This chapter is intended to cover Maryland Law in its entire complexity and for the most part is intended for current use by practitioners. Whenever possible, it includes references to online sources of material, including LexisNexis, Westlaw, and authoritative sites available on the Internet. We have not included references to WestlawNext as many Maryland specific materials have not been included there as this project was concluding in November 2011.

Maryland Code Materials

The Maryland Code is a topical compilation of the Public General Laws currently in effect in Maryland. Originally published in 1957, this version is organized by numbered articles and is gradually being replaced by topical volumes. The two versions co-exist and there is one subject index for the two formats.

Topical compilation of the public general laws of Maryland currently in affect. Includes annotations to cases, references to the MarylandLawReview, University of Baltimore Law Review, commentaries and historical information. Selected numbered articles have been removed, revised, clarified, and published in the recodified set (red volumes) which will replace the black set. Either the article number (black set) or the abbreviated subject title (red set) is used as the first element in citing law in Michie's Annotated Code of Maryland or in references found in the index volumes. The annotated version of the code, which is updated quarterly, is also available on LexisNexis (MD/CODE) or (CODES/ MDCD).

West's Annotated Code of Maryland. St. Paul, Minn.: West Group, 2002. 60 vols., updated annually with pocketparts and cumulative supplements and as needed with replacement volumes/binders. The West version of the annotated code gives the full text of Maryland and court rules in an annotated format with some cross references to the Code of MarylandRegulations,MarylandLaw Encyclopedia, other West publications and annotations to cases. Judicial Materials

There are eight circuit courts and this is the highest common law and court of record in Maryland. The District Court handles claims that involve landlord-tenant cases, actions, motor vehicle violations, mis- demeanors and certain felonies. The Orphans' Courts hear all matters involving decedents' estates and supervises judicially probated estates.

COMAR was created in 1974 to formally compile the rules and regulations issued by Maryland agencies. Generally, each department of state government has its own title in COMAR. At the beginning of each chapter of regulations, there is the statutory authority for the regulations, and at the end, there is an "administrative history" that gives the original effective date of the chapter as well as the dates of any amendments. COMAR is updated in the interim by the Maryland Register, which is issued every other week. Municipal Law Sources

Maryland's local governments consist of 23 counties and the city of Baltimore. Counties provide local services and act as administrative arms of the state. Only 11 counties have a county commission form of governance. Legislative and executive powers are granted directly to the Board of County Commissioners by the Maryland General Assembly. These laws are found in individual codifications of the public local laws. The other 12 Maryland counties operate under a "home rule" form of governance where the state has transferred legislative power in local matters to the county.
