be maintained on site; c. complaints that cannot be immediately attended to by the Contractor shall be filed either verbally or writing to the DEO, and or the DEO’s Environment Officer who will assist the complainant in filling-up the grievance intake form; d. within 2 working days, the Environment Officer, contractor’s representative, and complainant will discuss if the complaint can be resolved without calling for a GRC meeting; e. within 3 days of lodging the complaint, the DEO’s Environment Officer will provide the complainant a written feedback on the process, steps and timeframe for resolving the complaint. f. if the complaint cannot be resolved, a GRC meeting with the complainant will be called within 5 working days; g. the GRC will have 15 days to resolve the complaint; h. the complainant will receive feedback from the DEO’s Environment Officer within 5 working days after the various steps of the GRM are completed. i. if unsatisfied with the decision, the existence of the GRC will not impede the complainant's access to the Government's judicial, administrative remedies or through concerned government agencies (e.g., Community Environment and Natural Resources Office and Provincial Environment and Natural Resources Office of DENR, Regional offices of the Environmental Management Bureau.

The GRC will receive, follow-up and prepare monthly reports on all complaints, disputes or questions received about the Project and corresponding actions taken to resolve the issues. As of this date of reporting, there were no complaints filed.

The project is being implemented and would be completed in observance with relevant norms of ADB guidelines for category B and the construction supervision as per TOR. The project has a minimal physical impact to the land, air, water and most are construction related and short- term impact such as increase generation of dust and noise levels, loss of roadside vegetation, and traffic flow disruption, these will be addressed in the CEMPs of the contractor. These impacts are considered temporary in nature and will be address through careful implementation of the environmental mitigation and monitoring plan. Presently, the three-core project has started construction works and impacts/issues were addressed and implement EMP as stated in the CEMP. The Contractor, CSC and the local populations has exchange information with regards to relevant activities under campsite location, operation and management, Health and Safety, Environmental Awareness, Recruitment of Labor for Construction Works. The project construction works are supervised by the CSC in accordance with IEE and EMP. No accidents have been reported. Corrective action is being implemented by the contractors based on site Instructions by the CSC. All the three core Project road are not located within the environmentally sensitive areas, national parks, or natural forest. In the next reporting period of SEMR, tabulated data on the recommended corrective actions will be presented with specific timelines in the implementation.

EMP Implementation Activities

During this reporting period both the International and National Environmental Specialists undertook field visits to the project sites in Mindanao. The National Expert was first to visit and formed part of the CSC team accompanying the ADB mission as reported in other sub-Sections of this report. The purpose of these missions was primarily twofold in order to i) ascertain the capacity and preparedness of the works Contractors to implement their contractual obligations in respect of Environmental Management; and ii) to provide practical “hands-on” assistance, advice and on-the job training as appropriate, to the Contractors nominated Environmental Management Teams. From the delays that had already occurred in meeting the contractual requirements, it was no surprise that a large number of concerns were raised and that extensive assistance was required, particularly in respect of preparation of the CEMP, selection of sites for disposal etc., and implementation of baseline measurement surveys. August 2019 Monthly Report During this reporting period both the SCS Project Team’s Environmental Specialists undertook field visits to the project sites in Mindanao. The primary purposes for this visit was to become familiar with the project environs, conduct and also participate in orientation sessions, presentations and meetings, and to provide “ hands-on” assistance to the core project Works Contractors, who continue to struggle with the preparation of satisfactory CEMP’s. This reporting period the first such orientation meeting and presentation was held on 29th July which was for the purpose of providing overview of the requirements for CEMP’s. The meeting was attended by senior staff from both the Consultant and the Works Contractors from each of the 3 currently active core projects. Another session was held on 31st July for management and staff of PR-06. The subject matter for this session was HIV/AIDS; Trafficking and Sexual Exploitation of Women; Gender Awareness and included an element for Health & Safety, which was addressed by the International Environmental Specialist. A site visits to the batching plant at project PR-06 was undertaken on 1st August, which raised a number of issues of environmental concern related to the close proximity of inhabited dwellings, and restrictions on the access available to residents in these dwellings.

The close proximity of the batching plant location to existing houses is a non-compliance with the requirements of the IEE for the project and the Contractor has been informed that this situation must be addressed.

The non-compliance with the requirements can be addressed by constant consultation with the community to solicit information, complaints, suggestions etc. regarding the plant’s operation. The DPWH-UPMO, CSC and the Contractor’s Environmental Officer will from time to time communicate with the host barangay (Plant location) and the Local Government Unit.

Other activities conducted during this period related to the review of the resubmitted CEMP’s, discussions regarding their suitability and assistance with the preparation of the CEMP’s in a suitable format for approval by ADB.

Baseline Measurements

The object of these baseline measurement activities is to characterize the environmental resources at a site prior to construction. This will provide a benchmark and reference against which to compare the environmental conditions influenced by the construction, operation of the plants and demobilization phases of the project. The information will also be used to assess the effectiveness of the mitigation measures and to implement adaptive management, if needed. The environmental baseline collects, assesses, and interprets enough physical and chemical except biological information since parameters for this factor exceeds its holding time from sampling point to the laboratory.

The head of the monitoring team has ensured that necessary preparations were undertaken before the field work. Each member of the monitoring team has clearly understood their role and duty to ensure the integrity of all field analyses and of the water samples to be brought to the laboratory for analysis.

Water Quality

Head of monitoring team coordinated with the Contractor’s Environmental Officer. Preparation of a monitoring plan to ensure that all the requirements for monitoring are met.

Collection of water samples were from the rivers. Since the rivers were shallow (<2.5meters) one grab sample collected from the center of the stream were considered representative of the river or stream water quality. Analyzing for parameters that were measured right away or on site were Dissolved Oxygen (DO), temperature, and pH.

BOD, Total Suspended Solid and Conductivity analysis were analyzed at Aeronics Laboratory. Pre-treatment, preservation and storage were performed prior to transport of samples. Sample for BOD analyses require rapid cooling and need cold water in addition to ice or ice packs. The transport container for the samples were leakproof.

Sample containers were provided by the laboratory to ensure that sufficient volume of samples is obtained for the planned analyses and that the containers have been properly cleaned and provided with stabilizing preservatives. Figure below shows the different types of sample containers.

For the sampling equipment, the ambient air sampler used, namely the Staflex High Volume Air Sampler Model 121-H, Compass Kimoto Handy Gas Sampler HS-7, Speedtech Instrument Barometer and Vector Portable GPS (Global Positioning Systems).

Sampling Methodologies

The test methods used were derived from the U.S. Environmental Protection Agency (USEPA), Philippine Standard Methods of Air and Water Analysis Volume 3, as prescribed in the DENR Implementing Rules and Regulations of R.A. 8749 or the Philippine Clean Air Act of 1999.

Determination of Suspended Particulate Matter in the Atmosphere (High Volume with 10-micron particle- size inlet – Gravimetric Method).

Determination of Total Suspended Particulate Matter in the Atmosphere (High Volume – Gravimetric Method).

Determination of Sulfur Dioxide in the Atmosphere (Gas Bubbler and Pararosaniline Method).

Determination of Nitrogen Dioxide in the Atmosphere (Gas Bubbler and Griess-Saltzman Reaction).

Determination of Carbon Monoxide in the Atmosphere (Gas Chromatographic Method).

The ambient air quality monitoring was performed 24 hours at an elevated of at least two (2) meters above the ground level and conducted at a downwind and upwind with the distance of 5 to 20 times the height of the stack.

The digital level meter Lutron (Model SL-4001) was used in the noise monitoring activity. This equipment is compliant with IEC 651 Type2 standard and has a weighing of 94 dBA and maximum of 130 dBA with slow and fast response.

Sampling Methodologies

The noise level measurement was conducted 24 hours at the locations near the air identified sampling stations and was performed by setting the noise meter at slow and fast response modulation with low frequency mode. The multiple sounds reading were manually recorded and summarized by getting its Average Arithmetic Median and expressed in decibel (dBA).

a.) Air quality: Results for all the sampling stations within DENR Standards.

b.) Noise level results were all above the maximum allowable noise either for Class A “Residential Area” Classifiaction and Class C “Light Industrial” Classification.

c.) Water quality: Results were all within DENR Standards for pH, TSS, and BOD5 parameters except for DO within results were slightly above the standard. The baseline information has been gathered in the field on a 24-hours ambient air quality and noise monitoring level measurement. The analysis conducted for the air, noise and water baseline was in accordance with the approved/accepted method by the Department of Environmental and Natural Resources – Environmental Management Bureau. The results will be used for internal evaluation of the actual concentration.

October 2019 Monthly Report Compliance to Statutory Requirements/Environmental Permits and Licenses Throughout this reporting period the primary activity was related to the review and final revision of the Contractor’s Environmental Management Plan (CEMP) for the 3 core projects. In cutting operations, the first consideration was always on safety. This implies that all members of the crew and the community, close supervision was observed by the CSC and DPWH.

Trees affected (within the RROW) has been marked X before cutting. The cutting was done by competent personnel outfitted with appropriate safety gear. CSC has ensured that it has valid permit cutting equipment (chainsaw) and approved Permit to Cut from DENR-CENRO (for timber trees) and Philippine Coconut Authority (PCA) (for coconut trees).

A representative from DENR-CENRO, Zamboanga Sibugay witnessed the cutting activities for timber trees. Cut timber trees were transported to a temporary designated disposal site by DENR-CENRO. Conditions in the cutting permit has been followed by the Contractor. As such, that fell trees shall be turned over to DENR and subsequently to the Department of Education who then use it for school desks and chairs. However, for non-timber trees Contractor has identified site for disposal of the trees. Cut coconut trees were used by the Contractor for false works.

Special safety precautions must be taken whenever there is a possibility that members of the public or other persons not directly involved in the felling operations might be endangered. When felling is to be done near roadways, for instance, flag person was posted on the road to halt traffic until the tree has been safely brought to the ground.

Stocked coconut palm tree trunks to be use as false works must be properly arranged and limit prolong stocking of those trunks that will serve as breeding area for mosquito.
